 7|       An Act relating to schools; amending Section 1,                 |
  |       Chapter 333, O.S.L. 2014 (70 O.S. Supp. 2020, Section           |
 8|       24-100.7), which relates to suicide awareness and               |
  |       drug abuse policies; requiring rather than allowing             |
 9|       school district boards of education to adopt certain            |
  |       policy; requiring boards of education to provide                |
10|       certain staff training; directing certain curriculum            |
  |       be made available to staff; requiring school                    |
11|       districts to provide certain training and curriculum            |
  |       beginning in certain school year; allowing certain              |
12|       training of students in certain grades beginning in             |
  |       certain school year; providing an effective date; and           |
13|       declaring an emergency.                                         |

16|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
17|    SECTION 1.     AMENDATORY     Section 1, Chapter 333, O.S.L.       |
  |                                                                       |
18|2014 (70 O.S. Supp. 2020, Section 24-100.7), is amended to read as     |
  |                                                                       |
19|follows:                                                               |
  |                                                                       |
20|    Section 24-100.7.  A.  The board of education of each school       |
  |                                                                       |
21|district in this state may shall adopt a policy regarding suicide      |
  |                                                                       |
22|awareness and training, requiring staff training and the reporting     |
  |                                                                       |
23|of student drug abuse.                                                 |

 1|    B.  The board of education of each school district in this state   |
  |                                                                       |
 2|may shall provide schoolwide district-wide training to all students    |
  |                                                                       |
 3|in grades seven through twelve and staff on a biennial basis           |
  |                                                                       |
 4|addressing suicide awareness and prevention.  The Department of        |
  |                                                                       |
 5|Mental Health and Substance Abuse Services shall develop and make      |
  |                                                                       |
 6|available to school districts curriculum for staff which addresses     |
  |                                                                       |
 7|suicide awareness and prevention, without cost to the school           |
  |                                                                       |
 8|districts.  The course outline for the curriculum shall be made        |
  |                                                                       |
 9|available to the public online through the school district website.    |
  |                                                                       |
10|Beginning with the 2014-2015 2021-2022 school year, every school       |
  |                                                                       |
11|district may shall:                                                    |
  |                                                                       |
12|    1.  Provide a suicide prevention training program which includes   |
  |                                                                       |
13|as a core element research-based evidence-based approaches and that    |
  |                                                                       |
14|is developed by the school district;                                   |
  |                                                                       |
15|    2.  Provide the curriculum made available by the Department of     |
  |                                                                       |
16|Mental Health and Substance Abuse Services; or                         |
  |                                                                       |
17|    3.  Provide a suicide prevention training program that is          |
  |                                                                       |
18|selected by the school district from a list maintained by the          |
  |                                                                       |
19|Department of Mental Health and Substance Abuse Services to students   |
  |                                                                       |
20|and school district staff that addresses suicide awareness and         |
  |                                                                       |
21|prevention.  The training program may be combined with any other       |
  |                                                                       |
22|training provided by the school district addressing bullying           |
  |                                                                       |
23|prevention.                                                            |

 1|    C.  Beginning with the 2022-2023 school year, the board of         |
  |                                                                       |
 2|education of each school district may provide training to address      |
  |                                                                       |
 3|suicide awareness and prevention to students in grades seven through   |
  |                                                                       |
 4|twelve.                                                                |
  |                                                                       |
 5|    D.  Teachers, counselors, principals, administrators and other     |
  |                                                                       |
 6|school personnel shall be immune from employment discipline and any    |
  |                                                                       |
 7|civil liability for:                                                   |
  |                                                                       |
 8|    1.  Calling the 911 emergency telephone number, law enforcement    |
  |                                                                       |
 9|or the Department of Human Services if they believe a student poses    |
  |                                                                       |
10|a threat to themselves or others or if a student has committed or      |
  |                                                                       |
11|been the victim of a violent act or threat of a violent act;           |
  |                                                                       |
12|    2.  Providing referral, emergency medical care or other            |
  |                                                                       |
13|assistance offered in good faith to a student or other youth; or       |
  |                                                                       |
14|    3.  Communicating information in good faith concerning drug or     |
  |                                                                       |
15|alcohol abuse or a potential safety threat by or to any student to     |
  |                                                                       |
16|the parents or legal guardians of the student, law enforcement         |
  |                                                                       |
17|officers or health care providers.                                     |
  |                                                                       |
18|    D. E.  No person shall have a cause of action for any loss or      |
  |                                                                       |
19|damage caused by any act or omission resulting from the                |
  |                                                                       |
20|implementation of this section or resulting from any training, or      |
  |                                                                       |
21|lack thereof, required by this section, unless the loss or damage      |
  |                                                                       |
22|was caused by willful or wanton misconduct.                            |

 1|    E. F.  The training required pursuant to this section, or the      |
  |                                                                       |
 2|lack thereof, shall not be construed to impose any specific duty of    |
  |                                                                       |
 3|care.                                                                  |
  |                                                                       |
 4|    F.  School districts G.  The board of education of each school     |
  |                                                                       |
 5|district may enter into agreements with designated Youth Services      |
  |                                                                       |
 6|Agencies for the provision of intervention and prevention services.    |
  |                                                                       |
 7|    G. H.  Teachers, counselors, principals, administrators, or        |
  |                                                                       |
 8|other school personnel, upon determining that a student is at risk     |
  |                                                                       |
 9|of attempting suicide, shall notify the parents or legal guardians     |
  |                                                                       |
10|of the student immediately upon determining that such risk exists.     |
  |                                                                       |
11|    SECTION 2.  This act shall become effective July 1, 2021.          |
  |                                                                       |
12|    SECTION 3.  It being immediately necessary for the preservation    |
  |                                                                       |
13|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
14|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
15|be in full force from and after its passage and approval.              |
  |                                                                       |
