  |       An Act relating to removal of officers; amending 22             |
11|       O.S. 2011, Section 1181, which relates to causes for            |
  |       removal of officers; specifying circumstances                   |
12|       constituting willful neglect of duty; making language           |
  |       gender neutral; and providing an effective date.                |

16|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
17|    SECTION 1.     AMENDATORY     22 O.S. 2011, Section 1181, is       |
  |                                                                       |
18|amended to read as follows:                                            |
  |                                                                       |
19|    Section 1181.  Any officer not subject to impeachment elected or   |
  |                                                                       |
20|appointed to any state, county, township, city, town, or other         |
  |                                                                       |
21|office under the laws of the state may, in the manner provided in      |
  |                                                                       |
22|this article, be removed from office for any of the following          |
  |                                                                       |
23|causes:                                                                |
  |                                                                       |

 1|    First.  Habitual or willful neglect of duty, which, for a state    |
  |                                                                       |
 2|officer, shall include, but not be limited to, knowingly giving        |
  |                                                                       |
 3|false testimony to a committee of either house of the Legislature,     |
  |                                                                       |
 4|knowingly engaging in operations beyond the constitutional or          |
  |                                                                       |
 5|statutory authority delegated to the agency that the officer is        |
  |                                                                       |
 6|employed by or serves, or repeatedly refusing to provide information   |
  |                                                                       |
 7|to a committee, either house or a member of the Legislature in a       |
  |                                                                       |
 8|timely manner.  For the purposes of this section, "timely manner"      |
  |                                                                       |
 9|means no more than fifteen (15) business days from the date the        |
  |                                                                       |
10|request for information was received by the agency, unless extended    |
  |                                                                       |
11|by written agreement.                                                  |
  |                                                                       |
12|    Second.  Gross partiality in office.                               |
  |                                                                       |
13|    Third.  Oppression in office.                                      |
  |                                                                       |
14|    Fourth.  Corruption in office.                                     |
  |                                                                       |
15|    Fifth.  Extortion or willful overcharge of fees in office.         |
  |                                                                       |
16|    Sixth.  Willful maladministration.                                 |
  |                                                                       |
17|    Seventh.  Habitual drunkenness.                                    |
  |                                                                       |
18|    Eighth.  Failure to produce and account for all public funds and   |
  |                                                                       |
19|property in his or her hands, at any settlement or inspection          |
  |                                                                       |
20|authorized or required by law.                                         |
  |                                                                       |
21|    SECTION 2.  This act shall become effective November 1, 2021.      |
  |                                                                       |
