 7|       An Act relating to schools; amending 70 O.S. 2011,              |
  |       Section 1210.192, which relates to exemptions from              |
 8|       immunizations; requiring school districts to report             |
  |       certain information to State Department of Health;              |
 9|       specifying submission date and minimum required                 |
  |       information; directing promulgation of rules;                   |
10|       providing an effective date; and declaring an                   |
  |       emergency.                                                      |

  |                                                                       |
13|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
14|    SECTION 1.     AMENDATORY     70 O.S. 2011, Section 1210.192, is   |
  |                                                                       |
15|amended to read as follows:                                            |
  |                                                                       |
16|    Section 1210.192.  A.  Any minor child, through the parent,        |
  |                                                                       |
17|guardian, or legal custodian of the child, may submit to the health    |
  |                                                                       |
18|authority charged with the enforcement of the immunization laws of     |
  |                                                                       |
19|this state:                                                            |
  |                                                                       |
20|    1.  A certificate of a licensed physician as defined in Section    |
  |                                                                       |
21|725.2 of Title 59 of the Oklahoma Statutes, stating that the           |
  |                                                                       |
22|physical condition of the child is such that immunization would        |
  |                                                                       |
23|endanger the life or health of the child; or                           |
  |                                                                       |

 1|    2.  A written statement by the parent, guardian or legal           |
  |                                                                       |
 2|custodian of the child objecting to immunization of the child;         |
  |                                                                       |
 3|whereupon the child shall be exempt from the immunization laws of      |
  |                                                                       |
 4|this state.                                                            |
  |                                                                       |
 5|    B.  Each school district in this state shall report the number     |
  |                                                                       |
 6|and type of exemptions from vaccinations as provided by subsection A   |
  |                                                                       |
 7|of this section to the State Department of Health.  Such information   |
  |                                                                       |
 8|shall be submitted to the Department on or before a date determined    |
  |                                                                       |
 9|by the State Commissioner of Health, and shall include information     |
  |                                                                       |
10|from the most recently completed school year.                          |
  |                                                                       |
11|    C.  The Commissioner shall promulgate rules to implement this      |
  |                                                                       |
12|section.                                                               |
  |                                                                       |
13|    SECTION 2.  This act shall become effective July 1, 2019.          |
  |                                                                       |
14|    SECTION 3.  It being immediately necessary for the preservation    |
  |                                                                       |
15|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
16|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
17|be in full force from and after its passage and approval.              |
  |                                                                       |
