 7|       An Act relating to prison system training program;              |
  |       providing for a hospice care training program within            |
 8|       the state prison system; providing for training                 |
  |       requirements; providing for review of applicants;               |
 9|       providing for program completion certificates;                  |
  |       providing authority for promulgation of rules;                  |
10|       providing for construal of provision; providing for             |
  |       codification; and providing an effective date.                  |

  |                                                                       |
14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
15|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
16|in the Oklahoma Statutes as Section 1-863 of Title 63, unless there    |
  |                                                                       |
17|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
18|    A.  The Department of Corrections may establish a Nurse Aide       |
  |                                                                       |
19|training program for eligible inmates, who are in work assignments,    |
  |                                                                       |
20|which will provide long-term end-of-life care to fellow inmates.       |
  |                                                                       |
21|The curriculum will follow established training requirements for       |
  |                                                                       |
22|Nurse Aides as provided in Section 1-1951 of Title 63 of the           |
  |                                                                       |
23|Oklahoma Statutes.  The Chief Medical Officer of the Department of     |
  |                                                                       |
24|Corrections will have oversight of the training program.               |

 1|    B.  Inmates with convictions pursuant to the provisions of         |
  |                                                                       |
 2|Section 1-1950.1 of Title 63 of the Oklahoma Statutes are prohibited   |
  |                                                                       |
 3|from participation unless written permission to participate is         |
  |                                                                       |
 4|granted by the State Department of Health.  Eligible inmates are       |
  |                                                                       |
 5|subject to a criminal background check, as provided in Section         |
  |                                                                       |
 6|1-1947 of Title 63 of the Oklahoma Statutes.                           |
  |                                                                       |
 7|    C.  Upon successful completion of the training program provided    |
  |                                                                       |
 8|for in this section, the Department of Corrections shall issue a       |
  |                                                                       |
 9|program completion certificate to the inmate.  The Department of       |
  |                                                                       |
10|Corrections in cooperation with the State Department of Health and     |
  |                                                                       |
11|the Oklahoma Department of Career and Technology Education shall       |
  |                                                                       |
12|develop appropriate processes to submit notice of training             |
  |                                                                       |
13|completion and application for licensure or certification to the       |
  |                                                                       |
14|State Department of Health in a manner prescribed by the State         |
  |                                                                       |
15|Department of Health.                                                  |
  |                                                                       |
16|    D.  The Department of Corrections, in consultation with the        |
  |                                                                       |
17|State Department of Health, shall have authority to promulgate rules   |
  |                                                                       |
18|to maintain the curriculum established pursuant to subsection A of     |
  |                                                                       |
19|this section.                                                          |
  |                                                                       |
20|    E.  Nothing in this section shall be construed to establish a      |
  |                                                                       |
21|right to employment with any licensed hospice provider.                |
  |                                                                       |
22|    SECTION 2.  This act shall become effective November 1, 2021.      |
  |                                                                       |
