 6|       An Act relating to schools; amending 70 O.S. 2011,              |
  |       Section 11-103.6, as last amended by Section 1,                 |
 7|       Chapter 241, O.S.L. 2018 (70 O.S. Supp. 2018, Section           |
  |       11-103.6), which relates to curricular standards;               |
 8|       requiring certain units or sets of competencies to be           |
  |       taken in certain grades; updating statutory                     |
 9|       reference; amending 70 O.S. 2011, Section 1210.508,             |
  |       as last amended by Section 2, Chapter 67, O.S.L. 2018           |
10|       (70 O.S. Supp. 2018, Section 1210.508), which relates           |
  |       to the statewide system of student assessments;                 |
11|       removing the requirement to administer assessments in           |
  |       U.S. History; providing an effective date; and                  |
12|       declaring an emergency.                                         |

  |                                                                       |
14|                                                                       |
  |                                                                       |
15|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
16|    SECTION 1.     AMENDATORY     70 O.S. 2011, Section 11-103.6, as   |
  |                                                                       |
17|last amended by Section 1, Chapter 241, O.S.L. 2018 (70 O.S. Supp.     |
  |                                                                       |
18|2018, Section 11-103.6), is amended to read as follows:                |
  |                                                                       |
19|    Section 11-103.6.  A.  1.  The State Board of Education shall      |
  |                                                                       |
20|adopt subject matter standards for instruction of students in the      |
  |                                                                       |
21|public schools of this state that are necessary to ensure there is     |
  |                                                                       |
22|attainment of desired levels of competencies in a variety of areas     |
  |                                                                       |
23|to include language, mathematics, science, social studies and          |
  |                                                                       |
24|communication.                                                         |

 1|    2.  School districts shall develop and implement curriculum,       |
  |                                                                       |
 2|courses and instruction in order to ensure that students meet the      |
  |                                                                       |
 3|skills and competencies as set forth in this section and in the        |
  |                                                                       |
 4|subject matter standards adopted by the State Board of Education.      |
  |                                                                       |
 5|    3.  All students shall gain literacy at the elementary and         |
  |                                                                       |
 6|secondary levels.  Students shall develop skills in reading,           |
  |                                                                       |
 7|writing, speaking, computing and critical thinking.  For purposes of   |
  |                                                                       |
 8|this section, critical thinking means a manner of analytical           |
  |                                                                       |
 9|thinking which is logical and uses linear factual analysis to reach    |
  |                                                                       |
10|a conclusion.  They also shall learn about cultures and environments   |
  |                                                                       |
11|- their own and those of others with whom they share the earth.        |
  |                                                                       |
12|Students, therefore, shall study social studies, literature,           |
  |                                                                       |
13|languages, the arts, mathematics and science.  Such curricula shall    |
  |                                                                       |
14|provide for the teaching of a hands-on career exploration program in   |
  |                                                                       |
15|cooperation with technology center schools.                            |
  |                                                                       |
16|    4.  The subject matter standards shall be designed to teach the    |
  |                                                                       |
17|competencies for which students shall be tested as provided in         |
  |                                                                       |
18|Section 1210.508 of this title, and shall be designed to prepare all   |
  |                                                                       |
19|students for active citizenship, employment and/or successful          |
  |                                                                       |
20|completion of postsecondary education without the need for remedial    |
  |                                                                       |
21|coursework at the postsecondary level.                                 |
  |                                                                       |
22|    5.  The subject matter standards shall be designed with rigor as   |
  |                                                                       |
23|defined in paragraph 3 of subsection F of this section.                |
  |                                                                       |

 1|    6.  The subject matter standards for English Language Arts shall   |
  |                                                                       |
 2|give Classic Literature and nonfiction literature equal                |
  |                                                                       |
 3|consideration to other literature.  In addition, emphasis shall be     |
  |                                                                       |
 4|given to the study of complete works of literature.                    |
  |                                                                       |
 5|    7.  At a minimum, the subject matter standards for mathematics     |
  |                                                                       |
 6|shall require mastery of the standard algorithms in mathematics,       |
  |                                                                       |
 7|which is the most logical, efficient way of solving a problem that     |
  |                                                                       |
 8|consistently works, and for students to attain fluency in Euclidian    |
  |                                                                       |
 9|geometry.                                                              |
  |                                                                       |
10|    B.  Subject to the provisions of subsection C of this section,     |
  |                                                                       |
11|in order to graduate from a public high school accredited by the       |
  |                                                                       |
12|State Board of Education with a standard diploma, students shall       |
  |                                                                       |
13|complete the following college preparatory/work ready curriculum       |
  |                                                                       |
14|units or sets of competencies at the secondary level:                  |
  |                                                                       |
15|    1.  Four units or sets of competencies of English to include       |
  |                                                                       |
16|Grammar, Composition, Literature, or any English course approved for   |
  |                                                                       |
17|college admission requirements;                                        |
  |                                                                       |
18|    2.  Three units or sets of competencies of mathematics, limited    |
  |                                                                       |
19|to Algebra I, Algebra II, Geometry, Trigonometry, Math Analysis,       |
  |                                                                       |
20|Calculus, Advanced Placement Statistics, or any mathematics course     |
  |                                                                       |
21|with content and/or rigor above Algebra I and approved for college     |
  |                                                                       |
22|admission requirements;                                                |
  |                                                                       |
23|    3.  Three units or sets of competencies of laboratory science      |
  |                                                                       |
24|approved for college admission requirements, including one unit or     |
  |                                                                       |

 1|set of competencies of life science, meeting the standards for         |
  |                                                                       |
 2|Biology I; one unit or set of competencies of physical science,        |
  |                                                                       |
 3|meeting the standards for Physical Science, Chemistry or Physics;      |
  |                                                                       |
 4|and one unit or set of competencies from the domains of physical       |
  |                                                                       |
 5|science, life science or earth and space science such that the         |
  |                                                                       |
 6|content and rigor is above Biology I or Physical Science;              |
  |                                                                       |
 7|    4.  Three units or sets of competencies of history and             |
  |                                                                       |
 8|citizenship skills, including one unit of American History, 1/2 unit   |
  |                                                                       |
 9|of Oklahoma History, 1/2 unit of United States Government and one      |
  |                                                                       |
10|unit from the subjects of History, Government, Geography, Economics,   |
  |                                                                       |
11|Civics, or non-Western culture and approved for college admission      |
  |                                                                       |
12|requirements; provided, the 1/2 unit of United States Government       |
  |                                                                       |
13|required by this paragraph shall be taken in the eleventh or twelfth   |
  |                                                                       |
14|grade;                                                                 |
  |                                                                       |
15|    5.  Two units or sets of competencies of the same foreign or       |
  |                                                                       |
16|non-English language or two units of computer technology approved      |
  |                                                                       |
17|for college admission requirements, whether taught at a high school    |
  |                                                                       |
18|or a technology center school, including computer programming,         |
  |                                                                       |
19|hardware, and business computer applications, such as word             |
  |                                                                       |
20|processing, databases, spreadsheets, and graphics, excluding           |
  |                                                                       |
21|keyboarding or typing courses;                                         |
  |                                                                       |
22|    6.  One additional unit or set of competencies selected from       |
  |                                                                       |
23|paragraphs 1 through 5 of this subsection or career and technology     |
  |                                                                       |
24|education courses, concurrently enrolled courses, Advanced Placement   |
  |                                                                       |

 1|courses or International Baccalaureate courses approved for college    |
  |                                                                       |
 2|admission requirements; and                                            |
  |                                                                       |
 3|    7.  One unit or set of competencies of fine arts, such as music,   |
  |                                                                       |
 4|art, or drama, or one unit or set of competencies of speech.           |
  |                                                                       |
 5|    C.  In lieu of the requirements of subsection B of this section    |
  |                                                                       |
 6|which requires a college preparatory/work ready curriculum, a          |
  |                                                                       |
 7|student may enroll in the core curriculum as provided in subsection    |
  |                                                                       |
 8|D of this section upon written approval of the parent or legal         |
  |                                                                       |
 9|guardian of the student.  For students under the age of eighteen       |
  |                                                                       |
10|(18) school districts shall require a parent or legal guardian of      |
  |                                                                       |
11|the student to meet with a designee of the school prior to             |
  |                                                                       |
12|enrollment in the core curriculum.  The State Department of            |
  |                                                                       |
13|Education shall develop and distribute to school districts a form      |
  |                                                                       |
14|suitable for this purpose, which shall include information on the      |
  |                                                                       |
15|benefits to students of completing the college preparatory/work        |
  |                                                                       |
16|ready curriculum as provided for in subsection B of this section.      |
  |                                                                       |
17|    D.  For those students subject to the requirements of subsection   |
  |                                                                       |
18|C of this section, in order to graduate from a public high school      |
  |                                                                       |
19|accredited by the State Board of Education with a standard diploma,    |
  |                                                                       |
20|students shall complete the following core curriculum units or sets    |
  |                                                                       |
21|of competencies at the secondary level:                                |
  |                                                                       |
22|    1.  Language Arts  4 units or sets of competencies, to consist     |
  |                                                                       |
23|of 1 unit or set of competencies of grammar and composition, and 3     |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|units or sets of competencies which may include, but are not limited   |
  |                                                                       |
 2|to, the following courses:                                             |
  |                                                                       |
 3|         a.    American Literature,                                    |
  |                                                                       |
 4|         b.    English Literature,                                     |
  |                                                                       |
 5|         c.    World Literature,                                       |
  |                                                                       |
 6|         d.    Advanced English Courses, or                            |
  |                                                                       |
 7|         e.    other English courses with content and/or rigor equal   |
  |                                                                       |
 8|              to or above grammar and composition;                     |
  |                                                                       |
 9|    2.  Mathematics  3 units or sets of competencies, to consist of    |
  |                                                                       |
10|1 unit or set of competencies of Algebra I or Algebra I taught in a    |
  |                                                                       |
11|contextual methodology, and 2 units or sets of competencies which      |
  |                                                                       |
12|may include, but are not limited to, the following courses:            |
  |                                                                       |
13|         a.    Algebra II,                                             |
  |                                                                       |
14|         b.    Geometry or Geometry taught in a contextual             |
  |                                                                       |
15|              methodology,                                             |
  |                                                                       |
16|         c.    Trigonometry,                                           |
  |                                                                       |
17|         d.    Math Analysis or Precalculus,                           |
  |                                                                       |
18|         e.    Calculus,                                               |
  |                                                                       |
19|         f.    Statistics and/or Probability,                          |
  |                                                                       |
20|         g.    Computer Science or acceptance and successful           |
  |                                                                       |
21|              completion of one (1) year of a full-time, three-hour    |
  |                                                                       |
22|              career and technology program leading to an industry     |
  |                                                                       |
23|              credential/certificate or college credit.  The State     |
  |                                                                       |
24|              Board of Career and Technology Education shall           |
  |                                                                       |

 1|              promulgate rules to define the provisions of this act    |
  |                                                                       |
 2|              section related to the accepted industry-valued          |
  |                                                                       |
 3|              credentials which are industry-endorsed or               |
  |                                                                       |
 4|              industry-aligned.  The list of accepted                  |
  |                                                                       |
 5|              industry-valued credentials shall be reviewed annually   |
  |                                                                       |
 6|              and updated at least every three (3) years by the        |
  |                                                                       |
 7|              Board,                                                   |
  |                                                                       |
 8|         h.   (1)   contextual mathematics courses which enhance       |
  |                                                                       |
 9|                   technology preparation, or                          |
  |                                                                       |
10|              (2)  a science, technology, engineering and math         |
  |                                                                       |
11|                   (STEM) block course meeting the requirements for    |
  |                                                                       |
12|                   course competencies listed in paragraph 2 of        |
  |                                                                       |
13|                   subsection B of this section, whether taught at     |
  |                                                                       |
14|                   a:                                                  |
  |                                                                       |
15|                   (a)  comprehensive high school, or                  |
  |                                                                       |
16|                   (b)  technology center school when taken in the     |
  |                                                                       |
17|                        tenth, eleventh or twelfth grade, taught by    |
  |                                                                       |
18|                        a certified teacher, and approved by the       |
  |                                                                       |
19|                        State Board of Education and the independent   |
  |                                                                       |
20|                        district board of education,                   |
  |                                                                       |
21|         i.    mathematics courses taught at a technology center       |
  |                                                                       |
22|              school by a teacher certified in the secondary subject   |
  |                                                                       |
23|              area when taken in the tenth, eleventh or twelfth        |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|              grade upon approval of the State Board of Education      |
  |                                                                       |
 2|              and the independent district board of education, or      |
  |                                                                       |
 3|         j.    any other mathematics course with content and/or        |
  |                                                                       |
 4|              rigor equal to or above Algebra I;                       |
  |                                                                       |
 5|    3.  Science  3 units or sets of competencies, to consist of 1      |
  |                                                                       |
 6|unit or set of competencies of Biology I or Biology I taught in a      |
  |                                                                       |
 7|contextual methodology, and 2 units or sets of competencies in the     |
  |                                                                       |
 8|areas of life, physical, or earth science or technology which may      |
  |                                                                       |
 9|include, but are not limited to, the following courses:                |
  |                                                                       |
10|         a.    Chemistry I,                                            |
  |                                                                       |
11|         b.    Physics,                                                |
  |                                                                       |
12|         c.    Biology II,                                             |
  |                                                                       |
13|         d.    Chemistry II,                                           |
  |                                                                       |
14|         e.    Physical Science,                                       |
  |                                                                       |
15|         f.    Earth Science,                                          |
  |                                                                       |
16|         g.    Botany,                                                 |
  |                                                                       |
17|         h.    Zoology,                                                |
  |                                                                       |
18|         i.    Physiology,                                             |
  |                                                                       |
19|         j.    Astronomy,                                              |
  |                                                                       |
20|         k.    Applied Biology/Chemistry,                              |
  |                                                                       |
21|         l.    Applied Physics,                                        |
  |                                                                       |
22|         m.    Principles of Technology,                               |
  |                                                                       |
23|         n.    qualified agricultural education courses,               |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|         o.   (1)   contextual science courses which enhance           |
  |                                                                       |
 2|                   technology preparation, or                          |
  |                                                                       |

  |                                                                       |
 5|                   course competencies listed in paragraph 3 of        |
  |                                                                       |
 6|                   subsection B of this section, whether taught at     |

  |                                                                       |

  |                                                                       |

  |                                                                       |

  |                                                                       |
14|         p.    science courses taught at a technology center school    |
  |                                                                       |
15|              by a teacher certified in the secondary subject area     |
  |                                                                       |
16|              when taken in the tenth, eleventh or twelfth grade       |
  |                                                                       |
17|              upon approval of the State Board of Education and the    |
  |                                                                       |
18|              independent district board of education, or              |
  |                                                                       |
19|         q.    other science courses with content and/or rigor equal   |
  |                                                                       |
20|              to or above Biology I;                                   |
  |                                                                       |
21|    4.  Social Studies  3 units or sets of competencies, to consist    |
  |                                                                       |
22|of 1 unit or set of competencies of United States History, 1/2 to 1    |
  |                                                                       |
23|unit or set of competencies of United States Government, which shall   |
  |                                                                       |
24|be taken in the eleventh or twelfth grade, 1/2 unit or set of          |
  |                                                                       |

 1|competencies of Oklahoma History, and 1/2 to 1 unit or set of          |
  |                                                                       |
 2|competencies which may include, but are not limited to, the            |
  |                                                                       |
 3|following courses:                                                     |
  |                                                                       |
 4|         a.    World History,                                          |
  |                                                                       |
 5|         b.    Geography,                                              |
  |                                                                       |
 6|         c.    Economics,                                              |
  |                                                                       |
 7|         d.    Anthropology, or                                        |
  |                                                                       |
 8|         e.    other social studies courses with content and/or        |
  |                                                                       |
 9|              rigor equal to or above United States History, United    |
  |                                                                       |
10|              States Government, and Oklahoma History;                 |
  |                                                                       |
11|    5.  Arts  1 unit or set of competencies which may include, but     |
  |                                                                       |
12|is not limited to, courses in Visual Arts and General Music; and       |
  |                                                                       |
13|    6.  Computer Education or World Language - 1 unit or set of        |
  |                                                                       |
14|competencies of computer technology, whether taught at a high school   |
  |                                                                       |
15|or a technology center school, including computer programming,         |
  |                                                                       |
16|hardware and business computer applications, such as word              |
  |                                                                       |
17|processing, databases, spreadsheets and graphics, excluding            |
  |                                                                       |
18|keyboarding or typing courses, or 1 unit or set of competencies of     |
  |                                                                       |
19|foreign or non-English language.                                       |
  |                                                                       |
20|    E.  1.  In addition to the curriculum requirements of either       |
  |                                                                       |
21|subsection B or D of this section, in order to graduate from a         |
  |                                                                       |
22|public high school accredited by the State Board of Education          |
  |                                                                       |
23|students shall complete the requirements for a personal financial      |
  |                                                                       |
24|literacy passport as set forth in the Passport to Financial Literacy   |
  |                                                                       |

 1|Act and any additional course requirements or recommended elective     |
  |                                                                       |
 2|courses as may be established by the State Board of Education and      |
  |                                                                       |
 3|the district school board.  School districts shall strongly            |
  |                                                                       |
 4|encourage students to complete two units or sets of competencies of    |
  |                                                                       |
 5|foreign languages and two units or sets of competencies of physical    |
  |                                                                       |
 6|and health education.                                                  |
  |                                                                       |
 7|    2.  No student shall receive credit for high school graduation     |
  |                                                                       |
 8|more than once for completion of the same unit or set of               |
  |                                                                       |
 9|competencies to satisfy the curriculum requirements of this section.   |
  |                                                                       |
10|    3.  A school district shall not be required to offer every         |
  |                                                                       |
11|course listed in subsections B and D of this section, but shall        |
  |                                                                       |
12|offer sufficient courses to allow a student to meet the graduation     |
  |                                                                       |
13|requirements during the secondary grade years of the student.          |
  |                                                                       |
14|    F.  For purposes of this section:                                  |
  |                                                                       |
15|    1.  "Contextual methodology" means academic content and skills     |
  |                                                                       |
16|taught by utilizing real-world problems and projects in a way that     |
  |                                                                       |
17|helps students understand the application of that knowledge;           |
  |                                                                       |
18|    2.  "Qualified agricultural education courses" means courses       |
  |                                                                       |
19|that have been determined by the State Board of Education to offer     |
  |                                                                       |
20|the sets of competencies for one or more science content areas and     |
  |                                                                       |
21|which correspond to academic science courses.  Qualified               |
  |                                                                       |
22|agricultural education courses shall include, but are not limited      |
  |                                                                       |
23|to, Horticulture, Plant and Soil Science, Natural Resources and        |
  |                                                                       |
24|Environmental Science, and Animal Science.  The courses shall be       |
  |                                                                       |

 1|taught by teachers certified in agricultural education and comply      |
  |                                                                       |
 2|with all rules of the Oklahoma Department of Career and Technology     |
  |                                                                       |
 3|Education;                                                             |
  |                                                                       |
 4|    3.  "Rigor" means a level of difficulty that is thorough,          |
  |                                                                       |
 5|exhaustive and accurate and is appropriate for the grade level;        |
  |                                                                       |
 6|    4.  "Sets of competencies" means instruction in those skills and   |
  |                                                                       |
 7|competencies that are specified in the subject matter standards        |
  |                                                                       |
 8|adopted by the State Board of Education and other skills and           |
  |                                                                       |
 9|competencies adopted by the Board, without regard to specified         |
  |                                                                       |
10|instructional time; and                                                |
  |                                                                       |
11|    5.  "Unit" means a Carnegie Unit as defined by the North Central   |
  |                                                                       |
12|Association's Commission on Schools.                                   |
  |                                                                       |
13|    G.  1.  The State Board of Education shall adopt a plan to         |
  |                                                                       |
14|ensure that rigor is maintained in the content, teaching               |
  |                                                                       |
15|methodology, level of expectations for student achievement, and        |
  |                                                                       |
16|application of learning in all the courses taught to meet the          |
  |                                                                       |
17|graduation requirements as specified in this section.                  |
  |                                                                       |
18|    2.  The State Board of Education shall allow as much flexibility   |
  |                                                                       |
19|at the district level as is possible without diminishing the rigor     |
  |                                                                       |
20|or undermining the intent of providing these courses.  To accomplish   |
  |                                                                       |
21|this purpose, the State Department of Education shall work with        |
  |                                                                       |
22|school districts in reviewing and approving courses taught by          |
  |                                                                       |
23|districts that are not specifically listed in subsections B and D of   |
  |                                                                       |
24|this section.  Options may include, but shall not be limited to,       |
  |                                                                       |

 1|courses taken by concurrent enrollment, advanced placement, or         |
  |                                                                       |
 2|correspondence, or courses bearing different titles.                   |
  |                                                                       |
 3|    3.  The State Board of Education shall approve an advanced         |
  |                                                                       |
 4|placement computer science course to meet the requirements of course   |
  |                                                                       |
 5|competencies listed in paragraph 2 of subsection B of this section     |
  |                                                                       |
 6|if the course is taken in a student's senior year and the student is   |
  |                                                                       |
 7|concurrently enrolled in or has successfully completed Algebra II.     |
  |                                                                       |
 8|    4.  Technology center school districts may offer programs          |
  |                                                                       |
 9|designed in cooperation with institutions of higher education which    |
  |                                                                       |
10|have an emphasis on a focused field of career study upon approval of   |
  |                                                                       |
11|the State Board of Education and the independent district board of     |
  |                                                                       |
12|education.  Students in the tenth grade may be allowed to attend       |
  |                                                                       |
13|these programs for up to one-half (1/2) of a school day and credit     |
  |                                                                       |
14|for the units or sets of competencies required in paragraphs 2, 3      |
  |                                                                       |
15|and 6 of subsection B or D of this section shall be given if the       |
  |                                                                       |
16|courses are taught by a teacher certified in the secondary subject     |
  |                                                                       |
17|area; provided, credit for units or sets of competencies pursuant to   |
  |                                                                       |
18|subsection B of this section shall be approved for college admission   |
  |                                                                       |
19|requirements.                                                          |
  |                                                                       |
20|    5.  If a student enrolls in a concurrent course, the school        |
  |                                                                       |
21|district shall not be responsible for any costs incurred for that      |
  |                                                                       |
22|course, unless the school district does not offer enough course        |
  |                                                                       |
23|selection during the student's secondary grade years to allow the      |

 1|requirements of this section.  If the school district does not offer   |
  |                                                                       |
 2|the necessary course selection during the student's secondary grade    |
  |                                                                       |
 3|years, it shall be responsible for the cost of resident tuition at     |
  |                                                                       |
 4|an institution in The Oklahoma State System of Higher Education,       |
  |                                                                       |
 5|fees, and books for the concurrent enrollment course, and providing    |
  |                                                                       |
 6|for transportation to and from the institution to the school site.     |
  |                                                                       |
 7|    It is the intent of the Legislature that for students enrolled     |
  |                                                                       |
 8|in a concurrent enrollment course which is paid for by the school      |
  |                                                                       |
 9|district pursuant to this paragraph, the institution charge only the   |
  |                                                                       |
10|supplementary and special service fees that are directly related to    |
  |                                                                       |
11|the concurrent enrollment course and enrollment procedures for that    |
  |                                                                       |
12|student.  It is further the intent of the Legislature that fees for    |
  |                                                                       |
13|student activities and student service facilities, including the       |
  |                                                                       |
14|student health care and cultural and recreational service fees, not    |
  |                                                                       |
15|be charged to such students.                                           |
  |                                                                       |
16|    6.  Credit for the units or sets of competencies required in       |
  |                                                                       |
17|subsection B or D of this section shall be given when such units or    |
  |                                                                       |
18|sets of competencies are taken prior to ninth grade if the teachers    |
  |                                                                       |
19|are certified or authorized to teach the subjects for high school      |
  |                                                                       |
20|credit and the required rigor is maintained.                           |
  |                                                                       |
21|    7.  The three units or sets of competencies in mathematics         |
  |                                                                       |
22|required in subsection B or D of this section shall be completed in    |
  |                                                                       |
23|the ninth through twelfth grades.  If a student completes any          |
  |                                                                       |
24|required courses or sets of competencies in mathematics prior to       |
  |                                                                       |

 1|ninth grade, the student may take any other mathematics courses or     |
  |                                                                       |
 2|sets of competencies to fulfill the requirement to complete three      |
  |                                                                       |
 3|units or sets of competencies in grades nine through twelve after      |
  |                                                                       |
 4|the student has satisfied the requirements of subsection B or D of     |
  |                                                                       |
 5|this section.                                                          |
  |                                                                       |
 6|    8.  All units or sets of competencies required for graduation      |
  |                                                                       |
 7|may be taken in any sequence recommended by the school district.       |
  |                                                                       |
 8|    H.  As a condition of receiving accreditation from the State       |
  |                                                                       |
 9|Board of Education, all students in grades nine through twelve shall   |
  |                                                                       |
10|enroll in a minimum of six periods, or the equivalent in block         |
  |                                                                       |
11|scheduling or other scheduling structure that allows for instruction   |
  |                                                                       |
12|in sets of competencies, of rigorous academic and/or rigorous          |
  |                                                                       |
13|vocational courses each day, which may include arts, vocal and         |
  |                                                                       |
14|instrumental music, speech classes, and physical education classes.    |
  |                                                                       |
15|    I.  1.  Academic and vocational-technical courses designed to      |
  |                                                                       |
16|offer sets of competencies integrated or embedded within the course    |
  |                                                                       |
17|that provide for the teaching and learning of the appropriate skills   |
  |                                                                       |
18|and knowledge in the subject matter standards, as adopted by the       |
  |                                                                       |
19|State Board of Education, may upon approval of the Board, in           |
  |                                                                       |
20|consultation with the Oklahoma Department of Career and Technology     |
  |                                                                       |
21|Education if the courses are offered at a technology center school     |
  |                                                                       |
22|district, be counted for academic credit and toward meeting the        |
  |                                                                       |
23|graduation requirements of this section.                               |

 1|    2.  Internet-based courses offered by a technology center school   |
  |                                                                       |
 2|that are taught by a certified teacher and provide for the teaching    |

  |                                                                       |
 4|matter standards may, upon approval of the State Board of Education    |
  |                                                                       |
 5|and the independent district board of education, be counted for        |
  |                                                                       |
 6|academic credit and toward meeting the graduation requirements of      |
  |                                                                       |
 7|this section.                                                          |
  |                                                                       |
 8|    3.  Internet-based courses or vocational-technical courses         |
  |                                                                       |
 9|utilizing integrated or embedded skills for which no subject matter    |
  |                                                                       |
10|standards have been adopted by the State Board of Education may be     |
  |                                                                       |
11|approved by the Board, in consultation with the Oklahoma Department    |
  |                                                                       |
12|of Career and Technology Education if the courses are offered at a     |
  |                                                                       |
13|technology center school district, if such courses incorporate         |
  |                                                                       |
14|standards of nationally recognized professional organizations and      |
  |                                                                       |
15|are taught by certified teachers.                                      |
  |                                                                       |
16|    4.  Courses offered by a supplemental education organization       |
  |                                                                       |
17|that is accredited by a national accrediting body and that are         |
  |                                                                       |
18|taught by a certified teacher and provide for the teaching and         |
  |                                                                       |
19|learning of the appropriate skills and knowledge in the subject        |
  |                                                                       |
20|matter standards may, upon approval of the State Board of Education    |
  |                                                                       |
21|and the school district board of education, be counted for academic    |
  |                                                                       |
22|credit and toward meeting the graduation requirements of this          |
  |                                                                       |
23|section.                                                               |

 1|    J.  The State Board of Education shall provide an option for       |
  |                                                                       |
 2|high school graduation based upon attainment of the desired levels     |
  |                                                                       |
 3|of competencies as required in tests pursuant to the provisions of     |
  |                                                                       |
 4|Section 1210.508 of this title.  Such option shall be in lieu of the   |
  |                                                                       |
 5|amount of course credits earned.                                       |
  |                                                                       |
 6|    K.  The State Board of Education shall prescribe, adopt and        |
  |                                                                       |
 7|approve a promotion system based on the attainment by students of      |
  |                                                                       |
 8|specified levels of competencies in each area of the core              |
  |                                                                       |
 9|curriculum.                                                            |
  |                                                                       |
10|    L.  Children who have individualized education programs pursuant   |
  |                                                                       |
11|to the Individuals with Disabilities Education Act (IDEA), and who     |
  |                                                                       |
12|satisfy the graduation requirements through the individualized         |
  |                                                                       |
13|education program for that student shall be awarded a standard         |
  |                                                                       |
14|diploma.                                                               |
  |                                                                       |
15|    M.  Students who enter the ninth grade in or prior to the          |
  |                                                                       |
16|2007-08 school year who are enrolled in an alternative education       |
  |                                                                       |
17|program and meet the requirements of their plans leading to high       |
  |                                                                       |
18|school graduation developed pursuant to Section 1210.568 of this       |
  |                                                                       |
19|title shall be awarded a standard diploma.                             |
  |                                                                       |
20|    N.  Any student who completes the curriculum requirements of the   |
  |                                                                       |
21|International Baccalaureate Diploma Program shall be awarded a         |
  |                                                                       |
22|standard diploma.                                                      |
  |                                                                       |
23|    O.  Any student who successfully completes an advanced             |
  |                                                                       |
24|mathematics or science course offered pursuant to Section 1210.404     |
  |                                                                       |

 1|of this title shall be granted academic credit toward meeting the      |
  |                                                                       |
 2|graduation requirements pursuant to paragraph 2 or 3, as               |
  |                                                                       |
 3|appropriate, of subsection B or D of this section.                     |
  |                                                                       |
 4|    P.  For purposes of this section, the courses approved for         |
  |                                                                       |
 5|college admission requirements shall be courses which are approved     |
  |                                                                       |
 6|by the Oklahoma State Regents for Higher Education for admission to    |
  |                                                                       |
 7|an institution within The Oklahoma State System of Higher Education.   |
  |                                                                       |
 8|    Q.  Students who have been denied a standard diploma by the        |
  |                                                                       |
 9|school district in which the student is or was enrolled for failing    |
  |                                                                       |
10|to meet the requirements of this section may re-enroll in the school   |
  |                                                                       |
11|district that denied the student a standard diploma following the      |
  |                                                                       |
12|denial of a standard diploma.  The student shall be provided           |
  |                                                                       |
13|remediation or intervention and the opportunity to complete the        |
  |                                                                       |
14|curriculum units or sets of competencies required by this section to   |
  |                                                                       |
15|obtain a standard diploma.  Students who re-enroll in the school       |
  |                                                                       |
16|district to meet the graduation requirements of this section shall     |
  |                                                                       |
17|be exempt from the hourly instructional requirements of Section        |
  |                                                                       |
18|1-111 of this title and the six-period enrollment requirements of      |
  |                                                                       |
19|this section.                                                          |
  |                                                                       |
20|    R.  The State Department of Education shall collect and report     |
  |                                                                       |
21|data by school site and district on the number of students who         |
  |                                                                       |
22|enroll in the core curriculum as provided in subsection D of this      |
  |                                                                       |
23|section.                                                               |

 1|    SECTION 2.     AMENDATORY     70 O.S. 2011, Section 1210.508, as   |
  |                                                                       |
 2|last amended by Section 2, Chapter 67, O.S.L. 2018 (70 O.S. Supp.      |
  |                                                                       |
 3|2018, Section 1210.508), is amended to read as follows:                |
  |                                                                       |
 4|    Section 1210.508.  A.  1.  By no later than December 31, 2016,     |
  |                                                                       |
 5|the State Board of Education shall adopt a statewide system of         |
  |                                                                       |
 6|student assessments in compliance with the Elementary and Secondary    |
  |                                                                       |
 7|Education Act of 1965 (ESEA), as reauthorized and amended by P.L.      |
  |                                                                       |
 8|No. 114-95, also known as the Every Student Succeeds Act (ESSA).       |
  |                                                                       |
 9|    2.  The statewide student assessment system adopted by the Board   |
  |                                                                       |
10|pursuant to this subsection shall be aligned with the Oklahoma         |
  |                                                                       |
11|Academic Standards as adopted by the Board and which prepare           |
  |                                                                       |
12|students for college and careers.                                      |
  |                                                                       |
13|    B.  1.  The Board shall issue a request for proposals for the      |
  |                                                                       |
14|selection of assessments to be administered to students in grades      |
  |                                                                       |
15|three through twelve as a part of the statewide student assessment     |
  |                                                                       |
16|system adopted by the Board pursuant to this section.                  |
  |                                                                       |
17|    2.  The Board shall adopt assessments from the selected            |
  |                                                                       |
18|proposals that were submitted pursuant to paragraph 1 of this          |
  |                                                                       |
19|subsection.  The adopted assessments shall be administered by the      |
  |                                                                       |
20|Board for a period that is in coordination with the six-year subject   |
  |                                                                       |
21|area textbook adoption cycle unless the vendor does not fulfill the    |
  |                                                                       |
22|terms of the contract or fails to comply with or violates the terms    |
  |                                                                       |
23|of the contract.  The Board shall administer the assessments           |
  |                                                                       |
24|beginning with the 2017-2018 school year.                              |

 1|    C.  The statewide student assessment system adopted by the Board   |
  |                                                                       |
 2|pursuant to this section shall include assessments that:               |
  |                                                                       |
 3|    1.  Are aligned with the Oklahoma subject matter standards as      |
  |                                                                       |
 4|adopted by the Board;                                                  |
  |                                                                       |
 5|    2.  Provide a measure of comparability among other states;         |
  |                                                                       |
 6|    3.  Yield both norm-referenced scores and criterion-referenced     |
  |                                                                       |
 7|scores;                                                                |
  |                                                                       |
 8|    4.  Have a track record of statistical reliability and accuracy;   |
  |                                                                       |
 9|and                                                                    |
  |                                                                       |
10|    5.  For assessments administered in high school, provide a         |
  |                                                                       |
11|measure of future academic performance.                                |
  |                                                                       |
12|    D.  For the 2016-2017 school year, the Board shall administer      |
  |                                                                       |
13|assessments in:                                                        |
  |                                                                       |
14|    1.  English Language Arts or Reading and Mathematics in grades     |
  |                                                                       |
15|three through eight and at least once in high school, during the       |
  |                                                                       |
16|grade span of nine through twelve;                                     |
  |                                                                       |
17|    2.  Science not less than once during each grade span of three     |
  |                                                                       |
18|through five, six through nine and ten through twelve; and             |
  |                                                                       |
19|    3.  United States History not less than once during the grade      |
  |                                                                       |
20|span of nine through twelve.                                           |
  |                                                                       |
21|    E.  1.  Beginning with the 2017-2018 school year, the statewide    |
  |                                                                       |
22|student assessment system shall include assessments in:                |
  |                                                                       |
23|                                                                       |
  |                                                                       |

  |                                                                       |
 5|              three through five, six through nine and ten through     |
  |                                                                       |
 6|              twelve, and                                              |
  |                                                                       |
 7|         c.    United States History, with an emphasis on civics,      |
  |                                                                       |
 8|              not less than once during the grade span of nine         |
  |                                                                       |
 9|              through twelve.                                          |
  |                                                                       |
10|    2.  Beginning with the 2017-2018 school year, the statewide        |
  |                                                                       |
11|student assessment system may include:                                 |
  |                                                                       |
12|         a.    assessments in Reading and Writing in certain grades    |
  |                                                                       |
13|              as determined by the Board, and                          |
  |                                                                       |
14|         b.    contingent upon the availability of funds, an           |
  |                                                                       |
15|              additional nationally recognized college- and            |
  |                                                                       |
16|              career-readiness assessment or assessments as            |
  |                                                                       |
17|              recommended by the State Department of Education which   |
  |                                                                       |
18|              will be administered to students in high school at no    |
  |                                                                       |
19|              cost to the student.                                     |
  |                                                                       |
20|    F.  1.  Beginning with students entering the ninth grade in the    |
  |                                                                       |
21|2017-2018 school year, each student shall take the assessment or       |
  |                                                                       |
22|assessments included in the statewide student assessment system        |
  |                                                                       |
23|adopted by the Board pursuant to subsection A of this section in       |
  |                                                                       |
24|order to graduate from a public high school with a standard diploma.   |

 1| All students shall take the assessment or assessments prior to        |
  |                                                                       |
 2|graduation, unless otherwise exempt by law.                            |

 3|    2.  Beginning with students entering the ninth grade in the        |
  |                                                                       |
 4|2017-2018 school year, each student, in addition to taking the         |
  |                                                                       |
 5|assessment or assessments included in the statewide student            |
  |                                                                       |
 6|assessment system adopted by the Board pursuant to subsection A of     |
  |                                                                       |
 7|this section, shall meet any other high school graduation              |
  |                                                                       |
 8|requirements adopted by the Board pursuant to Section 5 of Enrolled    |
  |                                                                       |
 9|House Bill No. 3218 of the 2nd Session of the 55th Oklahoma            |
  |                                                                       |
10|Legislature in order to graduate from a public high school with a      |
  |                                                                       |
11|standard diploma.                                                      |
  |                                                                       |
12|    3.  For students who start the ninth grade prior to or during      |
  |                                                                       |
13|the 2016-2017 school year, school districts shall adopt a plan that    |
  |                                                                       |
14|establishes the assessment or assessments those students are           |
  |                                                                       |
15|required to take in order to graduate from a public high school with   |
  |                                                                       |
16|a standard diploma.  The plan may also include any or all of the       |
  |                                                                       |
17|other high school graduation requirements adopted by the Board         |
  |                                                                       |
18|pursuant to Section 5 of Enrolled House Bill No. 3218 of the 2nd       |
  |                                                                       |
19|Session of the 55th Oklahoma Legislature that those students will be   |
  |                                                                       |
20|required to meet in order to graduate from a public high school with   |
  |                                                                       |
21|a standard diploma.                                                    |
  |                                                                       |
22|    4.  The Board shall promulgate rules to ensure that students who   |
  |                                                                       |
23|transfer into an Oklahoma school district from out-of-state after      |
  |                                                                       |
24|the junior year of high school shall not be denied the opportunity     |
  |                                                                       |

 1|to be awarded a standard diploma due to differing testing              |
  |                                                                       |
 2|requirements.                                                          |
  |                                                                       |
 3|    G.  In order to provide an indication of the levels of             |
  |                                                                       |
 4|competency attained by the student in a permanent record for           |
  |                                                                       |
 5|potential future employers and institutions of higher education,       |
  |                                                                       |
 6|school districts shall report on the high school transcript of the     |
  |                                                                       |
 7|student the highest-achieved score on the assessment or assessments    |
  |                                                                       |
 8|included in the statewide student assessment system adopted by the     |
  |                                                                       |
 9|Board pursuant to subsection A of this section and any business- and   |
  |                                                                       |
10|industry-recognized endorsements attained.                             |
  |                                                                       |
11|    H.  Students who do not perform at a proficiency level on          |
  |                                                                       |
12|assessments shall be remediated as established in the assessment       |
  |                                                                       |
13|requirements adopted by the Board pursuant to Section 5 of Enrolled    |
  |                                                                       |
14|House Bill No. 3218 of the 2nd Session of the 55th Oklahoma            |
  |                                                                       |
15|Legislature, subject to the availability of funding.                   |
  |                                                                       |
16|    I.  1.  All assessments required by this section shall measure     |
  |                                                                       |
17|academic competencies in correlation with the subject matter           |
  |                                                                       |
18|standards adopted by the Board pursuant to Sections 11-103.6 and       |
  |                                                                       |
19|11-103.6a of this title and referred to as the Oklahoma Academic       |
  |                                                                       |
20|Standards.  The State Board of Education shall evaluate the subject    |
  |                                                                       |
21|matter standards to ensure the competencies reflect high standards,    |
  |                                                                       |
22|are specific, well-defined, measurable, challenging, and will          |
  |                                                                       |
23|prepare elementary students for next-grade-level course work and       |
  |                                                                       |
24|secondary students for postsecondary studies at institutions of        |
  |                                                                       |

 1|higher education or technology center schools without the need for     |
  |                                                                       |
 2|remediation.  All subject matter standards shall reflect the goals     |
  |                                                                       |
 3|as set forth in Section 11-103.6 of this title and of improving the    |
  |                                                                       |
 4|state average ACT score.                                               |
  |                                                                       |
 5|    2.  The State Department of Education shall annually evaluate      |
  |                                                                       |
 6|the results of the assessments.  The State Board of Education shall    |
  |                                                                       |
 7|ensure that preliminary results for all statewide assessments are      |
  |                                                                       |
 8|reported to districts no later than June 1 of each year and are        |
  |                                                                       |
 9|presented in a manner that yields detailed, diagnostic information     |
  |                                                                       |
10|for the purpose of guiding instruction and student remediation.  As    |
  |                                                                       |
11|improvements are made to the assessments required by this section,     |
  |                                                                       |
12|the Board shall seek to increase the depth of knowledge assessed for   |
  |                                                                       |
13|each subject.  The State Board of Education shall seek to ensure       |
  |                                                                       |
14|that data yielded from the assessments required in this section are    |
  |                                                                       |
15|utilized at the school district level to inform instruction,           |
  |                                                                       |
16|professional development, school improvement and remediation for       |
  |                                                                       |
17|students.                                                              |
  |                                                                       |
18|    3.  The Commission for Educational Quality and Accountability      |
  |                                                                       |
19|shall determine the cut scores for the performance levels on all       |
  |                                                                       |
20|statewide assessments.  The Commission shall conduct an ongoing        |
  |                                                                       |
21|review to compare the statewide assessment content and performance     |
  |                                                                       |
22|descriptors with those of other states.  Upon receipt of the review,   |
  |                                                                       |
23|the Commission may adjust the cut scores as necessary.                 |
  |                                                                       |

 1|    4.  The State Board of Education, for the purposes of conducting   |
  |                                                                       |
 2|reliability and validity studies, monitoring contractor adherence to   |
  |                                                                       |
 3|professionally accepted testing standards, and providing               |
  |                                                                       |
 4|recommendations for testing program improvement, shall retain the      |
  |                                                                       |
 5|services of an established, independent agency or organization that    |
  |                                                                       |
 6|is nationally recognized for its technical expertise in educational    |
  |                                                                       |
 7|testing but is not engaged in the development of aptitude or           |
  |                                                                       |
 8|achievement tests for elementary or secondary level grades.  These     |
  |                                                                       |
 9|national assessment experts shall annually conduct studies of the      |
  |                                                                       |
10|reliability and validity of the statewide assessments administered     |
  |                                                                       |
11|pursuant to this section.  Validity studies shall include studies of   |
  |                                                                       |
12|decision validity and concurrent validity.                             |
  |                                                                       |
13|    J.  1.  The State Board of Education shall promulgate rules        |
  |                                                                       |
14|setting the assessment window dates for each statewide assessment so   |
  |                                                                       |
15|that the assessments are administered according to recommended         |
  |                                                                       |
16|testing protocols, and so that the assessment results are reported     |
  |                                                                       |
17|back to school districts in a timely manner.  The vendor shall         |
  |                                                                       |
18|provide a final electronic data file of all school site, school        |
  |                                                                       |
19|district, and state results to the State Department of Education and   |
  |                                                                       |
20|the Office of Educational Quality and Accountability prior to August   |
  |                                                                       |
21|1 of each year.  The Department shall forward the final data files     |
  |                                                                       |
22|for each school district and each school site in that district to      |
  |                                                                       |
23|the school district.  The Board shall ensure the contract with the     |
  |                                                                       |
24|vendor includes a provision that the vendor report assessment          |
  |                                                                       |

 1|results directly to the Office of Educational Quality and              |
  |                                                                       |
 2|Accountability at the same time it is reported to the Board.           |
  |                                                                       |
 3|    2.  State, district, and site level results of all assessments     |
  |                                                                       |
 4|required in this section shall be disaggregated by gender, race,       |
  |                                                                       |
 5|ethnicity, disability status, migrant status, English proficiency,     |
  |                                                                       |
 6|and status as economically disadvantaged, except that such             |
  |                                                                       |
 7|disaggregation shall not be required in a case in which the number     |
  |                                                                       |
 8|of students in a category is insufficient to yield statistically       |
  |                                                                       |
 9|reliable information or the results would reveal personally            |
  |                                                                       |
10|identifiable information about an individual student.  Each school     |
  |                                                                       |
11|site shall notify the student's parents of the school's performance    |
  |                                                                       |
12|levels in the Oklahoma School Testing Program as reported in the       |
  |                                                                       |
13|Oklahoma Educational Indicators Program at the end of each school      |
  |                                                                       |
14|year.                                                                  |
  |                                                                       |
15|    K.  The State Board of Education shall be responsible for the      |
  |                                                                       |
16|field-testing and validation of the statewide assessment system        |
  |                                                                       |
17|required in subsection A of this section.                              |
  |                                                                       |
18|    L.  The State Board of Education shall develop, administer, and    |
  |                                                                       |
19|incorporate as a part of the Oklahoma School Testing Program, other    |
  |                                                                       |
20|assessment programs or procedures, including appropriate               |

 1|    M.  For purposes of developing and administering alternate         |
  |                                                                       |
 2|assessments for students with the most significant cognitive           |
  |                                                                       |
 3|disabilities, the State Board of Education shall not be subject to     |
  |                                                                       |
 4|subsections D and E of Section 11-103.6a of this title.                |
  |                                                                       |
 5|    SECTION 3.  This act shall become effective July 1, 2019.          |
  |                                                                       |
 6|    SECTION 4.  It being immediately necessary for the preservation    |
  |                                                                       |
 7|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
 8|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
 9|be in full force from and after its passage and approval.              |
  |                                                                       |
