 9|       An Act relating to social media; requiring the                  |
  |       development of social networking and social media               |
10|       policy and standards; defining terms; stating that              |
  |       the guidelines shall apply to certain employees;                |
11|       requiring that each policy shall prohibit the sharing           |
  |       of certain content or comments; requiring                       |
12|       distribution to all affected employees; providing               |
  |       exemption from liability; providing for codification;           |
13|       and providing an effective date.                                |

16|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
17|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
18|in the Oklahoma Statutes as Section 840-8.1 of Title 74, unless        |
  |                                                                       |
19|there is created a duplication in numbering, reads as follows:         |
  |                                                                       |
20|    Social Networking and Social Media Policy and Standards            |
  |                                                                       |
21|    A.  All state agencies and all political subdivisions of this      |
  |                                                                       |
22|state, shall adopt a social networking and social media policy that    |
  |                                                                       |
23|shall apply to the use of social media by state employees and          |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|employees of any political subdivision of this state to discourage     |
  |                                                                       |
 2|abusive or offensive online behavior.                                  |
  |                                                                       |
 3|    For purposes of this section, the following definitions shall      |
  |                                                                       |
 4|apply:                                                                 |
  |                                                                       |
 5|    1.  "Social networking" or "social media" means interaction with   |
  |                                                                       |
 6|external websites or services based upon participant contributions     |
  |                                                                       |
 7|to the content.  Types of social media include social and              |
  |                                                                       |
 8|professional networks, blogs, micro blogs, video or photo sharing      |
  |                                                                       |
 9|and social bookmarking; and                                            |
  |                                                                       |
10|    2.  "Comment" means a response to an article or social media       |
  |                                                                       |
11|content submitted by a commenter.                                      |
  |                                                                       |
12|    B.  The social media and social networking policy developed by     |
  |                                                                       |
13|each agency and political subdivision of this state utilizing the      |
  |                                                                       |
14|guidelines established in this section shall apply to all state        |
  |                                                                       |
15|employees and employees of any political subdivision of this state     |
  |                                                                       |
16|who utilize social media or social networking networks for work        |
  |                                                                       |
17|purposes.                                                              |
  |                                                                       |
18|    C.  Social media and social networking policies developed by       |
  |                                                                       |
19|each agency and political subdivision of this state shall discourage   |
  |                                                                       |
20|the sharing of content or comments by state employees and employees    |
  |                                                                       |
21|of any political subdivision of this state containing the following,   |
  |                                                                       |
22|when it is directed at a citizen of the State of Oklahoma:             |
  |                                                                       |
23|    1.  Obscene sexual content or links to obscene sexual content;     |
  |                                                                       |
24|    2.  Abusive behavior and bullying language or tone;                |
  |                                                                       |

 1|    3.  Conduct or encouragement of illegal activity; and              |
  |                                                                       |
 2|    4.  Disclosure of information which an agency and its employees    |
  |                                                                       |
 3|are required to keep confidential by law, regulation or internal       |
  |                                                                       |
 4|policy.                                                                |
  |                                                                       |
 5|    D.  Social media and social networking policies developed by       |
  |                                                                       |
 6|each state agency and political subdivision of this state in           |
  |                                                                       |
 7|accordance with the requirements established in this section shall     |
  |                                                                       |
 8|be distributed to each affected employee by email.                     |
  |                                                                       |
 9|    E.  The state or a political subdivision shall not be liable if    |
  |                                                                       |
10|a loss or claim results from any action undertaken in their            |
  |                                                                       |
11|discretion pursuant to the provisions of this act.                     |
  |                                                                       |
12|    SECTION 2.  This act shall become effective November 1, 2019.      |
  |                                                                       |
