 8|       An Act relating to elections; amending 26 O.S. 2011,            |
  |       Section 7-138, which relates to voting credit;                  |
 9|       prohibiting disclosure of method of voting; providing           |
  |       exceptions; defining term; authorizing prescribing of           |
10|       procedures; and providing an effective date.                    |

13|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
14|    SECTION 1.     AMENDATORY     26 O.S. 2011, Section 7-138, is      |
  |                                                                       |
15|amended to read as follows:                                            |
  |                                                                       |
16|    Section 7-138.  A.  Following the election, the secretary of the   |
  |                                                                       |
17|county election board shall cause each registered voter who cast a     |
  |                                                                       |
18|ballot to be credited with voting in said election according to        |
  |                                                                       |
19|procedures specified by the Secretary of the State Election Board.     |
  |                                                                       |
20|    B.  1.  The secretary of the county election board shall record    |
  |                                                                       |
21|a voter's method of voting for each voter in the voter credit          |
  |                                                                       |
22|described in subsection A of this section, but shall not disclose to   |
  |                                                                       |
23|the public the method of voting for any voter except as allowed in     |
  |                                                                       |
24|this subsection.                                                       |

 1|    2.  A voter's method of voting contained in the voter history      |
  |                                                                       |
 2|record shall not be a public record except for an election held on     |
  |                                                                       |
 3|the date of:                                                           |
  |                                                                       |
 4|         a.    a regularly scheduled federal or state election, or     |
  |                                                                       |
 5|         b.    a statewide special election for a state question.      |
  |                                                                       |
 6|    3.  For the purposes of this section, "method of voting" shall     |
  |                                                                       |
 7|mean an indication or identification of the method used by a voter     |
  |                                                                       |
 8|to cast a ballot, including:                                           |
  |                                                                       |
 9|         a.    in person on election day,                              |
  |                                                                       |
10|         b.    in-person absentee,                                     |
  |                                                                       |
11|         c.    absentee, or                                            |
  |                                                                       |
12|         d.    any other method of voting authorized by law.           |
  |                                                                       |
13|    C.  The Secretary of the State Election Board shall prescribe      |
  |                                                                       |
14|such procedures as may be necessary to implement the provisions of     |
  |                                                                       |
15|this section.                                                          |
  |                                                                       |
16|    SECTION 2.  This act shall become effective November 1, 2021.      |
