11|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
12|    SECTION 1.     AMENDATORY     70 O.S. 2011, Section 3-104, as      |
  |                                                                       |
13|last amended by Section 1, Chapter 271, O.S.L. 2013 (70 O.S. Supp.     |
  |                                                                       |
14|2018, Section 3-104), is amended to read as follows:                   |
  |                                                                       |
15|    Section 3-104.  The supervision of the public school system of     |
  |                                                                       |
16|Oklahoma shall be vested in the State Board of Education and,          |
  |                                                                       |
17|subject to limitations otherwise provided by law, the State Board of   |
  |                                                                       |
18|Education shall:                                                       |
  |                                                                       |
19|    1.  Adopt policies and make rules for the operation of the         |
  |                                                                       |
20|public school system of the state;                                     |
  |                                                                       |
21|    2.  Appoint, prescribe the duties and fix the compensation of a    |
  |                                                                       |
22|secretary, an attorney and all other personnel necessary for the       |
  |                                                                       |
23|proper performance of the functions of the State Board of Education.   |
  |                                                                       |
24| The secretary shall not be a member of the Board;                     |
  |                                                                       |

 1|    3.  Submit to the Governor a departmental budget based upon        |
  |                                                                       |
 2|major functions of the Department as prepared by the State             |
  |                                                                       |
 3|Superintendent of Public Instruction and supported by detailed data    |
  |                                                                       |
 4|on needs and proposed operations as partially determined by the        |
  |                                                                       |
 5|budgetary needs of local school districts filed with the State Board   |
  |                                                                       |
 6|of Education for the ensuing fiscal year.  Appropriations therefor     |
  |                                                                       |
 7|shall be made in lump-sum form for each major item in the budget as    |
  |                                                                       |
 8|follows:                                                               |
  |                                                                       |
 9|         a.   State Aid to schools,                                    |
  |                                                                       |
10|         b.   the supervision of all other functions of general and    |
  |                                                                       |
11|              special education including general control, free        |
  |                                                                       |
12|              textbooks, school lunch, Indian education and all        |
  |                                                                       |
13|              other functions of the Board and an amount sufficient    |
  |                                                                       |
14|              to adequately staff and administer these services, and   |
  |                                                                       |
15|         c.   the Board shall determine the details by which the       |
  |                                                                       |
16|              budget and the appropriations are administered.          |
  |                                                                       |
17|              Annually, the Board shall make preparations to           |
  |                                                                       |
18|              consolidate all of the functions of the Department in    |
  |                                                                       |
19|              such a way that the budget can be based on two items,    |
  |                                                                       |
20|              administration and aid to schools.  A maximum amount     |
  |                                                                       |
21|              for administration shall be designated as a part of      |
  |                                                                       |
22|              the total appropriation;                                 |
  |                                                                       |
23|    4.  On the first day of December preceding each regular session    |
  |                                                                       |
24|of the Legislature, prepare and deliver to the Governor and the        |
  |                                                                       |

 1|Legislature a report for the year ending June 30 immediately           |
  |                                                                       |
 2|preceding the regular session of the Legislature.  The report shall    |
  |                                                                       |
 3|contain:                                                               |
  |                                                                       |
 4|         a.   detailed statistics and other information concerning     |
  |                                                                       |
 5|              enrollment, attendance, expenditures including State     |
  |                                                                       |
 6|              Aid, and other pertinent data for all public schools     |
  |                                                                       |
 7|              in this state,                                           |
  |                                                                       |
 8|         b.   reports from each and every division within the State    |
  |                                                                       |
 9|              Department of Education as submitted by the State        |
  |                                                                       |
10|              Superintendent of Public Instruction and any other       |
  |                                                                       |
11|              division, department, institution or other agency        |
  |                                                                       |
12|              under the supervision of the Board,                      |
  |                                                                       |
13|         c.   recommendations for the improvement of the public        |
  |                                                                       |
14|              school system of the state,                              |
  |                                                                       |
15|         d.   a statement of the receipts and expenditures of the      |
  |                                                                       |
16|              State Board of Education for the past year, and          |
  |                                                                       |
17|         e.   a statement of plans and recommendations for the         |
  |                                                                       |
18|              management and improvement of public schools and such    |
  |                                                                       |
19|              other information relating to the educational            |
  |                                                                       |
20|              interests of the state as may be deemed necessary and    |
  |                                                                       |
21|              desirable;                                               |
  |                                                                       |
22|    5.  Provide for the formulation and adoption of curricula,         |
  |                                                                       |
23|courses of study and other instructional aids necessary for the        |
  |                                                                       |
24|adequate instruction of pupils in the public schools;                  |
  |                                                                       |

 1|    6.  Have authority in matters pertaining to the licensure and      |
  |                                                                       |
 2|certification of persons for instructional, supervisory and            |
  |                                                                       |
 3|administrative positions and services in the public schools of the     |
  |                                                                       |
 4|state subject to the provisions of Section 6-184 of this title, and    |
  |                                                                       |
 5|shall formulate rules governing the issuance and revocation of         |
  |                                                                       |
 6|certificates for superintendents of schools, principals,               |
  |                                                                       |
 7|supervisors, librarians, clerical employees, school nurses, school     |
  |                                                                       |
 8|bus drivers, visiting teachers, classroom teachers and for other       |
  |                                                                       |
 9|personnel performing instructional, administrative and supervisory     |
  |                                                                       |
10|services, but not including members of boards of education and other   |
  |                                                                       |
11|employees who do not work directly with pupils, and may charge and     |
  |                                                                       |
12|collect reasonable fees for the issuance of such certificates:         |
  |                                                                       |
13|         a.   the State Department of Education shall not issue a      |
  |                                                                       |
14|              certificate to and shall revoke the certificate of any   |
  |                                                                       |
15|              person who has been convicted, whether upon a verdict    |
  |                                                                       |
16|              or plea of guilty or upon a plea of nolo contendere,     |
  |                                                                       |
17|              or received a suspended sentence or any probationary     |
  |                                                                       |
18|              term for a crime or an attempt to commit a crime         |
  |                                                                       |
19|              provided for in Section 843.5 of Title 21 of the         |
  |                                                                       |
20|              Oklahoma Statutes if the offense involved sexual abuse   |
  |                                                                       |
21|              or sexual exploitation as those terms are defined in     |
  |                                                                       |
22|              Section 1-1-105 of Title 10A of the Oklahoma Statutes,   |
  |                                                                       |
23|              Sections 741, 843.1, if the offense included sexual      |
  |                                                                       |
24|              abuse or sexual exploitation, 865 et seq., 885, 888,     |
  |                                                                       |

 1|              891, 1021, 1021.2, 1021.3, 1040.13a, 1087, 1088,         |
  |                                                                       |
 2|              1111.1, 1114 or 1123 of Title 21 of the Oklahoma         |
  |                                                                       |
 3|              Statutes or who enters this state and who has been       |
  |                                                                       |
 4|              convicted, received a suspended sentence or received a   |
  |                                                                       |
 5|              deferred judgment for a crime or attempted crime         |
  |                                                                       |
 6|              which, if committed or attempted in this state, would    |
  |                                                                       |
 7|              be a crime or an attempt to commit a crime provided      |
  |                                                                       |
 8|              for in any of said laws,                                 |
  |                                                                       |
 9|         b.   all funds collected by the State Department of           |
  |                                                                       |
10|              Education for the issuance of certificates to            |
  |                                                                       |
11|              instructional, supervisory and administrative            |
  |                                                                       |
12|              personnel in the public schools of the state shall be    |
  |                                                                       |
13|              deposited in the "Teachers' Certificate Fund" in the     |
  |                                                                       |
14|              State Treasury and may be expended by the State Board    |
  |                                                                       |
15|              of Education to finance the activities of the State      |
  |                                                                       |
16|              Department of Education necessary to administer the      |
  |                                                                       |
17|              program, for consultative services, publication costs,   |
  |                                                                       |
18|              actual and necessary travel expenses as provided in      |
  |                                                                       |
19|              the State Travel Reimbursement Act incurred by persons   |
  |                                                                       |
20|              performing research work, and other expenses found       |
  |                                                                       |
21|              necessary by the State Board of Education for the        |
  |                                                                       |
22|              improvement of the preparation and certification of      |
  |                                                                       |
23|              teachers in Oklahoma.  Provided, any unobligated         |
  |                                                                       |
24|              balance in the Teachers' Certificate Fund in excess of   |
  |                                                                       |

 1|              Ten Thousand Dollars ($10,000.00) on June 30 of any      |
  |                                                                       |
 2|              fiscal year shall be transferred to the General          |
  |                                                                       |
 3|              Revenue Fund of the State of Oklahoma.  Until July 1,    |
  |                                                                       |
 4|              1997, the State Board of Education shall have            |
  |                                                                       |
 5|              authority for approval of teacher education programs.    |
  |                                                                       |
 6|              The State Board of Education shall also have authority   |
  |                                                                       |
 7|              for the administration of teacher residency and          |
  |                                                                       |
 8|              professional development, subject to the provisions of   |
  |                                                                       |
 9|              the Oklahoma Teacher Preparation Act;                    |
  |                                                                       |
10|    7.  Promulgate rules governing the classification, inspection,     |
  |                                                                       |
11|supervision and accrediting of all public nursery, kindergarten,       |
  |                                                                       |
12|elementary and secondary schools and on-site educational services      |
  |                                                                       |
13|provided by public school districts or state-accredited private        |
  |                                                                       |
14|schools in partial hospitalization programs, day treatment programs,   |
  |                                                                       |
15|and day hospital programs as defined in this act for persons between   |
  |                                                                       |
16|the ages of three (3) and twenty-one (21) years of age in the state.   |
  |                                                                       |
17| However, no school shall be denied accreditation solely on the        |
  |                                                                       |
18|basis of average daily attendance.                                     |
  |                                                                       |
19|    Any school district which maintains an elementary school and       |
  |                                                                       |
20|faces the necessity of relocating its school facilities because of     |
  |                                                                       |
21|construction of a lake, either by state or federal authority, which    |
  |                                                                       |
22|will inundate the school facilities, shall be entitled to receive      |
  |                                                                       |
23|probationary accreditation from the State Board of Education for a     |
  |                                                                       |
24|period of five (5) years after the effective date of this act and      |
  |                                                                       |

 1|any school district, otherwise qualified, shall be entitled to         |
  |                                                                       |
 2|receive probationary accreditation from the State Board of Education   |
  |                                                                       |
 3|for a period of two (2) consecutive years to attain the minimum        |
  |                                                                       |
 4|average daily attendance.  The Head Start and public nurseries or      |
  |                                                                       |
 5|kindergartens operated from Community Action Program funds shall not   |
  |                                                                       |
 6|be subjected to the accrediting rules of the State Board of            |
  |                                                                       |
 7|Education.  Neither will the State Board of Education make rules       |
  |                                                                       |
 8|affecting the operation of the public nurseries and kindergartens      |
  |                                                                       |
 9|operated from federal funds secured through Community Action           |
  |                                                                       |
10|Programs even though they may be operating in the public schools of    |
  |                                                                       |
11|the state.  However, any of the Head Start or public nurseries or      |
  |                                                                       |
12|kindergartens operated under federal regulations may make              |
  |                                                                       |
13|application for accrediting from the State Board of Education but      |
  |                                                                       |
14|will be accredited only if application for the approval of the         |
  |                                                                       |
15|programs is made.  The status of no school district shall be changed   |
  |                                                                       |
16|which will reduce it to a lower classification until due notice has    |
  |                                                                       |
17|been given to the proper authorities thereof and an opportunity        |
  |                                                                       |
18|given to correct the conditions which otherwise would be the cause     |
  |                                                                       |
19|of such reduction.                                                     |
  |                                                                       |
20|    Private and parochial schools may be accredited and classified     |
  |                                                                       |
21|in like manner as public schools or, if an accrediting association     |
  |                                                                       |
22|is approved by the State Board of Education, by procedures             |
  |                                                                       |
23|established by the State Board of Education to accept accreditation    |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|by such accrediting association, if application is made to the State   |
  |                                                                       |
 2|Board of Education for such accrediting;                               |
  |                                                                       |
 3|    8.  Be the legal agent of the State of Oklahoma to accept, in      |
  |                                                                       |
 4|its discretion, the provisions of any Act of Congress appropriating    |
  |                                                                       |
 5|or apportioning funds which are now, or may hereafter be, provided     |
  |                                                                       |
 6|for use in connection with any phase of the system of public           |
  |                                                                       |
 7|education in Oklahoma.  It shall prescribe such rules as it finds      |
  |                                                                       |
 8|necessary to provide for the proper distribution of such funds in      |
  |                                                                       |
 9|accordance with the state and federal laws;                            |
  |                                                                       |
10|    9.  Be and is specifically hereby designated as the agency of      |
  |                                                                       |
11|this state to cooperate and deal with any officer, board or            |
  |                                                                       |
12|authority of the United States Government under any law of the         |
  |                                                                       |
13|United States which may require or recommend cooperation with any      |
  |                                                                       |
14|state board having charge of the administration of public schools      |
  |                                                                       |
15|unless otherwise provided by law;                                      |
  |                                                                       |
16|    10.  Be and is hereby designated as the "State Educational         |
  |                                                                       |
17|Agency" referred to in Public Law 396 of the 79th Congress of the      |
  |                                                                       |
18|United States, which law states that said act may be cited as the      |
  |                                                                       |
19|"National School Lunch Act", and said State Board of Education is      |
  |                                                                       |
20|hereby authorized and directed to accept the terms and provisions of   |
  |                                                                       |
21|said act and to enter into such agreements, not in conflict with the   |
  |                                                                       |
22|Constitution of Oklahoma or the Constitution and Statutes of the       |
  |                                                                       |
23|United States, as may be necessary or appropriate to secure for the    |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|State of Oklahoma the benefits of the school lunch program             |
  |                                                                       |
 2|established and referred to in said act;                               |
  |                                                                       |
 3|    11.  Have authority to secure and administer the benefits of the   |
  |                                                                       |
 4|National School Lunch Act, Public Law 396 of the 79th Congress of      |
  |                                                                       |
 5|the United States, in the State of Oklahoma and is hereby authorized   |
  |                                                                       |
 6|to employ or appoint and fix the compensation of such additional       |
  |                                                                       |
 7|officers or employees and to incur such expenses as may be necessary   |
  |                                                                       |
 8|for the accomplishment of the above purpose, administer the            |
  |                                                                       |
 9|distribution of any state funds appropriated by the Legislature        |
  |                                                                       |
10|required as federal matching to reimburse on children's meals;         |
  |                                                                       |
11|    12.  Accept and provide for the administration of any land,        |
  |                                                                       |
12|money, buildings, gifts, donation or other things of value which may   |
  |                                                                       |
13|be offered or bequeathed to the schools under the supervision or       |
  |                                                                       |
14|control of said Board;                                                 |
  |                                                                       |
15|    13.  Have authority to require persons having administrative       |
  |                                                                       |
16|control of all school districts in Oklahoma to make such regular and   |
  |                                                                       |
17|special reports regarding the activities of the schools in said        |
  |                                                                       |
18|districts as the Board may deem needful for the proper exercise of     |
  |                                                                       |
19|its duties and functions.  Such authority shall include the right of   |
  |                                                                       |
20|the State Board of Education to withhold all state funds under its     |
  |                                                                       |
21|control, to withhold official recognition, including accrediting,      |
  |                                                                       |
22|until such required reports have been filed and accepted in the        |
  |                                                                       |
23|office of said Board and to revoke the certificates of persons         |
  |                                                                       |
24|failing or refusing to make such reports;                              |
  |                                                                       |

 1|    14.  Have general supervision of the school lunch program.  The    |
  |                                                                       |
 2|State Board of Education may sponsor workshops for personnel and       |
  |                                                                       |
 3|participants in the school lunch program and may develop, print and    |
  |                                                                       |
 4|distribute free of charge or sell any materials, books and bulletins   |
  |                                                                       |
 5|to be used in such school lunch programs.  There is hereby created     |
  |                                                                       |
 6|in the State Treasury a revolving fund for the Board, to be            |
  |                                                                       |
 7|designated the School Lunch Workshop Revolving Fund.  The fund shall   |
  |                                                                       |
 8|consist of all fees derived from or on behalf of any participant in    |
  |                                                                       |
 9|any such workshop sponsored by the State Board of Education, or from   |
  |                                                                       |
10|the sale of any materials, books and bulletins, and such funds shall   |
  |                                                                       |
11|be disbursed for expenses of such workshops and for developing,        |
  |                                                                       |
12|printing and distributing of such materials, books and bulletins       |
  |                                                                       |
13|relating to the school lunch program.  The fund shall be               |
  |                                                                       |
14|administered in accordance with Section 155 of Title 62 of the         |
  |                                                                       |
15|Oklahoma Statutes;                                                     |
  |                                                                       |
16|    15.  Prescribe all forms for school district and county officers   |
  |                                                                       |
17|to report to the State Board of Education where required.  The State   |
  |                                                                       |
18|Board of Education shall also prescribe a list of appropriation        |
  |                                                                       |
19|accounts by which the funds of school districts shall be budgeted,     |
  |                                                                       |
20|accounted for and expended; and it shall be the duty of the State      |
  |                                                                       |
21|Auditor and Inspector in prescribing all budgeting, accounting and     |
  |                                                                       |
22|reporting forms for school funds to conform to such lists;             |
  |                                                                       |
23|    16.  Provide for the establishment of a uniform system of pupil    |
  |                                                                       |
24|and personnel accounting, records and reports;                         |
  |                                                                       |

 1|    17.  Have authority to provide for the health and safety of        |
  |                                                                       |
 2|school children and school personnel while under the jurisdiction of   |
  |                                                                       |
 3|school authorities;                                                    |
  |                                                                       |
 4|    18.  Provide for the supervision of the transportation of          |
  |                                                                       |
 5|pupils;                                                                |
  |                                                                       |
 6|    19.  Have authority, upon request of the local school board, to    |
  |                                                                       |
 7|act in behalf of the public schools of the state in the purchase of    |
  |                                                                       |
 8|transportation equipment;                                              |
  |                                                                       |
 9|    20.  Have authority and is hereby required to perform all duties   |
  |                                                                       |
10|necessary to the administration of the public school system in         |
  |                                                                       |
11|Oklahoma as specified in the Oklahoma School Code; and, in addition    |
  |                                                                       |
12|thereto, those duties not specifically mentioned herein if not         |
  |                                                                       |
13|delegated by law to any other agency or official;                      |
  |                                                                       |
14|    21.  Administer the State Public Common School Building            |
  |                                                                       |
15|Equalization Fund established by Section 32 of Article X of the        |
  |                                                                       |
16|Oklahoma Constitution.  Any monies as may be appropriated or           |
  |                                                                       |
17|designated by the Legislature, other than ad valorem taxes, any        |
  |                                                                       |
18|other funds identified by the State Department of Education, which     |
  |                                                                       |
19|may include, but not be limited to, grants-in-aid from the federal     |
  |                                                                       |
20|government for building purposes, the proceeds of all property that    |
  |                                                                       |
21|shall fall to the state by escheat, penalties for unlawful holding     |
  |                                                                       |
22|of real estate by corporations, and capital gains on assets of the     |
  |                                                                       |
23|permanent school funds, shall be deposited in the State Public         |
  |                                                                       |
24|Common School Building Equalization Fund.  The fund shall be used to   |
  |                                                                       |

 1|aid school districts and charter schools in acquiring buildings,       |
  |                                                                       |
 2|subject to the limitations fixed by Section 32 of Article X of the     |
  |                                                                       |
 3|Oklahoma Constitution.  It is hereby declared that the term            |
  |                                                                       |
 4|"acquiring buildings" as used in Section 32 of Article X of the        |
  |                                                                       |
 5|Oklahoma Constitution shall mean acquiring or improving school         |
  |                                                                       |
 6|sites, constructing, repairing, remodeling or equipping buildings,     |
  |                                                                       |
 7|or acquiring school furniture, fixtures, or equipment.  For charter    |
  |                                                                       |
 8|schools, the fund shall only be used to acquire buildings in which     |
  |                                                                       |
 9|students enrolled in the charter school will be attending.  It is      |
  |                                                                       |
10|hereby declared that the term "school districts" as used in Section    |
  |                                                                       |
11|32 of Article X of the Oklahoma Constitution shall mean school         |
  |                                                                       |
12|districts and charter schools created pursuant to the provisions of    |
  |                                                                       |
13|the Oklahoma Charter Schools Act.  If sufficient monies are            |
  |                                                                       |
14|available in the fund, the Board shall solicit proposals for grants    |
  |                                                                       |
15|from school districts and charter schools and shall determine the      |
  |                                                                       |
16|process for consideration of proposals.  Grants shall be awarded       |
  |                                                                       |
17|only to school districts which have a total assessed property          |
  |                                                                       |
18|valuation per average daily membership that is less than the state     |
  |                                                                       |
19|average total assessed property valuation per average daily            |
  |                                                                       |
20|membership and, at the time of application, the district has voted     |
  |                                                                       |
21|the five-mill building fund levy authorized in Section 10 of Article   |
  |                                                                       |
22|X of the Oklahoma Constitution, and has voted indebtedness through     |
  |                                                                       |
23|the issuance of new bonds for at least fifty percent (50%) within      |
  |                                                                       |
24|the last three (3) years of the maximum allowable pursuant to the      |
  |                                                                       |

 1|provisions of Section 26 of Article X of the Oklahoma Constitution     |
  |                                                                       |
 2|as shown on the school district budget filed with the State Board of   |
  |                                                                       |
 3|Equalization for the current school year and certifications by the     |
  |                                                                       |
 4|Attorney General prior to April 1 of the school year.  Grants shall    |
  |                                                                       |
 5|be awarded only to charter schools which have secured matching funds   |
  |                                                                       |
 6|for the specific purpose of acquiring buildings in an amount of not    |
  |                                                                       |
 7|less than ten percent (10%) of the total grant amount.  The amount     |
  |                                                                       |
 8|of each grant awarded by the Board each year shall not exceed Four     |
  |                                                                       |
 9|Million Dollars ($4,000,000.00).  From the total amount available to   |
  |                                                                       |
10|provide grants to public schools and charter schools, charter          |
  |                                                                       |
11|schools shall be allocated the greater of ten percent (10%) of the     |
  |                                                                       |
12|total amount or the percent of students enrolled in charter schools    |
  |                                                                       |
13|that are not sponsored by the Statewide Virtual Charter School Board   |
  |                                                                       |
14|as compared to the student enrollment in school districts which have   |
  |                                                                       |
15|a total assessed property valuation per average daily membership       |
  |                                                                       |
16|that is equal to or less than twenty-five percent (25%) of the state   |
  |                                                                       |
17|total assessed property valuation per average daily membership.  The   |
  |                                                                       |
18|Board shall give priority consideration to school districts which      |
  |                                                                       |
19|have a total assessed property valuation per average daily             |
  |                                                                       |
20|membership that is equal to or less than twenty-five percent (25%)     |
  |                                                                       |
21|of the state average total assessed property valuation per average     |
  |                                                                       |
22|daily membership.  The Board is authorized to prorate grants awarded   |
  |                                                                       |
23|if monies are not sufficient in the fund to award grants to            |
  |                                                                       |
24|qualified districts and charter schools.  The State Board of           |
  |                                                                       |

 1|Education shall make available to eligible charter schools any         |
  |                                                                       |
 2|unused grant funds that remain after the initial allocation to all     |
  |                                                                       |
 3|eligible public school districts and charter schools of this state.    |
  |                                                                       |
 4|The State Board of Education shall prescribe rules for making grants   |
  |                                                                       |
 5|of aid from, and for otherwise administering, the fund pursuant to     |
  |                                                                       |
 6|the provisions of this paragraph, and may employ and fix the duties    |
  |                                                                       |
 7|and compensation of technicians, aides, clerks, stenographers,         |
  |                                                                       |
 8|attorneys and other personnel deemed necessary to carry out the        |
  |                                                                       |
 9|provisions of this paragraph.  The cost of administering the fund      |
  |                                                                       |
10|shall be paid from monies appropriated to the State Board of           |
  |                                                                       |
11|Education for the operation of the State Department of Education;      |
  |                                                                       |
12|    22.  Recognize that the Director of the Oklahoma Department of     |
  |                                                                       |
13|Corrections shall be the administrative authority for the schools      |
  |                                                                       |
14|which are maintained in the state reformatories and shall appoint      |
  |                                                                       |
15|the principals and teachers in such schools.  Provided, that rules     |
  |                                                                       |
16|of the State Board of Education for the classification, inspection     |
  |                                                                       |
17|and accreditation of public schools shall be applicable to such        |
  |                                                                       |
18|schools; and such schools shall comply with standards set by the       |
  |                                                                       |
19|State Board of Education; and                                          |
  |                                                                       |
20|    23.  Have authority to administer a revolving fund which is        |
  |                                                                       |
21|hereby created in the State Treasury, to be designated the             |
  |                                                                       |
22|Statistical Services Revolving Fund.  The fund shall consist of all    |
  |                                                                       |
23|monies received from the various school districts of the state, the    |
  |                                                                       |
24|United States Government, and other sources for the purpose of         |
  |                                                                       |

 1|furnishing or financing statistical services and for any other         |
  |                                                                       |
 2|purpose as designated by the Legislature.  The State Board of          |
  |                                                                       |
 3|Education is hereby authorized to enter into agreements with school    |
  |                                                                       |
 4|districts, municipalities, the United States Government, foundations   |
  |                                                                       |
 5|and other agencies or individuals for services, programs or research   |
  |                                                                       |
 6|projects.  The Statistical Services Revolving Fund shall be            |
  |                                                                       |
 7|administered in accordance with Section 155 of Title 62 of the         |
  |                                                                       |
 8|Oklahoma Statutes;                                                     |
  |                                                                       |
 9|    24.  Beginning July 1, 2020, oversee implementation of the         |
  |                                                                       |
10|provisions of Enrolled House Bill No. 1017 of the 1st Extraordinary    |
  |                                                                       |
11|Session of the 42nd Oklahoma Legislature;                              |
  |                                                                       |
12|    25.  Beginning July 1, 2020, implement the provisions of the       |
  |                                                                       |
13|Oklahoma Teacher Preparation Act as provided for in law, including     |
  |                                                                       |
14|but not limited to:                                                    |
  |                                                                       |
15|         a.    approval and accreditation of teacher education         |
  |                                                                       |
16|              programs, and                                            |
  |                                                                       |
17|         b.    assessment of candidates for licensure and              |
  |                                                                       |
18|              certification; and                                       |
  |                                                                       |
19|    26.  Beginning July 1, 2020, set performance levels and            |
  |                                                                       |
20|corresponding cut scores pursuant to the Oklahoma School Testing       |
  |                                                                       |
21|Program Act and as provided for in Section 1210.541 of this title.     |
  |                                                                       |
22|    SECTION 2.     AMENDATORY     70 O.S. 2011, Section 3-116.1, is    |
  |                                                                       |
23|amended to read as follows:                                            |
  |                                                                       |

 1|    Section 3-116.1.  A.  This act shall be known and may be cited     |
  |                                                                       |
 2|as the "Educational Accountability Reform Act".                        |

 3|    B.  After the effective date of this act, the State Board of       |

 4|Education shall meet to organize and plan for the assumption of the    |
  |                                                                       |
 5|powers and duties of the Commission for Educational Quality and        |
  |                                                                       |
 6|Accountability and the Office of Educational Quality and               |
  |                                                                       |
 7|Accountability.                                                        |
  |                                                                       |
 8|    C.  On July 1, 2020, the Commission for Educational Quality and    |
  |                                                                       |
 9|Accountability and the Office of Educational Quality and               |
  |                                                                       |
10|Accountability shall be placed under the authority of the State        |
  |                                                                       |
11|Department of Education.  Except as otherwise provided for in this     |
  |                                                                       |
12|section, the transfer shall include all real property, buildings,      |
  |                                                                       |
13|furniture, equipment, supplies, records, personnel, assets, current    |
  |                                                                       |
14|and future liabilities, fund balances, encumbrances, obligations and   |
  |                                                                       |
15|indebtedness associated with the Commission for Educational Quality    |
  |                                                                       |
16|and Accountability and the Office of Educational Quality and           |
  |                                                                       |
17|Accountability.                                                        |
  |                                                                       |
18|    D.  All employees of the Office of Educational Quality and         |
  |                                                                       |
19|Accountability on July 1, 2020, including related liabilities for      |
  |                                                                       |
20|sick leave, annual leave, holidays, unemployment benefits and          |
  |                                                                       |
21|workers' compensation benefits accruing prior to July 1, 2020, to      |
  |                                                                       |
22|such personnel shall be transferred to the State Department of         |
  |                                                                       |
23|Education as of July 1, 2020.                                          |
  |                                                                       |

  |                                                                       |

 1|    E.  Appropriate conveyances and other documents shall be           |
  |                                                                       |
 2|executed by July 1, 2020, to effectuate the transfer of property       |

 4|and the Office of Educational Quality and Accountability to the        |
  |                                                                       |
 5|State Board of Education.                                              |
  |                                                                       |
 6|    F.  Any monies donated or accruing to or in the name of the        |
  |                                                                       |
 7|Commission for Educational Quality and Accountability or the Office    |
  |                                                                       |
 8|of Educational Quality and Accountability after July 1, 2020, shall    |
  |                                                                       |
 9|be transferred to the State Board of Education.  Any other monies      |
  |                                                                       |
10|from appropriations, fees, licenses, fines, penalties or other         |
  |                                                                       |
11|similar types of monies that accrue in any funds or accounts after     |
  |                                                                       |
12|July 1, 2020, in the name of the Commission for Educational Quality    |
  |                                                                       |
13|and Accountability or the Office of Educational Quality and            |
  |                                                                       |
14|Accountability or maintained for the benefit of the Commission or      |
  |                                                                       |
15|the Office are transferred to the State Board of Education.            |
  |                                                                       |
16|    G.  The State Board of Education shall succeed to any              |
  |                                                                       |
17|contractual rights and responsibilities incurred by the Commission     |
  |                                                                       |
18|for Educational Quality and Accountability or the Office of            |
  |                                                                       |
19|Educational Quality and Accountability.                                |
  |                                                                       |
20|    H.  The rules of the Commission for Educational Quality and        |
  |                                                                       |
21|Accountability that are in effect on July 1, 2020, shall be            |
  |                                                                       |
22|enforceable by the State Board of Education until the Board            |
  |                                                                       |
23|establishes rules.                                                     |

23|    E.  The Commission shall hold its meetings in compliance with      |

12|teacher education programs in institutions of higher education;        |
  |                                                                       |
13|    6.  "Department" means the State Department of Education;          |
  |                                                                       |
14|    7.  "Induction" means a program that provides support,             |
  |                                                                       |
15|mentorship and coaching to educators at the beginning of their         |
  |                                                                       |
16|careers or as they transition to new roles within a school or          |
  |                                                                       |
17|district.  Induction programs work with inductees to assist in all     |
  |                                                                       |
18|matters concerning classroom management and professional development   |
  |                                                                       |
19|for that teacher.  Induction programs may involve a committee of one   |
  |                                                                       |
20|or more mentor teachers, the principal or an assistant principal of    |
  |                                                                       |
21|the employing school, one or more administrators designated by the     |
  |                                                                       |
22|school district board of education, a teacher educator in a college    |
  |                                                                       |
23|or school of education of an institution of higher education or an     |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|educator in a department or school outside the institution's teacher   |
  |                                                                       |
 2|education unit;                                                        |
  |                                                                       |
 3|    8.  "Teacher" means a person defined as a teacher in Section       |
  |                                                                       |
 4|1-116 of this title;                                                   |
  |                                                                       |
 5|    9.  "Inductee" means any certified teacher who is employed in an   |
  |                                                                       |
 6|accredited school to serve as a teacher and the school district has    |
  |                                                                       |
 7|elected to place under the guidance and assistance of a mentor         |
  |                                                                       |
 8|teacher or induction committee.  Inductees shall include those         |
  |                                                                       |
 9|individuals having completed the program of the college or school of   |
  |                                                                       |
10|education of the accredited institution of higher education from       |
  |                                                                       |
11|which the person has been graduated, and shall have successfully       |
  |                                                                       |
12|completed the competency examination in areas of approval in which     |
  |                                                                       |
13|the inductee seeks certification, those individuals eligible for the   |
  |                                                                       |
14|alternative placement teaching certificate according to Section        |
  |                                                                       |
15|6-122.3 of this title, and those individuals issued an emergency or    |
  |                                                                       |
16|provisional certificate according to Section 6-187 of this title.      |
  |                                                                       |
17|All teachers working in a new role, including classroom teachers       |
  |                                                                       |
18|transitioning to a new role, shall be considered inductees for         |
  |                                                                       |
19|purposes of induction programs;                                        |
  |                                                                       |
20|    10.  "Certified teacher" means any teacher who has been issued a   |
  |                                                                       |
21|certificate by the Board in accordance with the Oklahoma Teacher       |
  |                                                                       |
22|Preparation Act and the rules of the Board;                            |
  |                                                                       |
23|    11.  "Mentor teacher" means any teacher who has been appointed     |
  |                                                                       |
24|to provide guidance, support, coaching and assistance to an inductee   |
  |                                                                       |

 1|employed by the school district.  A mentor teacher shall be a          |
  |                                                                       |
 2|current or former classroom teacher and have a minimum of two (2)      |
  |                                                                       |
 3|years of classroom teaching experience as a certified teacher.         |

 4|    When possible, a mentor teacher shall have participated in         |
  |                                                                       |
 5|mentor teacher professional development and have expertise in the      |
  |                                                                       |
 6|teaching field of the inductee;                                        |
  |                                                                       |
 7|    12.  "Higher education faculty" means any individual who is        |
  |                                                                       |
 8|employed in a teaching capacity in an institution of higher            |
  |                                                                       |
 9|education, approved or accredited until June 30, 2020, by the          |
  |                                                                       |
10|Commission and beginning July 1, 2020, by the Board for the            |
  |                                                                       |
11|preparation of education personnel; and                                |
  |                                                                       |
12|    13.  "Competency examination" means the assessment required in     |
  |                                                                       |
13|the Oklahoma Teacher Preparation Act for certification as a teacher    |
  |                                                                       |
14|and shall consist of tests over general education, professional        |
  |                                                                       |
15|education and subject areas as defined until June 30, 2020, by the     |
  |                                                                       |
16|Commission for Educational Quality and Accountability and beginning    |
  |                                                                       |
17|July 1, 2020, by the Board.                                            |
  |                                                                       |
18|    SECTION 6.     AMENDATORY     70 O.S. 2011, Section 6-184, as      |
  |                                                                       |
19|last amended by Section 10, Chapter 124, O.S.L. 2014 (70 O.S. Supp.    |
  |                                                                       |
20|2018, Section 6-184), is amended to read as follows:                   |
  |                                                                       |
21|    Section 6-184.  A.  Beginning July 1, 1997 July 1, 2014, through   |
  |                                                                       |
22|July 1, 2014 June 30, 2020, the Oklahoma Commission for Teacher        |
  |                                                                       |
23|Preparation Educational Quality and Accountability and beginning       |
  |                                                                       |
24|July 1, 2020, the State Board of Education shall have authority for    |
  |                                                                       |

 4|duty the Oklahoma Commission for Teacher Preparation Educational       |
  |                                                                       |
 5|Quality and Accountability shall:                                      |
  |                                                                       |
 6|    1.  Include the State Board of Education in the process until      |
  |                                                                       |
 7|June 30, 2020;                                                         |
  |                                                                       |
 8|    2.  Review and assess approved, accredited and new programs of     |
  |                                                                       |
 9|teacher education; and                                                 |
  |                                                                       |
10|    3.  Encourage studies and research designed to improve teacher     |
  |                                                                       |
11|education.                                                             |
  |                                                                       |
12|    B.  Until July 1, 2014 June 30, 2020, before adopting any rule     |
  |                                                                       |
13|pertaining to approval or accreditation of teacher education           |
  |                                                                       |
14|programs or assessment of candidates for certification, the Oklahoma   |
  |                                                                       |
15|Commission for Teacher Preparation Educational Quality and             |
  |                                                                       |
16|Accountability shall solicit comments from the State Board of          |
  |                                                                       |
17|Education, the Oklahoma State Regents for Higher Education and the     |
  |                                                                       |
18|State Board of Career and Technology Education on the proposed rule.   |
  |                                                                       |
19| Within forty-five (45) days of the receipt of the proposed rule       |
  |                                                                       |
20|from the Oklahoma Commission for Teacher Preparation Educational       |
  |                                                                       |
21|Quality and Accountability, the State Board of Education, the State    |
  |                                                                       |
22|Regents and the State Board of Career and Technology Education shall   |
  |                                                                       |
23|separately review the proposed rule and return their recommendations   |
  |                                                                       |
24|to the Commission on the proposed adoption.  Each recommendation       |
  |                                                                       |

 1|shall include the rationale for the recommendation.  The Oklahoma      |
  |                                                                       |
 2|Commission for Teacher Preparation shall accord the recommendations    |

 4|each proposed rule.  If the action of the Commission on a proposed     |
  |                                                                       |
 5|rule is not consistent with the recommendation made by any of the      |
  |                                                                       |
 6|reviewing entities, within ten (10) days of the Oklahoma Commission    |
  |                                                                       |
 7|for Teacher Preparation's Commission's formal action on the rule,      |
  |                                                                       |
 8|the Commission shall submit a report providing justification for its   |
  |                                                                       |
 9|actions to the Commission for Educational Quality and Accountability   |
  |                                                                       |
10|State Board of Education, the State Regents and the State Board of     |
  |                                                                       |
11|Career and Technology Education.                                       |
  |                                                                       |
12|    C.  Until July 1, 2014 June 30, 2020, the State Board of           |
  |                                                                       |
13|Education, the Oklahoma State Regents for Higher Education and the     |
  |                                                                       |
14|State Board of Career and Technology Education shall also have         |
  |                                                                       |
15|authority to recommend to the Oklahoma Commission for Teacher          |
  |                                                                       |
16|Preparation Educational Quality and Accountability rules for teacher   |
  |                                                                       |
17|education program approval and accreditation and rules for teacher     |

18|assessment.  Any such rule recommended shall be considered by the      |
  |                                                                       |
19|Commission within sixty (60) days of receipt of the rule by the same   |
  |                                                                       |
20|process provided in subsection A of this section for rules proposed    |
  |                                                                       |
21|by the Oklahoma Commission for Teacher Preparation.                    |
  |                                                                       |
22|    D.  Until July 1, 2014 June 30, 2020, before adopting any rule     |
  |                                                                       |
23|pertaining to teacher certification, residency or professional         |
  |                                                                       |
24|development, the State Board of Education shall solicit comments       |
  |                                                                       |

 1|from the Oklahoma Commission for Teacher Preparation Educational       |
  |                                                                       |
 2|Quality and Accountability, the Oklahoma State Regents for Higher      |
  |                                                                       |
 3|Education and the State Board of Career and Technology Education on    |

 4|the proposed rule.  Within forty-five (45) days of the receipt of a    |
  |                                                                       |
 5|proposed rule from the State Board of Education, the Oklahoma          |
  |                                                                       |
 6|Commission for Teacher Preparation Educational Quality and             |
  |                                                                       |
 7|Accountability, the State Regents and the State Board of Career and    |
  |                                                                       |
 8|Technology Education shall separately review the proposed rule and     |
  |                                                                       |
 9|return their recommendations to the Board on the proposed adoption.    |
  |                                                                       |
10|Each recommendation shall include the rationale for the                |
  |                                                                       |
11|recommendation.  The State Board of Education shall accord the         |
  |                                                                       |
12|recommendations due deliberation in its subsequent consideration of    |
  |                                                                       |
13|the adoption of each rule.  If the action of the State Board of        |
  |                                                                       |
14|Education on a proposed rule is not consistent with the                |
  |                                                                       |
15|recommendation made by any of the reviewing entities, within ten       |
  |                                                                       |
16|(10) days of the State Board of Education's formal action on the       |
  |                                                                       |
17|rule, the State Board of Education shall submit a report providing     |
  |                                                                       |
18|justification for its action to the Education Oversight Board          |
  |                                                                       |
19|Commission, the State Regents and the State Board of Career and        |
  |                                                                       |
20|Technology Education.                                                  |
  |                                                                       |
21|    E.  Until July 1, 2014 June 30, 2020, the Oklahoma Commission      |
  |                                                                       |
22|for Teacher Preparation Educational Quality and Accountability, the    |
  |                                                                       |
23|Oklahoma State Regents for Higher Education and the State Board of     |
  |                                                                       |
24|Career and Technology Education shall have authority to recommend to   |
  |                                                                       |

 1|the State Board of Education rules for adoption in the areas of        |
  |                                                                       |
 2|teacher certification, residency and professional development.  Any    |
  |                                                                       |
 3|such rule recommended shall be considered by the State Board of        |
  |                                                                       |
 4|Education within sixty (60) days of the receipt of the rule by the     |
  |                                                                       |
 5|same process provided in subsection C of this section for rules        |
  |                                                                       |
 6|proposed by the State Board of Education.                              |
  |                                                                       |
 7|    F.  Beginning July 1, 2014 July 1, 2020, the State Board of        |
  |                                                                       |
 8|Education, the Oklahoma State Regents for Higher Education and the     |
  |                                                                       |
 9|State Board of Career and Technology Education shall have the          |
  |                                                                       |
10|authority to submit proposed rules regarding teacher education         |
  |                                                                       |
11|program approval, accreditation, and for teacher assessment to the     |
  |                                                                       |
12|Commission for Educational Quality and Accountability State Board of   |
  |                                                                       |
13|Education.  All proposed rules shall be considered by the Commission   |
  |                                                                       |
14|Board within sixty (60) days of receipt of the proposed rule.  The     |
  |                                                                       |
15|proposed rules shall be considered by the Commission Board in the      |
  |                                                                       |
16|same process provided in subsection B of this section for rules        |
  |                                                                       |
17|proposed by the Oklahoma Commission for Teacher Preparation            |
  |                                                                       |
18|Educational Quality and Accountability.                                |
  |                                                                       |
19|    G.  Beginning July 1, 2014 July 1, 2020, before adopting any       |
  |                                                                       |
20|rule pertaining to teacher leadership and effectiveness or             |
  |                                                                       |
21|professional development, the State Board of Education shall solicit   |
  |                                                                       |
22|comments from the Commission for Educational Quality and               |
  |                                                                       |
23|Accountability, the Oklahoma State Regents for Higher Education and    |
  |                                                                       |
24|the State Board of Career and Technology Education on the proposed     |
  |                                                                       |

10|    SECTION 7.     AMENDATORY     70 O.S. 2011, Section 6-185, as      |
  |                                                                       |
11|last amended by Section 11, Chapter 124, O.S.L. 2014 (70 O.S. Supp.    |
  |                                                                       |
12|2018, Section 6-185), is amended to read as follows:                   |
  |                                                                       |
13|    Section 6-185.  A.  The following competencies and methods shall   |
  |                                                                       |
14|be incorporated into the programs approved by the Oklahoma             |
  |                                                                       |
15|Commission for Teacher Preparation Educational Quality and             |
  |                                                                       |
16|Accountability until July 1, 2014 June 30, 2020, and approved by the   |
  |                                                                       |
17|Commission for Educational Quality and Accountability State Board of   |
  |                                                                       |
18|Education beginning July 1, 2014 July 1, 2020, for the                 |
  |                                                                       |
19|competency-based teacher preparation system provided for the           |
  |                                                                       |
20|Oklahoma Teacher Preparation Act:                                      |
  |                                                                       |
21|    1.  The teacher preparation system shall include, but not be       |
  |                                                                       |
22|limited to, the following competencies:                                |
  |                                                                       |
23|         a.   excellence in the arts and sciences,                     |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|         b.   an in-depth knowledge of the subject matter to be        |
  |                                                                       |
 2|              taught,                                                  |
  |                                                                       |
 3|         c.   the ability to identify and cultivate talent and         |
  |                                                                       |
 4|              potential in students,                                   |
  |                                                                       |
 5|         d.   an understanding of child and human development,         |
  |                                                                       |
 6|         e.   teaching skills developed through a variety of           |
  |                                                                       |
 7|              learning experiences,                                    |
  |                                                                       |
 8|         f.   the ability to interact effectively with all students,   |
  |                                                                       |
 9|                                                                       |
  |                                                                       |
10|         g.   skills necessary for working with parents, guardians     |
  |                                                                       |
11|              and custodians of students in the education process,     |
  |                                                                       |
12|         h.   skills necessary to involve the community in             |
  |                                                                       |
13|              education,                                               |
  |                                                                       |
14|         i.   skills to foster teamwork within and among schools,      |
  |                                                                       |
15|         j.   for administrators, skills necessary to be an            |
  |                                                                       |
16|              effective leader of a school or school district, and     |
  |                                                                       |
17|         k.   skills in effective classroom management and student     |
  |                                                                       |
18|              discipline;                                              |
  |                                                                       |
19|    2.  The preservice program shall include the following methods     |
  |                                                                       |
20|to achieve the competencies listed in paragraph 1 of this              |
  |                                                                       |
21|subsection:                                                            |
  |                                                                       |
22|         a.   require teacher candidates to study arts and sciences    |
  |                                                                       |
23|              at the undergraduate level,                              |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|         b.   require secondary and elementary/secondary teacher       |
  |                                                                       |
 2|              candidates to have undergraduate majors, or their        |
  |                                                                       |
 3|              equivalents, in a subject area, and require teacher      |
  |                                                                       |
 4|              candidates in early childhood, elementary, and special   |
  |                                                                       |
 5|              education to have subject area concentrations which      |
  |                                                                       |
 6|              allow qualification as a generalist,                     |
  |                                                                       |
 7|         c.   require teacher candidates to study the individuality    |
  |                                                                       |
 8|              of students, the capacity of students to learn and the   |
  |                                                                       |
 9|              process of learning,                                     |
  |                                                                       |
10|         d.   integrate curriculum from other disciplines with the     |
  |                                                                       |
11|              education curriculum,                                    |
  |                                                                       |
12|         e.   require teacher candidates to have training              |
  |                                                                       |
13|              experiences and personal contact with parents,           |
  |                                                                       |
14|              guardians or custodians of school-age children,          |
  |                                                                       |
15|         f.   require teacher candidates to have community             |
  |                                                                       |
16|              involvement experience,                                  |
  |                                                                       |
17|         g.   structure courses so as to require teamwork              |
  |                                                                       |
18|              activities, and                                          |
  |                                                                       |
19|         h.   require teacher candidates to study, in existing         |
  |                                                                       |
20|              coursework, substance abuse symptoms identification      |
  |                                                                       |
21|              and prevention, mental illness symptoms identification   |
  |                                                                       |
22|              and mental health issues, classroom management skills,   |
  |                                                                       |
23|              and classroom safety and discipline techniques;          |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|    3.  Until July 1, 2014 June 30, 2020, the Oklahoma Commission      |
  |                                                                       |
 2|for Teacher Preparation Educational Quality and Accountability and     |
  |                                                                       |
 3|beginning July 1, 2014 July 1, 2020, the Commission for Educational    |
  |                                                                       |
 4|Quality and Accountability State Board of Education shall not          |
  |                                                                       |
 5|require more than a four-year program of one hundred twenty-four       |
  |                                                                       |
 6|(124) semester hours to complete a teacher education degree.           |
  |                                                                       |
 7|    B.  It is the intent of the Legislature that institutions of       |
  |                                                                       |
 8|higher education which offer teacher education programs hold such      |
  |                                                                       |
 9|programs accountable for meeting the certification competencies        |
  |                                                                       |
10|approved by the State Board of Education.  It is the intent of the     |
  |                                                                       |
11|Legislature that the teacher education programs incorporate a          |
  |                                                                       |
12|curriculum to achieve the competency-based system and include          |
  |                                                                       |
13|integration of the teacher preparation curricula with the arts and     |
  |                                                                       |
14|sciences departments' curricula.  Each institution of higher           |
  |                                                                       |
15|education which seeks accreditation or approval for its teacher        |
  |                                                                       |
16|education program shall develop an institution plan which follows      |
  |                                                                       |
17|the State Board of Education competencies for certification.  In       |
  |                                                                       |
18|developing such institution plans, the higher education institution    |
  |                                                                       |
19|shall establish a process which seeks information and input from       |
  |                                                                       |
20|teacher preparation faculty, faculty from arts and sciences and        |
  |                                                                       |
21|other programs and disciplines which are appropriate, students         |
  |                                                                       |
22|within the teacher education program, teachers, administrators,        |
  |                                                                       |
23|parents, guardians or custodians of students and business and          |
  |                                                                       |
24|community leaders.  Until July 1, 2014 June 30, 2020, each             |
  |                                                                       |

 1|institution shall report annually to the Oklahoma Commission for       |
  |                                                                       |
 2|Teacher Preparation Educational Quality and Accountability and         |
  |                                                                       |
 3|beginning July 1, 2013 July 1, 2020, to the Commission for             |
  |                                                                       |
 4|Educational Quality and Accountability State Board of Education the    |
  |                                                                       |
 5|procedures used to inform the public regarding the institution's       |
  |                                                                       |
 6|teacher education program and the manner through which public input    |
  |                                                                       |
 7|is solicited and received.  The institution's plan shall be            |
  |                                                                       |
 8|accessible to any interested party under the Oklahoma Open Records     |
  |                                                                       |
 9|Act.  No institution of higher education's teacher education program   |
  |                                                                       |
10|shall be approved by the Commission until June 30, 2020, and by the    |
  |                                                                       |
11|Board beginning July 1, 2020, unless the institution plan has been     |
  |                                                                       |
12|approved by that institution's governing board.  The Oklahoma State    |
  |                                                                       |
13|Regents for Higher Education may facilitate the development of         |
  |                                                                       |
14|institution plans to assist institutions of higher education.          |
  |                                                                       |
15|    SECTION 8.     AMENDATORY     70 O.S. 2011, Section 6-186, as      |
  |                                                                       |
16|last amended by Section 1, Chapter 5, O.S.L. 2017 (70 O.S. Supp.       |
  |                                                                       |
17|2018, Section 6-186), is amended to read as follows:                   |
  |                                                                       |
18|    Section 6-186.  A.  Criteria for the approval and accreditation    |
  |                                                                       |
19|of teacher education programs in Oklahoma institutions of higher       |
  |                                                                       |
20|education shall include, but not be limited to, substantial evidence   |
  |                                                                       |
21|that persons who enter teacher education programs demonstrate:         |
  |                                                                       |
22|    1.  Competency in the oral and written use of the English          |
  |                                                                       |
23|language;                                                              |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|    2.  A minimum grade point average as established until June 30,    |
  |                                                                       |
 2|2020, by the Commission for Educational Quality and Accountability,    |
  |                                                                       |
 3|and beginning July 1, 2020, by the State Board of Education; and       |
  |                                                                       |
 4|    3.  The ability to meet criteria established pursuant to the       |
  |                                                                       |
 5|Oklahoma Teacher Preparation Act at the completion of the teacher      |
  |                                                                       |
 6|education program and provide evidence of having worked with           |
  |                                                                       |
 7|children or youth in a variety of situations.                          |
  |                                                                       |
 8|    Criteria shall also include a greater emphasis upon field work     |
  |                                                                       |
 9|in accredited schools by prospective teachers under the supervision    |
  |                                                                       |
10|of higher education faculty.                                           |
  |                                                                       |
11|    B.  The Until June 30, 2020, the Commission for Educational        |
  |                                                                       |
12|Quality and Accountability and beginning July 1, 2020, the State       |
  |                                                                       |
13|Board of Education shall work with the Oklahoma State Regents for      |
  |                                                                       |
14|Higher Education and the various institutions of higher education in   |
  |                                                                       |
15|developing guidelines for a paid teacher internship program which      |
  |                                                                       |
16|may be offered at each institution for prospective teachers.  The      |
  |                                                                       |
17|purpose of each program shall be to provide mentorship and support     |
  |                                                                       |
18|for prospective teachers.  Students enrolled in a teacher education    |
  |                                                                       |
19|program shall be eligible to participate in the program.  Only         |
  |                                                                       |
20|students who have completed the minimum nonsalaried teacher            |
  |                                                                       |
21|internship requirement as established by the institution shall be      |
  |                                                                       |
22|eligible to participate in the paid teacher internship program.        |
  |                                                                       |
23|    C.  It is hereby declared to be the intent of the Legislature      |
  |                                                                       |
24|that until June 30, 2020, the Commission for Educational Quality and   |
  |                                                                       |

 1|Accountability and beginning July 1, 2020, the State Board of          |
  |                                                                       |
 2|Education work with the Oklahoma State Regents for Higher Education    |
  |                                                                       |
 3|and the various institutions of higher education in establishing a     |
  |                                                                       |
 4|procedure whereby full-time teacher education faculty continue their   |
  |                                                                       |
 5|professional development during their tenure at an institution of      |
  |                                                                       |
 6|higher education to ensure that the future teachers of this state      |
  |                                                                       |
 7|are taught by professional educators fully trained in their area of    |
  |                                                                       |
 8|expertise.  Each approved or accredited program of teacher education   |
  |                                                                       |
 9|shall have a system for documenting and reporting the annual           |
  |                                                                       |
10|professional development activities of all teacher education faculty   |
  |                                                                       |
11|members.  Faculty professional development reports shall be reviewed   |
  |                                                                       |
12|until June 30, 2020, by the Commission and beginning July 1, 2020,     |
  |                                                                       |
13|by the Board along with professional development activities as a       |
  |                                                                       |
14|normal part of the accreditation process.                              |
  |                                                                       |
15|    It is further declared to be the intent of the Legislature that    |
  |                                                                       |
16|such professional development plans provide alternative means of       |
  |                                                                       |
17|education including, but not limited to:                               |
  |                                                                       |
18|    1.  Professional development programs;                             |
  |                                                                       |
19|    2.  Higher education courses;                                      |
  |                                                                       |
20|    3.  Exchange programs with public school classroom teachers,       |
  |                                                                       |
21|administrators, and other school personnel; and                        |
  |                                                                       |
22|    4.  Programs whereby all full-time teacher education faculty       |
  |                                                                       |
23|members directly involved in the teacher education process,            |
  |                                                                       |
24|including all administrators of the teacher education program, are     |
  |                                                                       |

 1|required to serve in a state accredited public school for at least     |
  |                                                                       |
 2|ten (10) clock hours per school year in responsibilities related to    |
  |                                                                       |
 3|their respective teacher education teaching fields.                    |
  |                                                                       |
 4|    All public school systems shall participate in the programs        |
  |                                                                       |
 5|provided for in this subsection when needed.                           |
  |                                                                       |
 6|    D.  The Until June 30, 2020, the Commission for Educational        |
  |                                                                       |
 7|Quality and Accountability and beginning July 1, 2020, the State       |
  |                                                                       |
 8|Board of Education shall adopt rules requiring specific improvements   |
  |                                                                       |
 9|to strengthen the screening of student applicants and field activity   |
  |                                                                       |
10|and placement as set out in subsection A of this section.  Such        |
  |                                                                       |
11|rules shall be reviewed and amended or readopted until June 30,        |
  |                                                                       |
12|2020, by the Commission and beginning July 1, 2020, by the Board at    |
  |                                                                       |
13|least once every five (5) years.                                       |
  |                                                                       |
14|    E.  To assist the Commission until June 30, 2020, and beginning    |
  |                                                                       |
15|July 1, 2020, to assist the Board in setting specific requirements     |
  |                                                                       |
16|as set out in subsections A and D of this section, the Commission      |
  |                                                                       |
17|shall until June 30, 2020, and beginning July 1, 2020, the Board       |
  |                                                                       |
18|shall annually prepare a statistical report showing the percentage     |
  |                                                                       |
19|of students from each of the Oklahoma institutions of higher           |
  |                                                                       |
20|education who have successfully completed or who have failed the       |
  |                                                                       |
21|competency examination for certification.  The annual report shall     |
  |                                                                       |
22|show the percentages for each institution of higher education and      |
  |                                                                       |
23|each assessment area separately by student degree status and shall     |
  |                                                                       |
24|be distributed annually to each member of the Commission for           |
  |                                                                       |

 1|Educational Quality and Accountability until June 30, 2020, the        |
  |                                                                       |
 2|Oklahoma State Regents for Higher Education, the governing board of    |
  |                                                                       |
 3|each institution which has an approved or state accredited teacher     |
  |                                                                       |
 4|education program, each member of the State Board of Education, the    |
  |                                                                       |
 5|State Board of Career and Technology Education and the Legislature.    |
  |                                                                       |
 6|    F.  By November 1, 2017, the Commission shall adopt rules          |
  |                                                                       |
 7|requiring coursework or training in the use of digital and other       |
  |                                                                       |
 8|instructional technologies as a requisite for program accreditation.   |
  |                                                                       |
 9|    SECTION 9.     AMENDATORY     70 O.S. 2011, Section 6-187, as      |
  |                                                                       |
10|last amended by Section 1, Chapter 50, O.S.L. 2017 (70 O.S. Supp.      |
  |                                                                       |
11|2018, Section 6-187), is amended to read as follows:                   |
  |                                                                       |
12|    Section 6-187.  A.  Prior to July 1, 2014 June 30, 2020, a         |
  |                                                                       |
13|competency examination shall be adopted by the Oklahoma Commission     |
  |                                                                       |
14|for Teacher Preparation Educational Quality and Accountability and     |
  |                                                                       |
15|beginning July 1, 2014 July 1, 2020, a competency examination shall    |
  |                                                                       |
16|be adopted by the Commission for Educational Quality and               |
  |                                                                       |
17|Accountability State Board of Education for the general education,     |
  |                                                                       |
18|professional education and various subject areas and grade levels      |
  |                                                                       |
19|for purposes of ensuring academic achievement and competency of each   |
  |                                                                       |
20|teacher candidate or teacher in the subject area the person is         |
  |                                                                       |
21|seeking certification to teach which shall also include                |
  |                                                                       |
22|certification as an administrator, as prescribed by the State Board    |
  |                                                                       |
23|of Education.                                                          |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|    The Commission, consistent with the purposes of this section,      |
  |                                                                       |
 2|shall promulgate rules and procedures to guarantee the                 |
  |                                                                       |
 3|confidentiality of examinations.                                       |
  |                                                                       |
 4|    B.  No teacher candidate shall be eligible for certification       |
  |                                                                       |
 5|until successfully completing the competency examination except        |
  |                                                                       |
 6|those candidates who make application to the State Board and meet      |
  |                                                                       |
 7|the criteria for the alternative placement program pursuant to         |
  |                                                                       |
 8|Section 6-122.3 of this title.  Certification shall be limited to      |
  |                                                                       |
 9|areas of approval in which the certified teacher has successfully      |
  |                                                                       |
10|completed the examination.  Subject to the provisions of subsection    |
  |                                                                       |
11|C of this section, testing for certification for subjects in which a   |
  |                                                                       |
12|teacher candidate or teacher is seeking a minor teaching assignment    |
  |                                                                       |
13|or an endorsement to teach shall be limited to the specific subject    |
  |                                                                       |
14|area test.                                                             |
  |                                                                       |
15|    A teacher candidate or teacher may take the general education,     |
  |                                                                       |
16|professional education or subject area portions of the examination     |
  |                                                                       |
17|subject to any limit imposed by the Commission.                        |
  |                                                                       |
18|    C.  1.  Except as otherwise provided for in this subsection, a     |
  |                                                                       |
19|teacher may be certified in as many areas as the teacher meets the     |
  |                                                                       |
20|necessary requirements provided by law and has successfully            |
  |                                                                       |
21|completed the subject area portion of the examination.                 |
  |                                                                       |
22|    2.  Except as otherwise provided for in this paragraph,            |
  |                                                                       |
23|certification in early childhood, elementary, or special education     |
  |                                                                       |
24|shall require completion of an appropriate teacher education program   |
  |                                                                       |

 1|approved by the Commission until June 30, 2020, and approved by the    |
  |                                                                       |
 2|State Board of Education after July 1, 2020.                           |
  |                                                                       |
 3|    Any teacher who is certified to teach elementary education may     |
  |                                                                       |
 4|be certified in early childhood education upon meeting the             |
  |                                                                       |
 5|requirements provided in law and successful completion of the          |
  |                                                                       |
 6|appropriate subject area portion of the examination.  Any teacher      |
  |                                                                       |
 7|who is certified to teach early childhood education may be certified   |
  |                                                                       |
 8|in elementary education upon meeting the requirements provided in      |
  |                                                                       |
 9|law and successful completion of the appropriate subject area          |
  |                                                                       |
10|portion of the examination.  Any special education teacher who         |
  |                                                                       |
11|becomes certified to teach through completion of an accredited         |
  |                                                                       |
12|teacher preparation program may be certified in early childhood or     |
  |                                                                       |
13|elementary education upon meeting the requirements provided in law     |
  |                                                                       |
14|and successful completion of the appropriate subject portion of the    |
  |                                                                       |
15|examination.  Any teacher who becomes certified to teach through       |
  |                                                                       |
16|completion of an accredited teacher preparation program or becomes     |
  |                                                                       |
17|alternatively certified to teach through the Troops to Teachers        |
  |                                                                       |
18|program may be certified in special education upon meeting the         |
  |                                                                       |
19|requirements provided in law and successful completion of the          |
  |                                                                       |
20|appropriate subject area portion of the examination.  Any special      |
  |                                                                       |
21|education teacher who has not completed a Commission- an approved      |
  |                                                                       |
22|teacher education program in elementary education or early childhood   |
  |                                                                       |
23|education but who has successfully completed the subject area          |
  |                                                                       |
24|portion of the examination may be certified in elementary education    |
  |                                                                       |

 1|or early childhood education for the purpose of providing direct       |
  |                                                                       |
 2|instruction and serving as the teacher of record for grading           |
  |                                                                       |
 3|purposes in special education settings only.                           |
  |                                                                       |
 4|    D.  The Until June 30, 2020, the Commission shall and beginning    |
  |                                                                       |
 5|July 1, 2020, the Board shall offer the competency examination at      |
  |                                                                       |
 6|least four times per calendar year on dates to be established by the   |
  |                                                                       |
 7|Commission until June 30, 2020, and by the Board beginning July 1,     |
  |                                                                       |
 8|2020.                                                                  |
  |                                                                       |
 9|    E.  If a teacher candidate or teacher is a non-native-English      |
  |                                                                       |
10|speaker, until June 30, 2020, the Commission shall and beginning       |
  |                                                                       |
11|July 1, 2020, the Board shall offer the subject area competency        |
  |                                                                       |
12|examination in the native language of the teacher candidate or         |
  |                                                                       |
13|teacher only if the teacher candidate or teacher is employed or has    |
  |                                                                       |
14|been offered employment by a school district as a teacher in a         |
  |                                                                       |
15|foreign language immersion program offered by the school district.     |
  |                                                                       |
16|If a non-native-English speaker who has received certification in a    |
  |                                                                       |
17|subject area after taking the subject area competency examination in   |
  |                                                                       |
18|the native language of the speaker seeks to add a certification area   |
  |                                                                       |
19|in the future and that person is no longer employed as a teacher in    |
  |                                                                       |
20|a foreign language immersion program, the examination for the          |
  |                                                                       |
21|additional certification area shall be taken in English.  The State    |
  |                                                                       |
22|Board of Education shall issue a restricted license or certificate     |
  |                                                                       |
23|to any teacher who has completed a subject area competency             |
  |                                                                       |
24|examination in the native language of the teacher as provided for in   |
  |                                                                       |

 1|this subsection restricting the teacher to teaching only in a          |
  |                                                                       |
 2|foreign language immersion program.                                    |
  |                                                                       |
 3|    F.  Nothing in the Oklahoma Teacher Preparation Act shall          |
  |                                                                       |
 4|restrict the right of the State Board of Education to issue an         |
  |                                                                       |
 5|emergency or provisional certificate, as needed.  Provided, however,   |
  |                                                                       |
 6|prior to the issuance of an emergency certificate, the district        |
  |                                                                       |
 7|shall document substantial efforts to employ a teacher who holds a     |
  |                                                                       |
 8|provisional or standard certificate.  In the event a district is       |
  |                                                                       |
 9|unable to hire an individual meeting this criteria, the district       |
  |                                                                       |
10|shall document efforts to employ an individual with a provisional or   |
  |                                                                       |
11|standard certificate in another curricular area with academic          |
  |                                                                       |
12|preparation in the field of need.  Only after these alternatives       |
  |                                                                       |
13|have been exhausted shall the district be allowed to employ an         |
  |                                                                       |
14|individual meeting minimum standards as established by the State       |
  |                                                                       |
15|Board of Education for the issuance of emergency certificates.         |
  |                                                                       |
16|    SECTION 10.     AMENDATORY     Section 1, Chapter 17, O.S.L.       |
  |                                                                       |
17|2016 (70 O.S. Supp. 2018, Section 6-187B), is amended to read as       |
  |                                                                       |
18|follows:                                                               |
  |                                                                       |
19|    Section 6-187B.  A.  The Until June 30, 2020, the Commission for   |
  |                                                                       |
20|Educational Quality and Accountability and beginning July 1, 2020,     |
  |                                                                       |
21|the State Board of Education shall establish the Teaching              |
  |                                                                       |
22|Certification Scholarship Program.  The purpose of the program shall   |
  |                                                                       |
23|be to provide qualifying teacher candidates who are seeking            |
  |                                                                       |
24|certification with a scholarship toward the cost of competency         |
  |                                                                       |

 1|examinations required by Section 6-187 of Title 70 of the Oklahoma     |
  |                                                                       |
 2|Statutes this title, subject to the availability of funds.             |
  |                                                                       |
 3|    B.  The Until June 30, 2020, the Commission and beginning July     |
  |                                                                       |
 4|1, 2020, the Board shall establish eligibility criteria for the        |
  |                                                                       |
 5|Teaching Certification Scholarship Program.                            |
  |                                                                       |
 6|    C.  Scholarships granted pursuant to this section shall be         |
  |                                                                       |
 7|limited to one per teacher candidate.                                  |
  |                                                                       |
 8|    D.  A teacher candidate who accepts a scholarship shall be         |
  |                                                                       |
 9|required to submit to the Commission until June 30, 2020, and          |
  |                                                                       |
10|beginning July 1, 2020, to the Board a declaration to teach for a      |
  |                                                                       |
11|minimum of one (1) year in an accredited school district in            |
  |                                                                       |
12|Oklahoma.  If the teacher candidate does not teach at a school         |
  |                                                                       |
13|district in Oklahoma upon achieving certification, he or she shall     |
  |                                                                       |
14|be required to reimburse the Commission until June 30, 2020, and       |
  |                                                                       |
15|beginning July 1, 2020, the Board for the full amount awarded.         |
  |                                                                       |
16|    SECTION 11.     AMENDATORY     Section 2, Chapter 17, O.S.L.       |
  |                                                                       |
17|2016 (70 O.S. Supp. 2018, Section 6-187C), is amended to read as       |
  |                                                                       |
18|follows:                                                               |
  |                                                                       |
19|    Section 6-187C.  There is hereby created in the State Treasury a   |
  |                                                                       |
20|revolving fund for the Office of Educational Quality and               |
  |                                                                       |
21|Accountability until June 30, 2020, and beginning July 1, 2020, for    |
  |                                                                       |
22|the State Board of Education to be designated the "Teaching            |
  |                                                                       |
23|Certification Scholarship Revolving Fund".  The fund shall be a        |
  |                                                                       |
24|continuing fund, not subject to fiscal year limitations, and shall     |
  |                                                                       |

 1|consist of all monies received by the Office of Educational Quality    |
  |                                                                       |
 2|and Accountability until June 30, 2020, and beginning July 1, 2020,    |
  |                                                                       |
 3|by the State Board of Education from the Legislature and any           |

 4|donations, grants and gifts from any public or private source.  All    |
  |                                                                       |
 5|monies accruing to the credit of the fund are hereby appropriated      |
  |                                                                       |
 6|and may be budgeted and expended by the Office of Educational          |
  |                                                                       |
 7|Quality and Accountability until June 30, 2020, and beginning July     |
  |                                                                       |
 8|1, 2020, by the State Board of Education for the purpose of            |
  |                                                                       |
 9|implementing the Teaching Certification Scholarship Program.           |
  |                                                                       |
10|Expenditures from the fund shall be made upon warrants issued by the   |
  |                                                                       |
11|State Treasurer against claims filed as prescribed by law with the     |
  |                                                                       |
12|Director of the Office of Management and Enterprise Services for       |
  |                                                                       |
13|approval and payment.                                                  |
  |                                                                       |
14|    SECTION 12.     AMENDATORY     70 O.S. 2011, Section 6-189, as     |
  |                                                                       |
15|last amended by Section 1, Chapter 287, O.S.L. 2018 (70 O.S. Supp.     |
  |                                                                       |
16|2018, Section 6-189), is amended to read as follows:                   |
  |                                                                       |
17|    Section 6-189.  A.  The certification system required by the       |
  |                                                                       |
18|Oklahoma Teacher Preparation Act as part of the new teacher            |
  |                                                                       |
19|preparation system shall be competency-based.  The competencies for    |
  |                                                                       |
20|certification shall be integrated with competencies specified in       |
  |                                                                       |
21|Section 6-185 of this title.  By July 1, 1996, the State Board of      |
  |                                                                       |
22|Education shall adopt general competencies for certification, and by   |
  |                                                                       |
23|January 1, 1997, the Board shall have adopted full competencies and    |
  |                                                                       |
24|implemented the certification system as required in this act the       |
  |                                                                       |

 1|Oklahoma Teacher Preparation Act.  No higher education courses or      |
  |                                                                       |
 2|credit hours may be specified by the State Board of Education in       |
  |                                                                       |
 3|rules for certification.  Nothing in the certification rules adopted   |
  |                                                                       |
 4|by the Board shall prohibit the Oklahoma State Regents for Higher      |
  |                                                                       |
 5|Education from adopting policies and procedures it deems appropriate   |
  |                                                                       |
 6|for coursework, grade point average, or credit hours for teacher       |
  |                                                                       |
 7|preparation at institutions in The Oklahoma State System of Higher     |
  |                                                                       |
 8|Education.                                                             |
  |                                                                       |
 9|    B.  The certification requirements for a school principal not      |
  |                                                                       |
10|alternatively certified under subsection D of this section shall       |
  |                                                                       |
11|include not less than:                                                 |
  |                                                                       |
12|    1.  Completion of a standard master's degree;                      |
  |                                                                       |
13|    2.  Completion of a program in education administration approved   |
  |                                                                       |
14|until June 30, 2020, by the Oklahoma Commission for Teacher            |
  |                                                                       |
15|Preparation Educational Quality and Accountability and beginning       |
  |                                                                       |
16|July 1, 2020, by the State Board of Education with an emphasis on      |
  |                                                                       |
17|curriculum, instruction and building-level leadership skills;          |
  |                                                                       |
18|    3.  Any other professional education and requirements as may be    |
  |                                                                       |
19|fixed by the State Board of Education;                                 |
  |                                                                       |
20|    4.  A passing score on the subject area competency examination     |
  |                                                                       |
21|required in Section 6-187 of this title; and                           |
  |                                                                       |
22|    5.  A minimum of two (2) years of successful teaching experience   |
  |                                                                       |
23|in public or private schools accredited by the State Board of          |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|Education or by the proper accrediting authority of another state of   |
  |                                                                       |
 2|the United States.                                                     |
  |                                                                       |
 3|    C.  The certification requirements for a superintendent of         |
  |                                                                       |
 4|schools not alternatively certified under subsection D of this         |
  |                                                                       |
 5|section shall include not less than:                                   |
  |                                                                       |
 6|    1.  Certification as a school principal or completion of the       |
  |                                                                       |
 7|certification requirements for a school principal as set forth in      |
  |                                                                       |
 8|subsection B of this section;                                          |
  |                                                                       |
 9|    2.  Completion of a program in education administration approved   |
  |                                                                       |
10|until June 30, 2020, by the Oklahoma Commission for Teacher            |
  |                                                                       |
11|Preparation Educational Quality and Accountability and beginning       |
  |                                                                       |
12|July 1, 2020, by the State Board of Education with an emphasis on      |
  |                                                                       |
13|district-level leadership skills, and which shall include the          |
  |                                                                       |
14|following competencies:                                                |
  |                                                                       |
15|         a.    instructional leadership,                               |
  |                                                                       |
16|         b.    organizational leadership, including education          |
  |                                                                       |
17|              finance, education law, and risk management,             |
  |                                                                       |
18|         c.    collaborative and community leadership, and             |
  |                                                                       |
19|         d.    ethical leadership, or                                  |
  |                                                                       |
20|    The requirement in this paragraph shall not apply to any person    |
  |                                                                       |
21|who has completed an Oklahoma Commission for Teacher Preparation       |
  |                                                                       |
22|approved a Master's Degree in Education Administration approved        |
  |                                                                       |
23|until June 30, 2020, by the Commission for Educational Quality and     |
  |                                                                       |
24|Accountability and beginning July 1, 2020, approved by the State       |
  |                                                                       |

 1|Board of Education or has completed a program in education             |
  |                                                                       |
 2|administration that included competencies that are substantially       |
  |                                                                       |
 3|equal to those listed in this paragraph, and if the degree or          |
  |                                                                       |
 4|program was completed between the effective date of this act and       |
  |                                                                       |
 5|July 1, 2005;                                                          |
  |                                                                       |
 6|    3.  Any other professional education and requirements as may be    |
  |                                                                       |
 7|fixed by the State Board of Education;                                 |
  |                                                                       |
 8|    4.  A passing score on the subject area competency examination     |
  |                                                                       |
 9|required in Section 6-187 of this title; and                           |
  |                                                                       |
10|    5.  A minimum of two (2) years of administrative experience in     |
  |                                                                       |
11|public or private schools accredited by the State Board of Education   |
  |                                                                       |
12|or by the proper accrediting authority of another state of the         |
  |                                                                       |
13|United States.                                                         |
  |                                                                       |
14|    D.  1.  The standards for alternative certification for            |
  |                                                                       |
15|superintendents of schools and principals shall include:               |
  |                                                                       |
16|         a.    the completion of a standard master's degree,           |
  |                                                                       |
17|         b.    two (2) years of relevant work experience in a          |
  |                                                                       |
18|              supervisory or administrative capacity,                  |
  |                                                                       |
19|         c.    a passing score on the subject area competency          |
  |                                                                       |
20|              examination required in Section 6-187 of this title,     |
  |                                                                       |
21|              and                                                      |
  |                                                                       |
22|         d.    filing with the director of teacher education at an     |
  |                                                                       |
23|              Oklahoma accredited institution of higher education a    |
  |                                                                       |
24|              plan for completing an alternative administrative        |
  |                                                                       |

 1|              preparation program within three (3) years.  Relevant    |
  |                                                                       |
 2|              work experience and coursework may be considered and     |
  |                                                                       |
 3|              applied to complete the plan.                            |
  |                                                                       |
 4|    2.  An alternative certificate for superintendent of schools and   |
  |                                                                       |
 5|principals shall not exceed three (3) years and shall not be           |
  |                                                                       |
 6|renewable.                                                             |
  |                                                                       |
 7|    3.  Upon successful completion of an alternative administrative    |
  |                                                                       |
 8|preparation program by a participant, the State Board of Education     |
  |                                                                       |
 9|shall issue a standard certificate for superintendent or principal,    |
  |                                                                       |
10|as applicable, to the applicant.                                       |
  |                                                                       |
11|    4.  Any person participating in an alternative certification       |
  |                                                                       |
12|program for superintendent of schools and principals on the            |
  |                                                                       |
13|effective date of this act shall be subject to the program             |
  |                                                                       |
14|requirements in effect prior to the effective date of this act.        |
  |                                                                       |
15|    E.  The certification requirements for a superintendent of a       |
  |                                                                       |
16|technology center school district shall include not less than a        |
  |                                                                       |
17|standard master's degree, any other professional education             |
  |                                                                       |
18|requirements as may be fixed by the State Board of Education, and a    |
  |                                                                       |
19|minimum of four (4) years teaching, supervisory or administrative      |
  |                                                                       |
20|experience, which may include teaching of full-time adult students,    |
  |                                                                       |
21|in a technology center school district.  A person meeting the          |
  |                                                                       |
22|requirements set forth in subsection C of this section shall be        |
  |                                                                       |
23|eligible for a certificate for superintendent of a technology center   |
  |                                                                       |
24|school district.                                                       |
  |                                                                       |

 1|    F.  The State Board of Education and the State Board of Career     |
  |                                                                       |
 2|and Technology Education shall promulgate rules for a certification    |
  |                                                                       |
 3|system option specifically for teachers and instructors in the         |
  |                                                                       |
 4|technology center school districts.  The teacher preparation system    |
  |                                                                       |
 5|shall be competency-based.  The competencies for certification shall   |
  |                                                                       |
 6|be integrated with competencies of this title, as well as reflect      |
  |                                                                       |
 7|industry-based skills, standards and certifications.                   |
  |                                                                       |
 8|    G.  Certificates issued by the State Board of Education may be     |
  |                                                                       |
 9|revoked by the State Board of Education for willful violation of any   |
  |                                                                       |
10|rule of the Board or of any federal or state law or other proper       |
  |                                                                       |
11|cause but only after sufficient hearing has been given before the      |
  |                                                                       |
12|Board.                                                                 |
  |                                                                       |
13|    H.  Teaching in a Head Start program or programs shall be used     |
  |                                                                       |
14|for renewal of a standard teaching certificate.                        |
  |                                                                       |
15|    SECTION 13.     AMENDATORY     70 O.S. 2011, Section 6-189.1, as   |
  |                                                                       |
16|last amended by Section 15, Chapter 124, O.S.L. 2014 (70 O.S. Supp.    |
  |                                                                       |
17|2018, Section 6-189.1), is amended to read as follows:                 |
  |                                                                       |
18|    Section 6-189.1.  A.  Beginning July 1, 2000, no school district   |
  |                                                                       |
19|shall employ any teacher to teach mathematics in grades seven or       |
  |                                                                       |
20|eight, unless the teacher is certified to teach middle or secondary    |
  |                                                                       |
21|level mathematics or has received middle level endorsement pursuant    |
  |                                                                       |
22|to subsection B of this section.                                       |
  |                                                                       |
23|    B.  Any teacher who became certified to teach prior to September   |
  |                                                                       |
24|1, 1999, does not have middle or secondary level certification in      |
  |                                                                       |

 1|mathematics, and is serving in a school as a mathematics teacher for   |
  |                                                                       |
 2|grades seven or eight shall be required to obtain middle level         |
  |                                                                       |
 3|certification or middle level endorsement before September 1, 2003.    |
  |                                                                       |
 4|For such teachers, middle level certification or middle level          |
  |                                                                       |
 5|endorsement may be obtained as follows:                                |
  |                                                                       |
 6|    1.  Middle level mathematics certification  A teacher may obtain   |
  |                                                                       |
 7|middle level certification by successfully completing the              |
  |                                                                       |
 8|appropriate Oklahoma Subject Area Test for middle level mathematics    |
  |                                                                       |
 9|administered until June 30, 2020, by the Oklahoma Commission for       |
  |                                                                       |
10|Teacher Preparation Educational Quality and Accountability and         |
  |                                                                       |
11|beginning July 1, 2020, by the State Board of Education.  The          |
  |                                                                       |
12|teacher shall not be required to take the Oklahoma Professional        |
  |                                                                       |
13|Teacher Examination for secondary students administered until June     |
  |                                                                       |
14|30, 2020, by the Oklahoma Commission for Teacher Preparation           |
  |                                                                       |
15|Educational Quality and Accountability and beginning July 1, 2020,     |
  |                                                                       |
16|by the State Board of Education.  A teacher granted middle level       |
  |                                                                       |
17|certification pursuant to this paragraph shall be entitled to teach    |
  |                                                                       |
18|mathematics in grades seven and eight for high school graduation       |
  |                                                                       |
19|credit; and                                                            |
  |                                                                       |
20|    2.  Middle level endorsement  A teacher may obtain a middle        |
  |                                                                       |
21|level endorsement by successfully completing a professional            |
  |                                                                       |
22|development institute in middle level mathematics developed and        |
  |                                                                       |
23|administered until June 30, 2020, by the Oklahoma Commission for       |
  |                                                                       |
24|Teacher Preparation Educational Quality and Accountability and         |
  |                                                                       |

 1|beginning July 1, 2020, by the State Board of Education.  Any          |
  |                                                                       |
 2|professional development institute developed pursuant to this          |
  |                                                                       |
 3|paragraph shall meet the criteria as established in subsection H of    |
  |                                                                       |
 4|this section.  A teacher granted middle level endorsement pursuant     |
  |                                                                       |
 5|to this paragraph shall not be entitled to teach mathematics for       |
  |                                                                       |
 6|high school graduation credit.                                         |
  |                                                                       |
 7|    C.  Any teacher serving in a school as a mathematics teacher for   |
  |                                                                       |
 8|grade six may obtain middle level endorsement by successfully          |
  |                                                                       |
 9|completing a professional development institute in middle level        |
  |                                                                       |
10|mathematics developed pursuant to this section.  Such teacher shall    |
  |                                                                       |
11|be eligible to participate in a professional development institute     |
  |                                                                       |
12|in middle level mathematics developed and administered until June      |
  |                                                                       |
13|30, 2020, by the Oklahoma Commission for Teacher Preparation           |
  |                                                                       |
14|Educational Quality and Accountability and beginning July 1, 2020,     |
  |                                                                       |
15|by the State Board of Education one time free of charge.               |
  |                                                                       |
16|    D.  Any teacher seeking middle level certification or middle       |
  |                                                                       |
17|level endorsement pursuant to subsection B of this section shall be    |
  |                                                                       |
18|eligible to take the Oklahoma Subject Area Test in middle level        |
  |                                                                       |
19|mathematics one time free of charge after July 1, 2000, or             |
  |                                                                       |
20|participate in a professional development institute in middle level    |
  |                                                                       |
21|mathematics developed and administered until June 30, 2020, by the     |
  |                                                                       |
22|Oklahoma Commission for Teacher Preparation Educational Quality and    |
  |                                                                       |
23|Accountability and beginning July 1, 2020, by the State Board of       |
  |                                                                       |
24|Education one time free of charge after July 1, 2000.                  |
  |                                                                       |

 1|    E.  A teacher who is granted middle level certification in         |
  |                                                                       |
 2|mathematics, pursuant to subsection B of this section, may teach       |
  |                                                                       |
 3|grade nine only if the teacher successfully completes the Oklahoma     |
  |                                                                       |
 4|Professional Teacher Examination for secondary students.               |
  |                                                                       |
 5|    F.  A teacher who is granted middle level endorsement pursuant     |
  |                                                                       |
 6|to subsection B or C of this section may teach mathematics courses     |
  |                                                                       |
 7|in grades seven or eight for high school credit only if the teacher    |
  |                                                                       |
 8|has completed a minimum of twenty-four (24) college credit semester    |
  |                                                                       |
 9|hours of mathematics as specified by the State Department of           |
  |                                                                       |
10|Education.                                                             |
  |                                                                       |
11|    G.  Any teacher who became certified to teach prior to September   |
  |                                                                       |
12|1, 1999, did not have middle or secondary level certification in       |
  |                                                                       |
13|mathematics and successfully completed the appropriate Oklahoma        |
  |                                                                       |
14|Subject Area Test for middle level mathematics between July 1, 1999,   |
  |                                                                       |
15|and July 1, 2000, shall be granted a middle level certificate          |
  |                                                                       |
16|pursuant to subsection B of this section.                              |
  |                                                                       |
17|    H.  1.  Any professional development institute in middle level     |
  |                                                                       |
18|mathematics developed pursuant to this section and administered        |
  |                                                                       |
19|until June 30, 2020, by the Oklahoma Commission for Teacher            |
  |                                                                       |
20|Preparation Educational Quality and Accountability and beginning       |
  |                                                                       |
21|July 1, 2020, by the State Board of Education shall:                   |
  |                                                                       |
22|         a.    consist of a minimum of thirty (30) clock hours,        |
  |                                                                       |
23|         b.    be competency based,                                    |
  |                                                                       |
24|         c.    emphasize effective learning practices,                 |
  |                                                                       |

 1|         d.    require collaboration among participants, and           |
  |                                                                       |
 2|         e.    require each participant to prepare a work product      |
  |                                                                       |
 3|              which can be utilized in the classroom by the            |
  |                                                                       |
 4|              participant.                                             |
  |                                                                       |
 5|    2.  Any professional development institute in middle level         |
  |                                                                       |
 6|mathematics developed pursuant to this section and administered        |
  |                                                                       |
 7|until June 30, 2020, by the Oklahoma Commission for Teacher            |
  |                                                                       |
 8|Preparation Educational Quality and Accountability and beginning       |
  |                                                                       |
 9|July 1, 2020, by the State Board of Education shall be chosen          |
  |                                                                       |
10|through a competitive bid process, be reviewed by a professional       |
  |                                                                       |
11|development committee and other constituencies, and be subject to      |
  |                                                                       |
12|peer review.  Invitations to bid for a professional development        |
  |                                                                       |
13|institute shall be open to any public or private entity.               |
  |                                                                       |
14|    I.  Beginning July 1, 2013, any teacher with certification or      |
  |                                                                       |
15|endorsement to teach at the secondary level may teach the subject      |
  |                                                                       |
16|area in which the teacher has received certification or endorsement    |
  |                                                                       |
17|in grades five and six.                                                |
  |                                                                       |
18|    SECTION 14.     AMENDATORY     70 O.S. 2011, Section 6-190, as     |
  |                                                                       |
19|last amended by Section 1, Chapter 229, O.S.L. 2018 (70 O.S. Supp.     |
  |                                                                       |
20|2018, Section 6-190), is amended to read as follows:                   |
  |                                                                       |
21|    Section 6-190.  A.  The board of education of each school          |
  |                                                                       |
22|district shall employ and contract in writing, as required in          |
  |                                                                       |
23|Section 6-101 of this title, only with persons certified to teach by   |
  |                                                                       |
24|the State Board of Education in accordance with the Oklahoma Teacher   |
  |                                                                       |

 1|Preparation Act, except as otherwise provided for by Section 6-101     |
  |                                                                       |
 2|of this title and by other law.                                        |
  |                                                                       |
 3|    B.  The Board shall issue a certificate to teach to any person     |

 4|who:                                                                   |
  |                                                                       |
 5|    1.  Has successfully completed the teacher education program       |
  |                                                                       |
 6|required until June 30, 2020, by the Commission for Educational        |
  |                                                                       |
 7|Quality and Accountability and beginning July 1, 2020, by the Board;   |
  |                                                                       |
 8|    2.  Has graduated from an accredited institution of higher         |
  |                                                                       |
 9|education that has approval or accreditation for teacher education,    |
  |                                                                       |
10|    3.  Has met all other requirements as may be established by the    |
  |                                                                       |
11|Board;                                                                 |
  |                                                                       |
12|    4.  Has made the necessary application and paid the competency     |
  |                                                                       |
13|examination fee in an amount and as prescribed until June 30, 2020,    |
  |                                                                       |
14|by the Commission, and beginning July 1, 2020, by the Board;           |
  |                                                                       |
15|    5.  Has successfully completed the competency examination          |
  |                                                                       |
16|required in Section 6-187 of this title; and                           |
  |                                                                       |
17|    6.  Beginning November 1, 2001, has on file with the Board a       |
  |                                                                       |
18|current Oklahoma criminal history record from the Oklahoma State       |
  |                                                                       |
19|Bureau of Investigation as well as a national criminal history         |
  |                                                                       |
20|record check as defined in Section 150.9 of Title 74 of the Oklahoma   |
  |                                                                       |
21|Statutes.  Upon receipt of the Oklahoma criminal history record, the   |
  |                                                                       |
22|Board may issue a temporary certificate which shall be effective       |
  |                                                                       |
23|until receipt of the national fingerprint-based criminal history       |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|record.  The person applying for a certificate shall be responsible    |
  |                                                                       |
 2|for the cost of the criminal history records.                          |
  |                                                                       |
 3|    C.  The Board shall issue a certificate to teach to any person     |
  |                                                                       |
 4|who:                                                                   |
  |                                                                       |
 5|    1.  Holds an out-of-state certificate and meets the requirements   |
  |                                                                       |
 6|set forth in subsection F of this section;                             |
  |                                                                       |
 7|    2.  Holds certification from the National Board for Professional   |
  |                                                                       |
 8|Teaching Standards;                                                    |
  |                                                                       |
 9|    3.  Holds an out-of-country certificate and meets the              |
  |                                                                       |
10|requirements set forth in subsection F of this section; or             |
  |                                                                       |
11|    4.  Has successfully completed a competency examination used in    |
  |                                                                       |
12|the majority of other states or comparable customized exam and meets   |
  |                                                                       |
13|the requirements set forth in subsection G of this section.            |
  |                                                                       |
14|    D.  Beginning July 1, 2004, any person applying for initial        |
  |                                                                       |
15|Oklahoma certification shall have on file with the Board a current     |
  |                                                                       |
16|Oklahoma criminal history record from the Oklahoma State Bureau of     |
  |                                                                       |
17|Investigation as well as a national criminal history record check as   |
  |                                                                       |
18|defined in Section 150.9 of Title 74 of the Oklahoma Statutes.  Upon   |
  |                                                                       |
19|receipt of the Oklahoma criminal history record, the Board may issue   |
  |                                                                       |
20|a temporary certificate which shall be effective until receipt of      |
  |                                                                       |
21|the national fingerprint-based criminal history record.  The person    |
  |                                                                       |
22|applying for a certificate shall be responsible for the cost of the    |
  |                                                                       |
23|criminal history records.                                              |
  |                                                                       |

  |                                                                       |

 1|    E.  Any person holding a valid certificate, issued prior to        |
  |                                                                       |
 2|January 1, 1997, shall be a certified teacher for purposes of the      |
  |                                                                       |
 3|Oklahoma Teacher Preparation Act, subject to any professional          |
  |                                                                       |
 4|development requirements prescribed by the Oklahoma Teacher            |
  |                                                                       |
 5|Preparation Act or by the State Board of Education.                    |
  |                                                                       |
 6|    F.  1.  The Board shall issue a certificate to teach to a person   |
  |                                                                       |
 7|who holds a valid out-of-state certificate or to a person who holds    |
  |                                                                       |
 8|a valid out-of-country certificate and meets any requirements          |
  |                                                                       |
 9|established by the Board.  The certificate to teach shall only be      |
  |                                                                       |
10|for those subject areas and grade levels most closely aligned to the   |
  |                                                                       |
11|subject areas and grade levels recognized on the out-of-state or       |
  |                                                                       |
12|out-of-country certificate.                                            |
  |                                                                       |
13|    2.  A person who meets the requirements of paragraph 1 of this     |
  |                                                                       |
14|subsection shall not be required to take any competency examinations   |
  |                                                                       |
15|in those subject areas and grade levels most closely aligned to the    |
  |                                                                       |
16|subject areas and grade levels recognized on the out-of-state or       |
  |                                                                       |
17|out-of-country certificate.                                            |
  |                                                                       |
18|    3.  A person who meets the requirements of paragraph 1 of this     |
  |                                                                       |
19|subsection shall have on file with the Board a current Oklahoma        |
  |                                                                       |
20|criminal history record check from the Oklahoma State Bureau of        |
  |                                                                       |
21|Investigation as well as a national criminal history record check as   |
  |                                                                       |
22|defined in Section 150.9 of Title 74 of the Oklahoma Statutes.  Upon   |
  |                                                                       |
23|receipt of the Oklahoma criminal history record check, the Board may   |
  |                                                                       |
24|issue a temporary certificate which shall be effective until receipt   |
  |                                                                       |

 1|of the national fingerprint-based criminal history record check.       |
  |                                                                       |
 2|The person applying for a certificate shall be responsible for the     |
  |                                                                       |
 3|cost of the criminal history record checks.                            |
  |                                                                       |
 4|    4.  The Board shall promulgate rules establishing a process by     |
  |                                                                       |
 5|which out-of-country certificates will be reviewed and evaluated for   |
  |                                                                       |
 6|purposes of awarding a certificate to teach pursuant to this           |
  |                                                                       |
 7|subsection.                                                            |
  |                                                                       |
 8|    G.  1.  The Board shall issue a certificate to teach to a person   |
  |                                                                       |
 9|who has successfully completed a competency exam used in a majority    |
  |                                                                       |
10|of the other states.  The certificate to teach shall only be for       |
  |                                                                       |
11|those subject areas and grade levels that correspond with a            |
  |                                                                       |
12|certification area used in Oklahoma.                                   |
  |                                                                       |
13|    2.  A person who meets the requirements of paragraph 1 of this     |
  |                                                                       |
14|subsection shall have on file with the Board a current Oklahoma        |
  |                                                                       |
15|criminal history record check from the Oklahoma State Bureau of        |
  |                                                                       |
16|Investigation as well as a national criminal history record check as   |
  |                                                                       |
17|defined in Section 150.9 of Title 74 of the Oklahoma Statutes.  Upon   |
  |                                                                       |
18|receipt of the Oklahoma criminal history record check, the Board may   |
  |                                                                       |
19|issue a temporary certificate which shall be effective until receipt   |
  |                                                                       |
20|of the national fingerprint-based criminal history record check.       |
  |                                                                       |
21|The person applying for a certificate shall be responsible for the     |
  |                                                                       |
22|cost of the criminal history record checks.                            |
  |                                                                       |
23|    H.  The Board shall issue a lead teaching certificate to any       |
  |                                                                       |
24|person who upon application:                                           |
  |                                                                       |

 1|    1.  Has successfully completed the requirements of this            |
  |                                                                       |
 2|subsection;                                                            |
  |                                                                       |
 3|    2.  Has a minimum of five (5) years of experience as a teacher;    |
  |                                                                       |
 4|    3.  Participates in a meaningful individualized program of         |
  |                                                                       |
 5|professional development, as provided for in Section 6-101.10 of       |
  |                                                                       |
 6|this title;                                                            |
  |                                                                       |
 7|    4.  Has earned a "highly effective" or "superior" rating           |
  |                                                                       |
 8|pursuant to Section 6-101.16 of this title; and                        |
  |                                                                       |
 9|    5.  May have a teaching load of not more than seventy-five         |
  |                                                                       |
10|percent (75%) student instruction to allow the teacher to mentor       |
  |                                                                       |
11|other teachers.                                                        |
  |                                                                       |
12|    I.  1.  The Board shall issue a master teaching certificate to     |
  |                                                                       |
13|any person who upon application:                                       |
  |                                                                       |
14|         a.    has successfully completed the requirements of this     |
  |                                                                       |
15|              subsection,                                              |
  |                                                                       |
16|         b.    has a minimum of seven (7) years of experience as a     |
  |                                                                       |
17|              teacher, and                                             |
  |                                                                       |
18|         c.   (1)   has earned a "superior" rating pursuant to         |
  |                                                                       |
19|                   Section 6-101.16 of this title, or                  |
  |                                                                       |
20|              (2)   has earned a "highly effective" rating pursuant    |
  |                                                                       |
21|                   to Section 6-101.16 of this title and holds or      |
  |                                                                       |
22|                   has held a National Board certification from the    |
  |                                                                       |
23|                   National Board for Professional Teaching            |
  |                                                                       |
24|                   Standards.                                          |
  |                                                                       |

 1|    2.  Teachers with a master teaching certificate may assume         |
  |                                                                       |
 2|leadership roles that include but are not limited to:                  |
  |                                                                       |
 3|         a.    the planning and delivery of professional development   |
  |                                                                       |
 4|              activities designed to improve instructional             |
  |                                                                       |
 5|              strategies,                                              |
  |                                                                       |
 6|         b.    the facilitation of an instructional leadership team    |
  |                                                                       |
 7|              within the building or school district in which the      |
  |                                                                       |
 8|              lead teacher is assigned, and                            |
  |                                                                       |
 9|         c.    the mentoring of other teachers and participation in    |
  |                                                                       |
10|              evaluations of other teachers.                           |
  |                                                                       |
11|    3.  Teachers with a master teaching certificate may have a         |
  |                                                                       |
12|teaching load of not more than fifty percent (50%) student             |
  |                                                                       |
13|instruction to allow the lead teacher to spend time on:                |
  |                                                                       |
14|         a.    co-teaching,                                            |
  |                                                                       |
15|         b.    co-planning,                                            |
  |                                                                       |
16|         c.    peer reviews, and                                       |
  |                                                                       |
17|         d.    other duties mutually agreed upon by the                |
  |                                                                       |
18|              superintendent and the master teacher, and may be used   |
  |                                                                       |
19|              to satisfy the qualitative evaluation component for      |
  |                                                                       |
20|              teachers as required by Section 6-101.16 of this title   |
  |                                                                       |
21|              by performing the duties set forth in this paragraph.    |
  |                                                                       |
22|    J.  The State Board of Education shall adopt rules to implement    |
  |                                                                       |
23|a renewal schedule and associated fees for lead and master teaching    |
  |                                                                       |
24|certificates.  The rules shall allow a teacher that no longer meets    |
  |                                                                       |

 1|the requirements of a lead or master teaching certificate to make      |
  |                                                                       |
 2|application for the standard teaching certificate.                     |
  |                                                                       |
 3|    K.  The terms of the contracts issued to those holding lead and    |
  |                                                                       |
 4|master teaching certificates shall include the following:              |
  |                                                                       |
 5|    1.  Lead:  an additional ten (10) days to be used to strengthen    |
  |                                                                       |
 6|instructional leadership.  A person with a lead teaching certificate   |
  |                                                                       |
 7|shall receive an annual salary supplement of at least Three Thousand   |
  |                                                                       |
 8|Dollars ($3,000.00) or the district's daily rate of pay, whichever     |
  |                                                                       |
 9|is higher, in addition to the salary for which the teacher qualifies   |
  |                                                                       |
10|pursuant to Section 18-114.14 of this title; and                       |
  |                                                                       |
11|    2.  Master:  an additional fifteen (15) days to be used to         |
  |                                                                       |
12|strengthen leadership.  A person with a master teaching certificate    |
  |                                                                       |
13|shall receive an annual salary supplement of at least Five Thousand    |
  |                                                                       |
14|Dollars ($5,000.00) or the district's daily rate of pay, whichever     |
  |                                                                       |
15|is higher, in addition to the salary for which the teacher qualifies   |
  |                                                                       |
16|pursuant to Section 18-114.14 of this title.                           |
  |                                                                       |
17|    If a person with a lead or master teaching certificate changes     |
  |                                                                       |
18|school districts during the life of the certificate, the terms of      |
  |                                                                       |
19|the contracts required in this subsection shall be subject to          |
  |                                                                       |
20|approval by the new employing school district.                         |
  |                                                                       |
21|    L.  1.  Any person who is eligible for a lead or master teaching   |
  |                                                                       |
22|certificate described in this section shall make application for the   |
  |                                                                       |
23|following school year with the State Board of Education.  The          |
  |                                                                       |
24|application shall include a recommendation from the local board of     |
  |                                                                       |

 1|education and determination that the applicant has met the statutory   |
  |                                                                       |
 2|criteria.  In reviewing an application, the local school board of      |
  |                                                                       |
 3|education and the superintendent shall consider the ability of the     |
  |                                                                       |
 4|school district to fulfill the additional requirements described in    |
  |                                                                       |
 5|subsections H and I of this section before making a recommendation     |
  |                                                                       |
 6|to the State Board of Education.                                       |
  |                                                                       |
 7|    2.  The State Department of Education shall develop an             |
  |                                                                       |
 8|application to implement the provisions of this subsection and make    |
  |                                                                       |
 9|it available to school districts.                                      |
  |                                                                       |
10|    M.  Beginning in the 2021-2022 school year, the Department shall   |
  |                                                                       |
11|make the teaching certificates provided for in this section            |
  |                                                                       |
12|available for any person who has received a recommendation from        |
  |                                                                       |
13|their local board of education and who meets the eligibility           |
  |                                                                       |
14|criteria.                                                              |
  |                                                                       |
15|    N.  For the 2019-2020 and 2020-2021 school years, the Department   |
  |                                                                       |
16|shall identify school districts to implement the teaching              |
  |                                                                       |
17|certificates provided for in this section on a pilot program basis     |
  |                                                                       |
18|with the assistance of public-private partnerships, funding from       |
  |                                                                       |
19|philanthropic organizations or federal grants.                         |
  |                                                                       |
20|    O.  The Department shall seek funding necessary for the            |
  |                                                                       |
21|administration of this section.  If funding for the administration     |
  |                                                                       |
22|of the teaching certificates listed in paragraphs H and I is not       |
  |                                                                       |
23|available, the Department shall not be required to fulfill the         |
  |                                                                       |
24|requirements listed in subsections K, L, M and N of the section.       |
  |                                                                       |

 1|    P.  The State Board of Education shall promulgate rules to         |
  |                                                                       |
 2|implement the provisions of this act.                                  |
  |                                                                       |
 3|    SECTION 15.     AMENDATORY     70 O.S. 2011, Section 6-191, as     |
  |                                                                       |
 4|amended by Section 598, Chapter 304, O.S.L. 2012 (70 O.S. Supp.        |
  |                                                                       |
 5|2018, Section 6-191), is amended to read as follows:                   |
  |                                                                       |
 6|    Section 6-191.  Until July 1, 1998, there is created in the        |
  |                                                                       |
 7|State Treasury a revolving fund for the State Board of Education, to   |
  |                                                                       |
 8|be designated the "Teachers' Curriculum Examination Revolving Fund".   |
  |                                                                       |
 9| The fund shall consist of curriculum examination fees paid to the     |
  |                                                                       |
10|Board pursuant to statutory authority.  The revolving fund shall be    |
  |                                                                       |
11|a continuing fund not subject to fiscal year limitations and shall     |
  |                                                                       |
12|be under the control and management of the administrative authority    |
  |                                                                       |
13|of the State Board of Education.  Expenditures from said the fund      |
  |                                                                       |
14|shall be made to maintain the curriculum examination process as set    |
  |                                                                       |
15|out in this act.  Warrants for expenditure shall be drawn by the       |
  |                                                                       |
16|State Treasurer on claims signed by an authorized employee or          |
  |                                                                       |
17|employees of the State Board of Education and approved by the          |
  |                                                                       |
18|Director of the Office of Management and Enterprise Services.          |
  |                                                                       |
19|    On July 1, 1997, the State Board of Education shall transfer any   |
  |                                                                       |
20|unencumbered funds in the Teachers' Curriculum Examination Revolving   |
  |                                                                       |
21|Fund to the Teachers' Competency Examination Revolving Fund.  Any      |
  |                                                                       |
22|funds which are unexpended on January 1, 1998, shall be transferred    |
  |                                                                       |
23|to the Teachers' Competency Examination Revolving Fund.  On July 1,    |
  |                                                                       |
24|1997, Until June 30, 2020, there shall be created in the State         |
  |                                                                       |

 1|Treasury a revolving fund for the Oklahoma Commission for Teacher      |
  |                                                                       |
 2|Preparation Educational Quality and Accountability and beginning       |
  |                                                                       |

 4|"Teachers' Competency Examination Revolving Fund".  The fund shall     |
  |                                                                       |
 5|consist of all monies received until June 30, 2020, by the             |
  |                                                                       |

13|beginning July 1, 2020.  Expenditures from said the fund shall be      |
  |                                                                       |
14|made to maintain the competency examination process set out in the     |
  |                                                                       |
15|Oklahoma Teacher Preparation Act.  Warrants for expenditure shall be   |
  |                                                                       |
16|drawn Expenditures from the fund shall be made upon warrants issued    |
  |                                                                       |
17|by the State Treasurer on claims signed by an authorized employee or   |
  |                                                                       |
18|employees of the Oklahoma Commission for Teacher Preparation and       |
  |                                                                       |
19|approved by filed as prescribed by law with the Director of the        |
  |                                                                       |
20|Office of Management and Enterprise Services for approval and          |
  |                                                                       |
21|payment.                                                               |
  |                                                                       |
22|    SECTION 16.     AMENDATORY     70 O.S. 2011, Section 6-195, as     |
  |                                                                       |
23|last amended by Section 4, Chapter 165, O.S.L. 2018 (70 O.S. Supp.     |
  |                                                                       |
24|2018, Section 6-195), is amended to read as follows:                   |

 1|    Section 6-195.  A.  As funds are available, the State Department   |

 2|of Education, in consultation with the Office of Educational Quality   |

 4|induction program for teachers which shall be approved by the State    |
  |                                                                       |
 5|Board of Education.  Beginning with the 2015-2016 school year, each    |
  |                                                                       |
 6|school district shall participate in the induction program.  The       |
  |                                                                       |
 7|program shall include, but not be limited to:                          |
  |                                                                       |
 8|    1.  Guidance to school districts for successful induction          |
  |                                                                       |
 9|programs;                                                              |
  |                                                                       |
10|    2.  Training for school districts to include the selection,        |
  |                                                                       |
11|function and duties of mentors; and                                    |
  |                                                                       |
12|    3.  Resources for appropriate professional development, support,   |
  |                                                                       |
13|mentorship and coaching for the inductee and mentors.                  |
  |                                                                       |
14|    B.  The State Board of Education may promulgate rules for          |
  |                                                                       |
15|administration of the induction program.                               |
  |                                                                       |
16|    SECTION 17.     AMENDATORY     70 O.S. 2011, Section 6-195.2, as   |
  |                                                                       |
17|amended by Section 21, Chapter 124, O.S.L. 2014 (70 O.S. Supp. 2018,   |
  |                                                                       |
18|Section 6-195.2), is amended to read as follows:                       |
  |                                                                       |
19|    Section 6-195.2.  A.  Subject to the availability of funds, the    |
  |                                                                       |
20|Oklahoma Commission for Teacher Preparation Educational Quality and    |
  |                                                                       |
21|Accountability until June 30, 2020, and beginning July 1, 2020, the    |
  |                                                                       |
22|State Board of Education shall develop and administer mathematics      |
  |                                                                       |
23|professional development programs which will be provided for any       |
  |                                                                       |
24|teacher who became certified to teach in elementary education or       |
  |                                                                       |

 1|early childhood education prior to July 1, 2001, and is serving as a   |
  |                                                                       |
 2|teacher in a public school in this state in kindergarten through       |
  |                                                                       |
 3|third grade.  The purpose of the professional development program      |

 4|shall be to improve the knowledge and skills of the teachers and to    |
  |                                                                       |
 5|ensure that the elementary grade students of the state are taught by   |
  |                                                                       |
 6|professional educators fully prepared in the area of mathematics.      |
  |                                                                       |
 7|    B.  Any professional development program offered to teachers       |
  |                                                                       |
 8|pursuant to the provisions of this section shall:                      |
  |                                                                       |
 9|    1.  Be scientifically research-based professional development;     |
  |                                                                       |
10|and                                                                    |
  |                                                                       |
11|    2.  Meet state law requirements for professional development       |
  |                                                                       |
12|administered by the Commission until June 30, 2020, and beginning      |
  |                                                                       |
13|July 1, 2020, by the Board.                                            |
  |                                                                       |
14|    C.  The professional development program offered to teachers       |
  |                                                                       |
15|pursuant to the provisions of this section shall address both          |
  |                                                                       |
16|content skill and methodology, and may contain a technology            |
  |                                                                       |
17|component.                                                             |
  |                                                                       |
18|    SECTION 18.     AMENDATORY     70 O.S. 2011, Section 6-197, as     |
  |                                                                       |
19|amended by Section 22, Chapter 124, O.S.L. 2014 (70 O.S. Supp. 2018,   |
  |                                                                       |
20|Section 6-197), is amended to read as follows:                         |
  |                                                                       |
21|    Section 6-197.  A.  All students graduating from an accredited     |

 2|personnel on or after September 1, 1999, and seeking to enter the      |
  |                                                                       |
 3|public education system as a teacher shall be subject to the           |
  |                                                                       |
 4|assessment and certification procedures established in the Oklahoma    |
  |                                                                       |
 5|Teacher Preparation Act.  Except as provided for in subsection B of    |
  |                                                                       |
 6|this section, all students graduating from an accredited institution   |
  |                                                                       |
 7|of higher education prior to September 1, 1999, and seeking to enter   |
  |                                                                       |
 8|the public education system as a teacher shall be subject to the       |
  |                                                                       |
 9|assessment and certification requirements in effect before July 1,     |
  |                                                                       |
10|1997.                                                                  |
  |                                                                       |
11|    B.  Any person who graduates from an accredited institution of     |
  |                                                                       |
12|higher education prior to September 1, 1999, and seeks certification   |
  |                                                                       |
13|or endorsement subsequent to September 1, 1999, to teach a subject     |
  |                                                                       |
14|area which the teacher was not certified to teach prior to September   |
  |                                                                       |
15|1, 1999, following completion of the required higher education shall   |
  |                                                                       |
16|be required to successfully complete the competency examination for    |
  |                                                                       |
17|such subject area prior to receiving such certification or             |
  |                                                                       |
18|endorsement.                                                           |
  |                                                                       |
19|    SECTION 19.     AMENDATORY     70 O.S. 2011, Section 6-200, as     |
  |                                                                       |
20|last amended by Section 12, Chapter 83, O.S.L. 2013 (70 O.S. Supp.     |
  |                                                                       |
21|2018, Section 6-200), is amended to read as follows:                   |
  |                                                                       |
22|    Section 6-200.  A.  Subject to the availability of funds, the      |
  |                                                                       |
23|State Board of Education shall have authority to develop and           |
  |                                                                       |
24|administer training for residency committees and training for          |
  |                                                                       |

 1|professional development through professional development              |
  |                                                                       |
 2|institutes.  Included in the professional development institutes       |
  |                                                                       |
 3|training shall be technology training.  Professional development       |
  |                                                                       |
 4|institutes shall be defined as continuing education experiences        |
  |                                                                       |
 5|which consist of a minimum of thirty (30) clock hours.  The            |
  |                                                                       |
 6|institutes shall be competency-based, emphasize effective learning     |
  |                                                                       |
 7|practices, require collaboration among participants, and require       |
  |                                                                       |
 8|each participant to prepare a work product which can be utilized in    |
  |                                                                       |
 9|the classroom by the participant.  Any state professional              |
  |                                                                       |
10|development institutes administered by the Board shall be chosen       |
  |                                                                       |
11|through a competitive bid process and if funds are available subject   |
  |                                                                       |
12|to peer review.  The Board, prior to offering any professional         |
  |                                                                       |
13|development institute, shall promulgate rules related to               |
  |                                                                       |
14|administering state professional development institutes.               |
  |                                                                       |
15|    B.  The State Board of Education shall develop, offer and          |
  |                                                                       |
16|administer professional development institutes to train elementary     |
  |                                                                       |
17|school teachers in reading education and if funds are available,       |
  |                                                                       |
18|which may include but not be limited to grant, foundation, or other    |
  |                                                                       |
19|funds, to train middle school teachers in reading education.  Funds    |
  |                                                                       |
20|appropriated for this purpose shall be used for the cost of            |
  |                                                                       |
21|developing, administering and contracting for the professional         |
  |                                                                       |
22|development institutes.  When possible, certified reading              |
  |                                                                       |
23|specialists shall be included as consultants.  All costs of the        |
  |                                                                       |
24|institutes shall be included in the contract price and no tuition or   |
  |                                                                       |

 1|registration fee shall be collected from teachers attending the        |
  |                                                                       |
 2|institutes.  The institutes shall be offered by or through the         |
  |                                                                       |
 3|Commission Board.  Working in conjunction with the State Department    |
  |                                                                       |
 4|of Education, the Commission Board shall develop a state plan for      |
  |                                                                       |
 5|administration of such institutes and shall report on or before        |
  |                                                                       |
 6|November 1 of each year to the Governor and the Legislature on the     |
  |                                                                       |
 7|format of and participation in the institutes.  The State Department   |
  |                                                                       |
 8|of Education shall cooperate with and provide any information          |
  |                                                                       |
 9|requested, including data available through the state student record   |
  |                                                                       |
10|system, to the State Board of Education as is necessary to carry out   |
  |                                                                       |
11|the provisions of this section.                                        |
  |                                                                       |
12|    C.  Subject to the availability of funds, the State Board of       |
  |                                                                       |
13|Education shall:                                                       |
  |                                                                       |
14|    1.  Contract for an independent evaluation of the reading          |
  |                                                                       |
15|professional development institutes.  The evaluation shall determine   |
  |                                                                       |
16|adherence to program requirements as provided in this section and      |
  |                                                                       |
17|the program's effectiveness in increasing teacher knowledge and        |
  |                                                                       |
18|student achievement; and                                               |
  |                                                                       |
19|    2.  Provide continued support of the reading professional          |
  |                                                                       |
20|development institutes through ongoing teacher development at          |
  |                                                                       |
21|individual school sites.  Funds may be used for the cost of mentor     |
  |                                                                       |
22|training, payment for substitute teachers, on-site facilitation, and   |
  |                                                                       |
23|any other costs necessary to ensure improved reading by students.      |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|    D.  1.  For the purpose of implementing comprehensive reading      |
  |                                                                       |
 2|reform and systemic change, the State Board of Education shall award   |
  |                                                                       |
 3|one-year grants renewable for up to two (2) additional years to        |
  |                                                                       |
 4|public schools that serve students in kindergarten through third       |
  |                                                                       |
 5|grade.  The grants will provide for:                                   |
  |                                                                       |
 6|         a.    a five-day initial professional development institute   |
  |                                                                       |
 7|              in elementary school reading for teachers of             |
  |                                                                       |
 8|              kindergarten through third grade, instructional          |
  |                                                                       |
 9|              leaders, and principals,                                 |
  |                                                                       |
10|         b.    a three-day follow-up professional development          |
  |                                                                       |
11|              institute in elementary school reading for teachers of   |
  |                                                                       |
12|              kindergarten through third grade and instructional       |
  |                                                                       |
13|              leaders, and                                             |
  |                                                                       |
14|         c.    continued support through ongoing teacher development   |
  |                                                                       |
15|              at school sites, including four (4) days of              |
  |                                                                       |
16|              professional development for principals and literacy     |
  |                                                                       |
17|              resource specialists, and six (6) days of on-site        |
  |                                                                       |
18|              visits by a program consultant.                          |
  |                                                                       |
19|    2.  In order to qualify for a grant pursuant to this subsection,   |
  |                                                                       |
20|the following requirements shall be met:                               |
  |                                                                       |
21|         a.    at least eighty percent (80%) of the teachers of        |
  |                                                                       |
22|              kindergarten through third grade at the school shall     |
  |                                                                       |
23|              have demonstrated support for the training program       |
  |                                                                       |
24|              provided pursuant to this subsection,                    |
  |                                                                       |

 1|         b.    the principal shall ensure that all members of the      |
  |                                                                       |
 2|              leadership team and all teachers of kindergarten         |
  |                                                                       |
 3|              through third grade will participate in all phases of    |
  |                                                                       |
 4|              the training program,                                    |
  |                                                                       |
 5|         c.    the school district shall ensure that any new teacher   |
  |                                                                       |
 6|              of kindergarten through third grade or principal at      |
  |                                                                       |
 7|              the school will participate in all phases of the         |
  |                                                                       |
 8|              training program, and                                    |
  |                                                                       |
 9|         d.    the school district shall employ a literacy resource    |
  |                                                                       |
10|              specialist for at least two (2) years after completion   |
  |                                                                       |
11|              of the training provided in this subsection.  One or     |
  |                                                                       |
12|              more districts may share a literacy resource             |
  |                                                                       |
13|              specialist upon approval of the Board.                   |
  |                                                                       |
14|    3.  Any school which has been determined by the State Board of     |
  |                                                                       |
15|Education to be a school in need of improvement shall be given         |
  |                                                                       |
16|priority for receipt of a grant.  Grants to local school districts     |
  |                                                                       |
17|may be awarded based on the amount of funds allocated to the State     |
  |                                                                       |
18|Board of Education for the purposes of this section.  Funds may be     |
  |                                                                       |
19|used for payment for substitute teachers, program consultants,         |
  |                                                                       |
20|on-site facilitation, and literacy resource specialists.               |
  |                                                                       |
21|    4.  For program evaluation purposes, each school awarded a grant   |
  |                                                                       |
22|pursuant to this subsection shall provide to the Commission Board      |
  |                                                                       |
23|student-level data and results of the reading assessments              |
  |                                                                       |
24|administered pursuant to the Oklahoma School Testing Program Act for   |
  |                                                                       |

 1|the year prior to the grant award, for each year a grant is received   |
  |                                                                       |
 2|by the school, and for three (3) years after completion of the         |
  |                                                                       |
 3|program.  If funds are not sufficient to award grants to all           |
  |                                                                       |
 4|eligible applicants, schools may be placed on a waiting list for       |
  |                                                                       |
 5|priority consideration for the following year's round of grant         |
  |                                                                       |
 6|awards which shall be superior to the priority given to schools as     |
  |                                                                       |
 7|provided in paragraph 3 of this subsection, if the school provides     |
  |                                                                       |
 8|student data for the current year to the Board as provided in this     |
  |                                                                       |
 9|paragraph.                                                             |
  |                                                                       |
10|    5.  The professional development institutes in elementary          |
  |                                                                       |
11|reading provided pursuant to this section shall incorporate the        |
  |                                                                       |
12|requirements of the Reading Sufficiency Act.                           |
  |                                                                       |
13|    E.  As additional funds become available for such purpose, the     |
  |                                                                       |
14|Board shall develop and offer professional development institutes      |
  |                                                                       |
15|in:                                                                    |
  |                                                                       |
16|    1.  Mathematics for teachers in grades kindergarten through        |
  |                                                                       |
17|nine;                                                                  |
  |                                                                       |
18|    2.  The use of technology in the classroom;                        |
  |                                                                       |
19|    3.  Training of residency committee members in teacher             |
  |                                                                       |
20|mentoring; and                                                         |
  |                                                                       |
21|    4.  Hands-on inquiry-based science for elementary teachers.        |
  |                                                                       |
22|    SECTION 20.     AMENDATORY     70 O.S. 2011, Section 6-204.1, as   |
  |                                                                       |
23|amended by Section 1, Chapter 394, O.S.L. 2013 (70 O.S. Supp. 2018,    |
  |                                                                       |
24|Section 6-204.1), is amended to read as follows:                       |

  |                                                                       |
12|    4.  "Commission" means the Oklahoma Commission for Teacher         |
  |                                                                       |
13|Preparation Educational Quality and Accountability until June 30,      |
  |                                                                       |
14|2020;                                                                  |
  |                                                                       |
15|    5.  "Board" means the State Board of Education;                    |
  |                                                                       |
16|    6.  "National Board" means the National Board for Professional     |
  |                                                                       |
17|Teaching Standards;                                                    |
  |                                                                       |
18|    6. 7.  "National Board certification" means National Board         |
  |                                                                       |
19|certification as provided by the National Board for Professional       |
  |                                                                       |
20|Teaching Standards; and                                                |
  |                                                                       |
21|    7. 8.  "Teacher" means a classroom teacher, counselor, or          |
  |                                                                       |
22|librarian employed by a public school district on a full-time basis.   |

13|National Board certification and the Education Leadership Oklahoma     |
  |                                                                       |
14|program services;                                                      |
  |                                                                       |
15|    2.  Provide technical assistance and National-Board-certified      |
  |                                                                       |
16|mentors to all teachers seeking National Board certification upon      |
  |                                                                       |
17|request;                                                               |
  |                                                                       |
18|    3.  Reward teachers who are seeking National Board certification   |
  |                                                                       |
19|by awarding them a portion of the application processing charge and    |
  |                                                                       |
20|assessment fee and scholarship as provided in subsection D of this     |
  |                                                                       |
21|section; and                                                           |
  |                                                                       |
22|    4.  Provide recognition to National-Board-certified teachers.      |
  |                                                                       |
23|    C.  To fulfill the objectives of the Education Leadership          |
  |                                                                       |
24|Oklahoma Act, until June 30, 2020, the Oklahoma Commission for         |
  |                                                                       |

 1|Teacher Preparation Educational Quality and Accountability and         |
  |                                                                       |
 2|beginning July 1, 2020, the State Board of Education shall:            |
  |                                                                       |
 3|    1.  Inform teachers of the Education Leadership Oklahoma program   |
  |                                                                       |
 4|and services it provides to teachers seeking National Board            |
  |                                                                       |
 5|certification, emphasizing recruiting efforts toward teachers at       |
  |                                                                       |
 6|high-poverty schools, schools identified as in need of improvement     |
  |                                                                       |
 7|and in counties with the lowest percentage of teachers who have        |
  |                                                                       |
 8|achieved National Board certification; and                             |
  |                                                                       |
 9|    2.  Ensure that all teachers seeking National Board                |
  |                                                                       |
10|certification receive adequate information regarding the level of      |
  |                                                                       |
11|commitment required to acquire National Board certification.           |
  |                                                                       |
12|    D.  The Until June 30, 2020, the Commission and beginning July     |
  |                                                                       |
13|1, 2020, the Board shall select not more than one hundred applicants   |
  |                                                                       |
14|to participate in the program each fiscal year for whom the            |
  |                                                                       |
15|Commission until June 30, 2020, and beginning July 1, 2020, for whom   |
  |                                                                       |
16|the Board shall pay one-half (1/2) of the application processing       |
  |                                                                       |
17|charge and assessment fee for National Board certification.  The       |
  |                                                                       |
18|total amount paid until June 30, 2020, by the Commission and           |
  |                                                                       |
19|beginning July 1, 2020, by the Board shall not exceed One Thousand     |
  |                                                                       |
20|Three Hundred Dollars ($1,300.00).  In addition, until June 30,        |
  |                                                                       |
21|2020, the Commission and beginning July 1, 2020, the Board shall       |
  |                                                                       |
22|also provide to the selected applicants a scholarship in the amount    |
  |                                                                       |
23|of Five Hundred Dollars ($500.00) to cover other expenses associated   |
  |                                                                       |
24|with obtaining National Board certification.                           |
  |                                                                       |

 1|    E.  The Until June 30, 2020, the Commission and beginning July     |
  |                                                                       |
 2|1, 2020, the Board shall promulgate rules establishing a process for   |
  |                                                                       |
 3|accepting applications for the Education Leadership Oklahoma program   |
  |                                                                       |
 4|and for providing to applicants selected for the program up-front      |
  |                                                                       |
 5|payment of the application processing charge and assessment fee and    |
  |                                                                       |
 6|scholarship.  If a selected applicant who receives the up-front        |
  |                                                                       |
 7|payment does not complete National Board certification within three    |
  |                                                                       |
 8|(3) years, the applicant shall repay the Commission until June 30,     |
  |                                                                       |
 9|2020, and beginning July 1, 2020, shall repay the Board the full       |
  |                                                                       |
10|amount paid until June 30, 2020, by the Commission and beginning       |
  |                                                                       |
11|July 1, 2020, by the Board pursuant to subsection D of this section.   |
  |                                                                       |
12| All selected applicants who do not receive an up-front payment and    |
  |                                                                       |
13|successfully complete National Board certification shall be            |
  |                                                                       |
14|reimbursed until June 30, 2020, by the Commission and beginning July   |
  |                                                                       |
15|1, 2020, by the Board for the application processing charge and        |
  |                                                                       |
16|assessment fee.  The total amount of reimbursement paid until June     |
  |                                                                       |
17|30, 2020, by the Commission and beginning July 1, 2020, by the Board   |
  |                                                                       |
18|shall not exceed One Thousand Three Hundred Dollars ($1,300.00).       |
  |                                                                       |
19|    F.  It is the intent of the Legislature that until June 30,        |
  |                                                                       |
20|2020, the Oklahoma Commission for Teacher Preparation and beginning    |
  |                                                                       |
21|July 1, 2020, the Board contract with Southeastern Oklahoma State      |
  |                                                                       |
22|University to establish Education Leadership Oklahoma program          |
  |                                                                       |
23|training in higher education teacher preparation programs in the       |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|state to assist teachers in meeting the requirements to obtain         |
  |                                                                       |
 2|National Board certification.                                          |
  |                                                                       |
 3|    G.  All teachers seeking National Board certification shall be     |
  |                                                                       |
 4|eligible to participate in Education Leadership Oklahoma program       |
  |                                                                       |
 5|training to assist them in meeting the requirements of the National    |
  |                                                                       |
 6|Board certification process, free of charge.                           |
  |                                                                       |
 7|    H.  Subject to district board of education policy or collective    |
  |                                                                       |
 8|bargaining agreement, additional professional leave days may be        |
  |                                                                       |
 9|granted to teachers seeking National Board certification for           |
  |                                                                       |
10|National Board certification portfolio development.  During the two    |
  |                                                                       |
11|(2) days of the additional professional days granted to teachers for   |
  |                                                                       |
12|National Board certification portfolio development, a substitute       |
  |                                                                       |
13|teacher shall be provided by the school district at no cost to the     |
  |                                                                       |
14|teacher.                                                               |
  |                                                                       |
15|    I.  1.  The State Board of Education shall provide to teachers     |
  |                                                                       |
16|who attained National Board certification prior to June 30, 2013, a    |
  |                                                                       |
17|bonus in the amount of Five Thousand Dollars ($5,000.00) annually      |
  |                                                                       |
18|over a ten-year period, to be paid no later than January 31 each       |
  |                                                                       |
19|year.  The Board shall provide a bonus to any teacher who attains      |
  |                                                                       |
20|National Board certification after June 30, 2013, if the teacher was   |
  |                                                                       |
21|selected for the Education Leadership Oklahoma program before June     |
  |                                                                       |
22|30, 2013, or the teacher has submitted an application for National     |
  |                                                                       |
23|Board certification to the National Board for Professional Teaching    |
  |                                                                       |
24|Standards before June 30, 2013.                                        |
  |                                                                       |

 1|    2.  The teachers eligible to receive the annual bonus as           |
  |                                                                       |
 2|provided for in paragraph 1 of this subsection shall receive the       |
  |                                                                       |
 3|annual bonus for the ten-year duration of their National Board         |
  |                                                                       |
 4|certification and so long as they are teaching in the classroom        |
  |                                                                       |
 5|full-time in an Oklahoma public school.  No school or school           |
  |                                                                       |
 6|district shall be liable for payment of bonuses pursuant to this       |
  |                                                                       |
 7|section.                                                               |
  |                                                                       |
 8|    3.  The bonus shall not be included in the calculation of the      |
  |                                                                       |
 9|teacher's salary for purposes of meeting the district or statutory     |
  |                                                                       |
10|minimum salary schedule or for purposes of compensating Oklahoma       |
  |                                                                       |
11|Teachers' Retirement System contributions or benefits.                 |
  |                                                                       |
12|    4.  Teachers eligible to receive the annual bonus as provided      |
  |                                                                       |
13|for in paragraph 1 of this subsection shall not be eligible to         |
  |                                                                       |
14|receive the additional salary increment for National Board             |
  |                                                                       |
15|certification as set forth in the minimum salary schedule in Section   |
  |                                                                       |
16|3 of this act 18-114.14 of this title.                                 |
  |                                                                       |
17|    5.  Teachers who attain National Board certification after June    |
  |                                                                       |
18|30, 2013, shall be eligible to receive the additional salary           |
  |                                                                       |
19|increments for National Board certification as set forth in the        |
  |                                                                       |
20|minimum salary schedule in Section 3 of this act 18-114.14 of this     |
  |                                                                       |
21|title.                                                                 |
  |                                                                       |
22|    6.  The State Board of Education shall promulgate rules for a      |
  |                                                                       |
23|process by which a National-Board-certified teacher will verify        |
  |                                                                       |
24|that:                                                                  |
  |                                                                       |

 1|         a.    the National Board certification has not lapsed,        |
  |                                                                       |
 2|         b.    the teacher is still a full-time teacher, and           |
  |                                                                       |
 3|         c.    for teachers eligible for the bonus, the teacher has    |
  |                                                                       |
 4|              not exceeded the limit of annual bonus payments as       |
  |                                                                       |
 5|              provided for in paragraph 1 of this subsection.          |
  |                                                                       |
 6|    J.  It is the intent of the Legislature that the Oklahoma State    |
  |                                                                       |
 7|Regents for Higher Education incorporate the National Board            |
  |                                                                       |
 8|certification portfolio development into all programs in education     |
  |                                                                       |
 9|leading to a master's level degree.                                    |
  |                                                                       |
10|    SECTION 22.     AMENDATORY     70 O.S. 2011, Section 6-204.3, as   |
  |                                                                       |
11|amended by Section 600, Chapter 304, O.S.L. 2012 (70 O.S. Supp.        |
  |                                                                       |
12|2018, Section 6-204.3), is amended to read as follows:                 |
  |                                                                       |
13|    Section 6-204.3.  There is hereby created in the State Treasury    |
  |                                                                       |
14|a revolving fund until June 30, 2020, for the Oklahoma Commission      |
  |                                                                       |
15|for Teacher Preparation Educational Quality and Accountability and     |
  |                                                                       |
16|beginning July 1, 2020, for the State Board of Education to be         |
  |                                                                       |
17|designated the "Education Leadership Oklahoma Revolving Fund".  The    |
  |                                                                       |
18|fund shall be a continuing fund, not subject to fiscal year            |
  |                                                                       |
19|limitations, and shall consist of all monies appropriated or           |
  |                                                                       |
20|transferred to the fund by the Legislature.  All monies accruing to    |
  |                                                                       |
21|the credit of the fund are hereby appropriated and may be budgeted     |
  |                                                                       |
22|and expended until June 30, 2020, by the Oklahoma Commission for       |
  |                                                                       |
23|Teacher Preparation Educational Quality and Accountability and         |
  |                                                                       |

  |                                                                       |
 5|Enterprise Services for approval and payment.                          |
  |                                                                       |
 6|    SECTION 23.     AMENDATORY     70 O.S. 2011, Section 6-204.5, as   |
  |                                                                       |
 7|amended by Section 602, Chapter 304, O.S.L. 2012 (70 O.S. Supp.        |
  |                                                                       |
 8|2018, Section 6-204.5), is amended to read as follows:                 |
  |                                                                       |
 9|    Section 6-204.5.  There is hereby created in the State Treasury    |
  |                                                                       |
10|a revolving fund until June 30, 2020, for the Oklahoma Commission      |
  |                                                                       |
11|for Teacher Preparation Educational Quality and Accountability and     |
  |                                                                       |
12|beginning July 1, 2020, for the State Board of Education to be         |
  |                                                                       |
13|designated the "Professional Development Institutes Revolving Fund".   |
  |                                                                       |
14| The fund shall be a continuing fund, not subject to fiscal year       |
  |                                                                       |
15|limitations, and shall consist of all monies appropriated or           |
  |                                                                       |
16|transferred to the fund by the Legislature.  All monies accruing to    |
  |                                                                       |
17|the credit of the fund are hereby appropriated and may be budgeted     |
  |                                                                       |
18|and expended until June 30, 2020, by the Oklahoma Commission for       |
  |                                                                       |
19|Teacher Preparation Educational Quality and Accountability and         |
  |                                                                       |
20|beginning July 1, 2020, by the State Board of Education to develop     |
  |                                                                       |
21|and administer professional development programs for teachers and      |
  |                                                                       |
22|administrators and training for residency committee members.           |
  |                                                                       |
23|Expenditures shall be made upon warrants issued by the State           |
  |                                                                       |
24|Treasurer against claims filed as prescribed by law with the           |
  |                                                                       |

 3|    SECTION 24.     AMENDATORY     70 O.S. 2011, Section 6-207, as     |
  |                                                                       |
 4|amended by Section 1, Chapter 430, O.S.L. 2014 (70 O.S. Supp. 2018,    |
  |                                                                       |
 5|Section 6-207), is amended to read as follows:                         |
  |                                                                       |
 6|    Section 6-207.  A.  The State Board of Education shall establish   |
  |                                                                       |
 7|the Oklahoma Mathematics Improvement Program.  The purpose of the      |
  |                                                                       |
 8|program is to improve student mastery of the subject matter            |
  |                                                                       |
 9|standards adopted by the State Board of Education for sixth-grade      |
  |                                                                       |
10|mathematics through Algebra I by enhancing sixth-, seventh- and        |
  |                                                                       |
11|eighth-grade public school teachers' mastery of the subject matter     |
  |                                                                       |
12|content and process skills.                                            |
  |                                                                       |
13|    B.  For purposes of this section, "middle-level mathematics"       |
  |                                                                       |
14|means the subject matter standards for sixth- through eighth-grade     |
  |                                                                       |
15|mathematics and Algebra I.                                             |
  |                                                                       |
16|    C.  Each sixth-, seventh-, or eighth-grade public school teacher   |
  |                                                                       |
17|of a middle-level mathematics course who completes a professional      |
  |                                                                       |
18|development program approved by the State Board of Education, as       |
  |                                                                       |
19|authorized in subsection E of this section, shall receive a stipend    |
  |                                                                       |
20|in the amount of One Thousand Dollars ($1,000.00) if, prior or         |
  |                                                                       |
21|subsequent to completion of the professional development program,      |
  |                                                                       |
22|the teacher successfully completes the middle-level/intermediate       |
  |                                                                       |
23|mathematics Oklahoma Subject Area Test administered until June 30,     |
  |                                                                       |
24|2020, by the Oklahoma Commission for Teacher Preparation Educational   |
  |                                                                       |

 1|Quality and Accountability and beginning July 1, 2020, by the State    |
  |                                                                       |
 2|Board of Education.  The State Board of Education shall provide the    |
  |                                                                       |
 3|stipend to qualifying teachers who meet the requirements of this       |
  |                                                                       |
 4|section.  The stipend shall not be included in the calculation of      |
  |                                                                       |
 5|the teacher's salary for purposes of meeting the district or           |
  |                                                                       |
 6|statutory minimum salary schedule or for purposes of calculating       |
  |                                                                       |
 7|Teachers' Retirement System of Oklahoma contributions or benefits.     |
  |                                                                       |
 8|    D.  The State Department of Education shall issue a request for    |
  |                                                                       |
 9|proposals on or before October 1, 2005, seeking applications for the   |
  |                                                                       |
10|Oklahoma Mathematics Improvement Program.  The State Department of     |
  |                                                                       |
11|Education shall review the applications for compliance with the        |
  |                                                                       |
12|established requirements.                                              |
  |                                                                       |
13|    E.  The State Board of Education may approve programs that meet    |
  |                                                                       |
14|the requirements set forth in this subsection.  Each participating     |
  |                                                                       |
15|teacher shall take a preassessment to establish current subject        |
  |                                                                       |
16|matter knowledge, and, based on the results of the preassessment,      |
  |                                                                       |
17|the teacher will participate in one of the three programs listed       |
  |                                                                       |
18|below:                                                                 |
  |                                                                       |
19|    1.  Mathematics academies consisting of a minimum of forty (40)    |
  |                                                                       |
20|contact hours of training and twenty (20) contact hours of follow-up   |
  |                                                                       |
21|training through lesson study with identified mathematics              |
  |                                                                       |
22|specialists on-site and through video technology.                      |
  |                                                                       |
23|    The mathematics academies shall incorporate both content           |
  |                                                                       |
24|knowledge and process knowledge that shall be modeled for teachers     |
  |                                                                       |

 1|in the areas of problem-solving, reasoning, and critical thinking as   |
  |                                                                       |
 2|applied to the mathematical concepts in the subject matter             |
  |                                                                       |
 3|standards.  The ultimate goal of the mathematics academies shall be    |
  |                                                                       |
 4|to significantly increase the number of children becoming proficient   |
  |                                                                       |
 5|in mathematics as demonstrated on assessments administered pursuant    |
  |                                                                       |
 6|to the Oklahoma School Testing Program Act.  The mathematics           |
  |                                                                       |
 7|academies shall be accepted for professional development purposes      |
  |                                                                       |
 8|and shall be defined as continuing education experiences that          |
  |                                                                       |
 9|consist of a minimum of forty (40) clock hours.  The mathematics       |
  |                                                                       |
10|academies shall be designed to provide instruction that includes       |
  |                                                                       |
11|peer coaching;                                                         |
  |                                                                       |
12|    2.  Other programs including customized higher education courses   |
  |                                                                       |
13|and/or on-line courses similar in scope and nature to those            |
  |                                                                       |
14|described in this subsection designed to improve middle school         |
  |                                                                       |
15|mathematics knowledge including Algebra I, as approved by the State    |
  |                                                                       |
16|Board of Education; and                                                |
  |                                                                       |
17|    3.  Small learning community lesson studies facilitated by a       |
  |                                                                       |
18|mathematics coach and utilizing the Internet and video technology,     |
  |                                                                       |
19|as approved by the State Board of Education.                           |
  |                                                                       |
20|    F.  On or before December 15, 2005, the State Department of        |
  |                                                                       |
21|Education shall forward applications that the Department has           |
  |                                                                       |
22|determined meet the requirements of this section to the State Board    |
  |                                                                       |
23|of Education.  On or before February 1, 2006, the Board shall award,   |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|through a competitive bid process, one or more grants for              |
  |                                                                       |
 2|professional development programs approved by the Department.          |
  |                                                                       |
 3|    G.  The State Board of Education shall contract for independent    |
  |                                                                       |
 4|evaluations of programs funded pursuant to this section.               |
  |                                                                       |
 5|    H.  Beginning June 30, 2006, and each year thereafter for which    |
  |                                                                       |
 6|the Oklahoma Mathematics Improvement Program is funded, the State      |
  |                                                                       |
 7|Board of Education shall prepare and submit a report to the            |
  |                                                                       |
 8|Legislature and the Governor containing:                               |
  |                                                                       |
 9|    1.  Descriptions of professional development programs approved     |
  |                                                                       |
10|and funded through the Oklahoma Mathematics Improvement Program;       |
  |                                                                       |
11|    2.  Number and amount of grants awarded;                           |
  |                                                                       |
12|    3.  Number of teachers completing approved programs;               |
  |                                                                       |
13|    4.  Number of teachers successfully completing the Oklahoma        |
  |                                                                       |
14|Subject Area Test for middle level/intermediate mathematics after      |
  |                                                                       |
15|completion of a program created pursuant to this section;              |
  |                                                                       |
16|    5.  Amount of stipends paid to teachers pursuant to this           |
  |                                                                       |
17|section; and                                                           |
  |                                                                       |
18|    6.  Student achievement data for students in classes taught by     |
  |                                                                       |
19|teachers completing one of the program options authorized pursuant     |
  |                                                                       |
20|to this section.                                                       |
  |                                                                       |
21|    SECTION 25.     AMENDATORY     70 O.S. 2011, Section 6-210, as     |
  |                                                                       |
22|last amended by Section 23, Chapter 124, O.S.L. 2014 (70 O.S. Supp.    |
  |                                                                       |
23|2018, Section 6-210), is amended to read as follows:                   |

 1|    Section 6-210.  A.  The Oklahoma Until June 30, 2020, the          |
  |                                                                       |
 2|Commission for Teacher Preparation Educational Quality and             |
  |                                                                       |
 3|Accountability and beginning July 1, 2020, the State Board of          |
  |                                                                       |
 4|Education is authorized to establish the Inner City Schools Rescue     |
  |                                                                       |
 5|program.  The purpose of the program shall be to recruit and train     |
  |                                                                       |
 6|certified teachers to work in inner city schools and to provide        |
  |                                                                       |
 7|technical assistance and support to those teachers who participate     |
  |                                                                       |
 8|in the program and become employed in an inner city school.            |
  |                                                                       |
 9|    B.  For purposes of this section, an inner city school shall       |
  |                                                                       |
10|mean a school identified as in need of improvement as determined by    |
  |                                                                       |
11|the Commission Board pursuant to the No Child Left Behind Act          |
  |                                                                       |
12|Elementary and Secondary Education Act of 1965 (ESEA) as               |
  |                                                                       |
13|reauthorized and amended by P.L. No. 114-95, also known as the Every   |
  |                                                                       |
14|Student Succeeds Act (ESSA) or where ninety-five percent (95%) or      |
  |                                                                       |
15|more of the students enrolled in the school qualify for the free and   |
  |                                                                       |
16|reduced lunch program.                                                 |
  |                                                                       |
17|    C.  To fulfill the objectives of the Inner City Schools Rescue     |
  |                                                                       |
18|program until June 30, 2020, the Commission and beginning July 1,      |
  |                                                                       |
19|2020, the Board shall:                                                 |
  |                                                                       |
20|    1.  Inform teachers of the program;                                |
  |                                                                       |
21|    2.  Collect and review applications for the program from           |
  |                                                                       |
22|interested teachers; and                                               |
  |                                                                       |
23|    3.  Establish an applicant review committee to identify            |
  |                                                                       |
24|participants for the program.                                          |

 1|    D.  Each year the Commission until June 30, 2020, and beginning    |
  |                                                                       |
 2|July 1, 2020, the Board shall select a certain number of teachers,     |
  |                                                                       |
 3|as determined until June 30, 2020, by the Commission and beginning     |
  |                                                                       |
 4|July 1, 2020, by the Board, who have demonstrated a commitment to      |
  |                                                                       |
 5|excellence in teaching and to working with at-risk students in the     |
  |                                                                       |
 6|inner city.                                                            |
  |                                                                       |
 7|    E.  The Until June 30, 2020, the Commission and beginning July     |
  |                                                                       |
 8|1, 2020, the Board shall promulgate rules to implement the             |
  |                                                                       |
 9|provisions of this section.                                            |
  |                                                                       |
10|    SECTION 26.     AMENDATORY     Section 27, Chapter 124, O.S.L.     |
  |                                                                       |
11|2014 (70 O.S. Supp. 2018, Section 6-211), is amended to read as        |
  |                                                                       |
12|follows:                                                               |
  |                                                                       |
13|    Section 6-211.  The State Board of Education in cooperation with   |
  |                                                                       |
14|the Commission for Educational Quality and Accountability until June   |
  |                                                                       |
15|30, 2020, the Oklahoma State Regents for Higher Education and          |
  |                                                                       |
16|institutions of higher education shall conduct an educator             |
  |                                                                       |
17|supply-and-demand study every three (3) years.  The study shall        |
  |                                                                       |
18|identify areas of teacher shortage and make recommendations for        |
  |                                                                       |
19|addressing the areas of most critical need.  The Board shall submit    |
  |                                                                       |
20|a report outlining the findings to the Governor, the Speaker of the    |
  |                                                                       |
21|House of Representatives and the President Pro Tempore of the          |
  |                                                                       |
22|Senate.                                                                |

 1|    SECTION 27.     AMENDATORY     70 O.S. 2011, Section 1210.508,     |
  |                                                                       |
 2|as last amended by Section 2, Chapter 67, O.S.L. 2018 (70 O.S. Supp.   |

 3|2018, Section 1210.508), is amended to read as follows:                |
  |                                                                       |
 4|    Section 1210.508.  A.  1.  By no later than December 31, 2016,     |
  |                                                                       |
 5|the State Board of Education shall adopt a statewide system of         |
  |                                                                       |
 6|student assessments in compliance with the Elementary and Secondary    |
  |                                                                       |
 7|Education Act of 1965 (ESEA), as reauthorized and amended by P.L.      |
  |                                                                       |
 8|No. 114-95, also known as the Every Student Succeeds Act (ESSA).       |
  |                                                                       |
 9|    2.  The statewide student assessment system adopted by the Board   |
  |                                                                       |
10|pursuant to this subsection shall be aligned with the Oklahoma         |
  |                                                                       |
11|Academic Standards as adopted by the Board and which prepare           |
  |                                                                       |
12|students for college and careers.                                      |
  |                                                                       |
13|    B.  1.  The Board shall issue a request for proposals for the      |
  |                                                                       |
14|selection of assessments to be administered to students in grades      |
  |                                                                       |
15|three through twelve as a part of the statewide student assessment     |
  |                                                                       |
16|system adopted by the Board pursuant to this section.                  |
  |                                                                       |
17|    2.  The Board shall adopt assessments from the selected            |
  |                                                                       |
18|proposals that were submitted pursuant to paragraph 1 of this          |
  |                                                                       |
19|subsection.  The adopted assessments shall be administered by the      |
  |                                                                       |
20|Board for a period that is in coordination with the six-year subject   |
  |                                                                       |
21|area textbook adoption cycle unless the vendor does not fulfill the    |
  |                                                                       |
22|terms of the contract or fails to comply with or violates the terms    |
  |                                                                       |
23|of the contract.  The Board shall administer the assessments           |
  |                                                                       |
24|beginning with the 2017-2018 school year.                              |
  |                                                                       |

 1|    C.  The statewide student assessment system adopted by the Board   |
  |                                                                       |
 2|pursuant to this section shall include assessments that:               |
  |                                                                       |
 3|    1.  Are aligned with the Oklahoma subject matter standards as      |
  |                                                                       |
 4|adopted by the Board;                                                  |
  |                                                                       |
 5|    2.  Provide a measure of comparability among other states;         |
  |                                                                       |
 6|    3.  Yield both norm-referenced scores and criterion-referenced     |
  |                                                                       |
 7|scores;                                                                |
  |                                                                       |
 8|    4.  Have a track record of statistical reliability and accuracy;   |
  |                                                                       |
 9|and                                                                    |
  |                                                                       |
10|    5.  For assessments administered in high school, provide a         |
  |                                                                       |
11|measure of future academic performance.                                |
  |                                                                       |
12|    D.  For the 2016-2017 school year, the Board shall administer      |
  |                                                                       |
13|assessments in:                                                        |
  |                                                                       |
14|    1.  English Language Arts or Reading and Mathematics in grades     |
  |                                                                       |
15|three through eight and at least once in high school, during the       |
  |                                                                       |
16|grade span of nine through twelve;                                     |
  |                                                                       |
17|    2.  Science not less than once during each grade span of three     |
  |                                                                       |
18|through five, six through nine and ten through twelve; and             |
  |                                                                       |
19|    3.  United States History not less than once during the grade      |
  |                                                                       |
20|span of nine through twelve.                                           |
  |                                                                       |
21|    E.  1.  Beginning with the 2017-2018 school year, the statewide    |
  |                                                                       |
22|student assessment system shall include assessments in:                |
  |                                                                       |
23|                                                                       |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|         a.    English Language Arts and Mathematics in grades three   |
  |                                                                       |
 2|              through eight and at least once in high school, during   |

  |                                                                       |
 5|              three through five, six through nine and ten through     |
  |                                                                       |
 6|              twelve, and                                              |
  |                                                                       |
 7|         c.    United States History, with an emphasis on civics,      |
  |                                                                       |
 8|              not less than once during the grade span of nine         |
  |                                                                       |
 9|              through twelve.                                          |
  |                                                                       |
10|    2.  Beginning with the 2017-2018 school year, the statewide        |
  |                                                                       |
11|student assessment system may include:                                 |
  |                                                                       |
12|         a.    assessments in Reading and Writing in certain grades    |
  |                                                                       |
13|              as determined by the Board, and                          |
  |                                                                       |
14|         b.    contingent upon the availability of funds, an           |
  |                                                                       |
15|              additional nationally recognized college- and            |
  |                                                                       |
16|              career-readiness assessment or assessments as            |
  |                                                                       |
17|              recommended by the State Department of Education which   |
  |                                                                       |
18|              will be administered to students in high school at no    |
  |                                                                       |
19|              cost to the student.                                     |
  |                                                                       |
20|    F.  1.  Beginning with students entering the ninth grade in the    |
  |                                                                       |
21|2017-2018 school year, each student shall take the assessment or       |
  |                                                                       |
22|assessments included in the statewide student assessment system        |
  |                                                                       |
23|adopted by the Board pursuant to subsection A of this section in       |
  |                                                                       |
24|order to graduate from a public high school with a standard diploma.   |
  |                                                                       |

 1| All students shall take the assessment or assessments prior to        |
  |                                                                       |
 2|graduation, unless otherwise exempt by law.                            |
  |                                                                       |
 3|    2.  Beginning with students entering the ninth grade in the        |
  |                                                                       |
 4|2017-2018 school year, each student, in addition to taking the         |
  |                                                                       |
 5|assessment or assessments included in the statewide student            |
  |                                                                       |
 6|assessment system adopted by the Board pursuant to subsection A of     |
  |                                                                       |
 7|this section, shall meet any other high school graduation              |
  |                                                                       |
 8|requirements adopted by the Board pursuant to Section 5 of Enrolled    |
  |                                                                       |
 9|House Bill No. 3218 of the 2nd Session of the 55th Oklahoma            |
  |                                                                       |
10|Legislature in order to graduate from a public high school with a      |
  |                                                                       |
11|standard diploma.                                                      |
  |                                                                       |
12|    3.  For students who start the ninth grade prior to or during      |
  |                                                                       |
13|the 2016-2017 school year, school districts shall adopt a plan that    |
  |                                                                       |
14|establishes the assessment or assessments those students are           |
  |                                                                       |
15|required to take in order to graduate from a public high school with   |
  |                                                                       |
16|a standard diploma.  The plan may also include any or all of the       |
  |                                                                       |
17|other high school graduation requirements adopted by the Board         |
  |                                                                       |
18|pursuant to Section 5 of Enrolled House Bill No. 3218 of the 2nd       |
  |                                                                       |
19|Session of the 55th Oklahoma Legislature that those students will be   |
  |                                                                       |
20|required to meet in order to graduate from a public high school with   |
  |                                                                       |
21|a standard diploma.                                                    |
  |                                                                       |
22|    4.  The Board shall promulgate rules to ensure that students who   |
  |                                                                       |
23|transfer into an Oklahoma school district from out-of-state after      |
  |                                                                       |
24|the junior year of high school shall not be denied the opportunity     |
  |                                                                       |

 1|to be awarded a standard diploma due to differing testing              |
  |                                                                       |
 2|requirements.                                                          |
  |                                                                       |
 3|    G.  In order to provide an indication of the levels of             |
  |                                                                       |
 4|competency attained by the student in a permanent record for           |
  |                                                                       |
 5|potential future employers and institutions of higher education,       |
  |                                                                       |
 6|school districts shall report on the high school transcript of the     |
  |                                                                       |
 7|student the highest-achieved score on the assessment or assessments    |
  |                                                                       |
 8|included in the statewide student assessment system adopted by the     |
  |                                                                       |
 9|Board pursuant to subsection A of this section and any business- and   |
  |                                                                       |
10|industry-recognized endorsements attained.                             |
  |                                                                       |
11|    H.  Students who do not perform at a proficiency level on          |
  |                                                                       |
12|assessments shall be remediated as established in the assessment       |
  |                                                                       |
13|requirements adopted by the Board pursuant to Section 5 of Enrolled    |
  |                                                                       |
14|House Bill No. 3218 of the 2nd Session of the 55th Oklahoma            |
  |                                                                       |
15|Legislature, subject to the availability of funding.                   |
  |                                                                       |
16|    I.  1.  All assessments required by this section shall measure     |
  |                                                                       |
17|academic competencies in correlation with the subject matter           |
  |                                                                       |
18|standards adopted by the Board pursuant to Sections 11-103.6 and       |
  |                                                                       |
19|11-103.6a of this title and referred to as the Oklahoma Academic       |
  |                                                                       |
20|Standards.  The State Board of Education shall evaluate the subject    |
  |                                                                       |
21|matter standards to ensure the competencies reflect high standards,    |
  |                                                                       |
22|are specific, well-defined, measurable, challenging, and will          |
  |                                                                       |
23|prepare elementary students for next-grade-level course work and       |
  |                                                                       |
24|secondary students for postsecondary studies at institutions of        |
  |                                                                       |

 1|higher education or technology center schools without the need for     |
  |                                                                       |
 2|remediation.  All subject matter standards shall reflect the goals     |
  |                                                                       |
 3|as set forth in Section 11-103.6 of this title and of improving the    |
  |                                                                       |
 4|state average ACT score.                                               |
  |                                                                       |
 5|    2.  The State Department of Education shall annually evaluate      |
  |                                                                       |
 6|the results of the assessments.  The State Board of Education shall    |
  |                                                                       |
 7|ensure that preliminary results for all statewide assessments are      |
  |                                                                       |
 8|reported to districts no later than June 1 of each year and are        |
  |                                                                       |
 9|presented in a manner that yields detailed, diagnostic information     |
  |                                                                       |
10|for the purpose of guiding instruction and student remediation.  As    |
  |                                                                       |
11|improvements are made to the assessments required by this section,     |
  |                                                                       |
12|the Board shall seek to increase the depth of knowledge assessed for   |
  |                                                                       |
13|each subject.  The State Board of Education shall seek to ensure       |
  |                                                                       |
14|that data yielded from the assessments required in this section are    |
  |                                                                       |
15|utilized at the school district level to inform instruction,           |
  |                                                                       |
16|professional development, school improvement and remediation for       |
  |                                                                       |

19|Quality and Accountability and beginning July 1, 2020, the State       |

20|Board of Education shall determine the cut scores for the              |
  |                                                                       |
21|performance levels on all statewide assessments.  The Until June 30,   |
  |                                                                       |
22|2020, the Commission and beginning July 1, 2020, the Board shall       |
  |                                                                       |
23|conduct an ongoing review to compare the statewide assessment          |
  |                                                                       |
24|content and performance descriptors with those of other states.        |

 1|Upon receipt of the review, until June 30, 2020, the Commission and    |
  |                                                                       |
 2|beginning July 1, 2020, the Board may adjust the cut scores as         |
  |                                                                       |
 3|necessary.                                                             |
  |                                                                       |
 4|    4.  The State Board of Education, for the purposes of conducting   |
  |                                                                       |
 5|reliability and validity studies, monitoring contractor adherence to   |
  |                                                                       |
 6|professionally accepted testing standards, and providing               |
  |                                                                       |
 7|recommendations for testing program improvement, shall retain the      |
  |                                                                       |
 8|services of an established, independent agency or organization that    |
  |                                                                       |
 9|is nationally recognized for its technical expertise in educational    |
  |                                                                       |
10|testing but is not engaged in the development of aptitude or           |
  |                                                                       |
11|achievement tests for elementary or secondary level grades.  These     |
  |                                                                       |
12|national assessment experts shall annually conduct studies of the      |
  |                                                                       |
13|reliability and validity of the statewide assessments administered     |
  |                                                                       |
14|pursuant to this section.  Validity studies shall include studies of   |
  |                                                                       |
15|decision validity and concurrent validity.                             |
  |                                                                       |
16|    J.  1.  The State Board of Education shall promulgate rules        |
  |                                                                       |
17|setting the assessment window dates for each statewide assessment so   |
  |                                                                       |
18|that the assessments are administered according to recommended         |
  |                                                                       |
19|testing protocols, and so that the assessment results are reported     |
  |                                                                       |
20|back to school districts in a timely manner.  The Prior to August 1    |
  |                                                                       |
21|of each year, the vendor shall provide a final electronic data file    |
  |                                                                       |
22|of all school site, school district, and state results to the State    |
  |                                                                       |
23|Department of Education and, until June 30, 2020, the Office of        |
  |                                                                       |
24|Educational Quality and Accountability prior to August 1 of each       |
  |                                                                       |

 1|year.  The Department shall forward the final data files for each      |
  |                                                                       |
 2|school district and each school site in that district to the school    |
  |                                                                       |
 3|district.  The Board shall ensure the contract with the vendor         |
  |                                                                       |
 4|includes a provision that the vendor report assessment results         |
  |                                                                       |
 5|directly to the Office of Educational Quality and Accountability       |
  |                                                                       |
 6|until June 30, 2020, at the same time it is reported to the Board.     |
  |                                                                       |
 7|    2.  State, district, and site level results of all assessments     |
  |                                                                       |
 8|required in this section shall be disaggregated by gender, race,       |
  |                                                                       |
 9|ethnicity, disability status, migrant status, English proficiency,     |
  |                                                                       |
10|and status as economically disadvantaged, except that such             |
  |                                                                       |
11|disaggregation shall not be required in a case in which the number     |
  |                                                                       |
12|of students in a category is insufficient to yield statistically       |
  |                                                                       |
13|reliable information or the results would reveal personally            |
  |                                                                       |
14|identifiable information about an individual student.  Each school     |
  |                                                                       |
15|site shall notify the student's parents of the school's performance    |
  |                                                                       |
16|levels in the Oklahoma School Testing Program as reported in the       |
  |                                                                       |
17|Oklahoma Educational Indicators Program at the end of each school      |
  |                                                                       |
18|year.                                                                  |
  |                                                                       |
19|    K.  The State Board of Education shall be responsible for the      |
  |                                                                       |
20|field-testing and validation of the statewide assessment system        |
  |                                                                       |
21|required in subsection A of this section.                              |
  |                                                                       |
22|    L.  The State Board of Education shall develop, administer, and    |
  |                                                                       |
23|incorporate as a part of the Oklahoma School Testing Program, other    |
  |                                                                       |
24|assessment programs or procedures, including appropriate               |
  |                                                                       |

 1|accommodations for the assessment of students with disabilities as     |
  |                                                                       |
 2|required by the Individuals with Disabilities Education Act (IDEA),    |
  |                                                                       |
 3|20 U.S.C., Section 1400 et seq.                                        |
  |                                                                       |
 4|    M.  For purposes of developing and administering alternate         |
  |                                                                       |
 5|assessments for students with the most significant cognitive           |
  |                                                                       |
 6|disabilities, the State Board of Education shall not be subject to     |
  |                                                                       |
 7|subsections D and E of Section 11-103.6a of this title.                |
  |                                                                       |
 8|    SECTION 28.     AMENDATORY     70 O.S. 2011, Section 1210.541,     |
  |                                                                       |
 9|as last amended by Section 1, Chapter 200, O.S.L. 2018 (70 O.S.        |
  |                                                                       |
10|Supp. 2018, Section 1210.541), is amended to read as follows:          |
  |                                                                       |
11|    Section 1210.541.  A.  The Until June 30, 2020, the Commission     |
  |                                                                       |
12|for Educational Quality and Accountability and beginning July 1,       |
  |                                                                       |
13|2020, the State Board of Education shall determine and adopt a         |
  |                                                                       |
14|series of student performance levels and the corresponding cut         |
  |                                                                       |
15|scores pursuant to the Oklahoma School Testing Program Act.            |
  |                                                                       |
16|    B.  The Until June 30, 2020, the Commission for Educational        |
  |                                                                       |
17|Quality and Accountability and beginning July 1, 2020, the State       |
  |                                                                       |
18|Board of Education shall have the authority to set cut scores using    |
  |                                                                       |
19|any method which the State Board of Education was authorized to use    |
  |                                                                       |
20|in setting cut scores prior to July 1, 2013.                           |
  |                                                                       |
21|    C.  The performance levels shall be set by a method that           |
  |                                                                       |
22|indicates students are ready for the next grade, course, or level of   |
  |                                                                       |
23|education, as applicable.  The Until June 30, 2020, the Commission     |
  |                                                                       |
24|for Educational Quality and Accountability and beginning July 1,       |
  |                                                                       |

 1|2020, the Board shall establish panels to review and revise the        |
  |                                                                       |
 2|performance level descriptors for each subject and grade level.  The   |
  |                                                                       |
 3|Until June 30, 2020, the Commission and beginning July 1, 2020, the    |
  |                                                                       |
 4|Board shall ensure that the assessments developed and administered     |
  |                                                                       |
 5|by the State Board of Education pursuant to the Oklahoma School        |
  |                                                                       |
 6|Testing Program Act in grades three through eight and at the           |
  |                                                                       |
 7|secondary level are vertically aligned by content across grade         |
  |                                                                       |
 8|levels to ensure consistency, continuity, alignment and clarity.       |
  |                                                                       |
 9|The Until June 30, 2020, the Commission and beginning July 1, 2020,    |
  |                                                                       |
10|the Board shall adopt performance levels that are labeled and          |
  |                                                                       |
11|defined as follows:                                                    |
  |                                                                       |
12|    1.  Advanced, which shall indicate that students demonstrate       |
  |                                                                       |
13|superior performance on challenging subject matter;                    |
  |                                                                       |
14|    2.  Proficient, which shall indicate that students demonstrate     |
  |                                                                       |
15|mastery over challenging grade-level subject matter, can analyze and   |
  |                                                                       |
16|apply such knowledge to real-world situations, that students are       |
  |                                                                       |
17|ready for the next grade, course, or level of education and that       |
  |                                                                       |
18|students are on track to be ready for college or career;               |
  |                                                                       |
19|    3.  Basic, which shall indicate that students demonstrate          |
  |                                                                       |
20|partial mastery of the essential knowledge and skills that are         |
  |                                                                       |
21|foundational for proficient work at their grade level or course and    |
  |                                                                       |
22|that students are not on track to be ready for college or career;      |
  |                                                                       |
23|and                                                                    |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|    4.  Below basic, which shall indicate that students have not       |
  |                                                                       |
 2|performed at least at the basic level.                                 |
  |                                                                       |
 3|    D.  The State Board of Education shall develop and implement in    |
  |                                                                       |
 4|accordance with the Elementary and Secondary Education Act of 1965     |
  |                                                                       |
 5|(ESEA), as reauthorized and amended by P.L. No. 114-95, also known     |
  |                                                                       |
 6|as the Every Student Succeeds Act (ESSA), an accountability system     |
  |                                                                       |
 7|as provided for in 20 U.S.C., 6311 and any related federal             |
  |                                                                       |
 8|regulations.  The accountability system shall be implemented           |
  |                                                                       |
 9|beginning with the 2002-2003 school year and shall be based on the     |
  |                                                                       |
10|data as established pursuant to Section 1210.545 of this title and     |
  |                                                                       |
11|as modified to meet the mandates of the ESEA.  For the 2002-2003       |
  |                                                                       |
12|school year and every year thereafter the State Board of Education     |
  |                                                                       |
13|shall publish and ensure that each local education agency is           |
  |                                                                       |
14|provided with data annually by site so that the local education        |
  |                                                                       |
15|agency can make determinations to identify schools for rewards, and    |
  |                                                                       |
16|supports and interventions.  The State Board of Education shall        |
  |                                                                       |
17|establish a system of recognition, rewards, interventions and          |
  |                                                                       |
18|technical assistance, as required by state law and the Elementary      |
  |                                                                       |
19|and Secondary Education Act of 1965 (ESEA) as reauthorized and         |
  |                                                                       |
20|amended by P.L. No. 114-95, also known as the Every Student Succeeds   |
  |                                                                       |
21|Act (ESSA).                                                            |
  |                                                                       |
22|    E.  A school that is identified as in need of improvement by the   |
  |                                                                       |
23|State Board of Education pursuant to this section, because of          |
  |                                                                       |
24|failure to meet either an academic performance target or an            |
  |                                                                       |

 1|attendance or graduation performance target, or both, and is           |
  |                                                                       |
 2|identified as in need of improvement pursuant to the Elementary and    |
  |                                                                       |
 3|Secondary Education Act of 1965 (ESEA), as reauthorized and amended    |
  |                                                                       |
 4|by P.L. No. 114-95, also known as the Every Student Succeeds Act       |
  |                                                                       |
 5|(ESSA), shall utilize the assistance of a school support team or       |
  |                                                                       |
 6|other similar team formed by the State Department of Education to      |
  |                                                                       |
 7|provide support for schools in need of improvement, subject to         |
  |                                                                       |
 8|school support team capacity.  The school support team shall review    |
  |                                                                       |
 9|and analyze all facets of operation of the school including the        |
  |                                                                       |
10|design and operation of the instructional program.  The school         |
  |                                                                       |
11|support team shall assist the school in:                               |
  |                                                                       |
12|    1.  Incorporating strategies based on scientifically based         |
  |                                                                       |
13|research that will strengthen the core academic subjects in the        |
  |                                                                       |
14|school and address the specific academic issues that caused the        |
  |                                                                       |
15|school to be identified for school improvement;                        |
  |                                                                       |
16|    2.  Incorporating strategies to promote high quality               |
  |                                                                       |
17|professional development; and                                          |
  |                                                                       |
18|    3.  Training teachers to analyze classroom and school-level data   |
  |                                                                       |
19|and use the data to inform instruction.                                |
  |                                                                       |
20|    SECTION 29.     REPEALER     Sections 1, 2 and 3, Chapter 223,     |
  |                                                                       |
21|O.S.L. 2012 (70 O.S. Supp. 2018, Sections 3-116.2, 3-116.3 and         |
  |                                                                       |
22|3-116.4) and 70 O.S. 2011, Section 3-117, as amended by Section 5,     |
  |                                                                       |
23|Chapter 223, O.S.L. 2012 (70 O.S. Supp. 2018, Section 3-117), are      |
  |                                                                       |
24|hereby repealed.                                                       |

 1|    SECTION 30.     REPEALER     70 O.S. 2011, Section 3-118.1, as     |

  |                                                                       |
 6|Section 1210.531), is hereby repealed.                                 |
  |                                                                       |
 7|    SECTION 32.  Sections 1 through 28 of this act shall become        |
  |                                                                       |
 8|effective July 1, 2019.                                                |
  |                                                                       |
 9|    SECTION 33.  Sections 29 through 31 of this act shall become       |
  |                                                                       |
10|effective July 1, 2020.                                                |
  |                                                                       |
11|    SECTION 34.  It being immediately necessary for the preservation   |
  |                                                                       |
12|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
13|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
14|be in full force from and after its passage and approval.              |
  |                                                                       |
