 7|       An Act relating to schools; requiring school district           |
  |       to spend certain percentage of budget on                        |
 8|       instructional expenditures; mandating annual increase           |
  |       to comply with requirement; providing for written               |
 9|       warning notice for failure to comply; prescribing               |
  |       posting warning notice on district website; requiring           |
10|       increased compensation for failure to comply for four           |
  |       consecutive years; stating increase is permanent;               |
11|       defining terms; providing for codification; and                 |
  |       providing an effective date.                                    |

14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
15|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
16|in the Oklahoma Statutes as Section 5-128.3 of Title 70, unless        |
  |                                                                       |
17|there is created a duplication in numbering, reads as follows:         |
  |                                                                       |
18|    A.  Beginning with the 2020-2021 school year, the board of         |
  |                                                                       |
19|education of each school district shall spend no less than sixty       |
  |                                                                       |
20|percent (60%) of its annual budget on instructional expenditures.      |
  |                                                                       |
21|    B.  If a school district spends less than sixty percent (60%) of   |
  |                                                                       |
22|its annual budget on instructional expenditures, it shall increase     |
  |                                                                       |
23|its instructional expenditures by no less than two percent (2%) each   |
  |                                                                       |

 1|year until the amount spent on instructional expenditures reaches      |
  |                                                                       |
 2|sixty percent (60%) of its annual budget.                              |
  |                                                                       |
 3|    C.  If a school district spends less than sixty percent (60%) of   |
  |                                                                       |
 4|its annual budget on instructional expenditures and does not           |
  |                                                                       |
 5|increase its spending as provided in subsection B of this section,     |
  |                                                                       |
 6|the school district shall receive a written warning notice from the    |
  |                                                                       |
 7|State Department of Education.  The notice shall also be posted on     |
  |                                                                       |
 8|the website of the school district.                                    |
  |                                                                       |
 9|    D.  If a school district spends less than sixty percent (60%) of   |
  |                                                                       |
10|its annual budget on instructional expenditures and does not           |
  |                                                                       |
11|increase its spending as provided in subsection B of this section      |
  |                                                                       |
12|for four (4) consecutive years after receiving the notice provided     |
  |                                                                       |
13|in subsection C of this section, the school district shall increase    |
  |                                                                       |
14|compensation for all teachers in the school district by two percent    |
  |                                                                       |
15|(2%) for each year in that period in which the school district did     |
  |                                                                       |
16|not increase instructional expenses by a minimum of two percent        |
  |                                                                       |
17|(2%).  The pay increase required pursuant to this subsection shall     |
  |                                                                       |
18|be permanent.                                                          |
  |                                                                       |
19|    E.  As used in this section:                                       |
  |                                                                       |
20|    1.  "Annual budget" means a plan of financial operations using     |
  |                                                                       |
21|revenues contributed from local, state and federal sources but shall   |
  |                                                                       |
22|not include revenue received from bond sales, the sale of property     |
  |                                                                       |
23|or equipment, school fundraisers or nonprofit organization             |
  |                                                                       |
24|contributions or grants; and                                           |
  |                                                                       |

 1|    2.  "Instructional expenditures" means current expenditures for    |
  |                                                                       |
 2|activities directly related to the interaction between teacher and     |
  |                                                                       |
 3|students and includes salaries and benefits for teachers and           |
  |                                                                       |
 4|instructional aides, textbooks, supplies and purchased instructional   |
  |                                                                       |
 5|services such as instruction via television, webinars and other        |
  |                                                                       |
 6|online instruction.  Also included are tuition expenditures to other   |
  |                                                                       |
 7|schools.                                                               |
  |                                                                       |
 8|    SECTION 2.  This act shall become effective November 1, 2019.      |
  |                                                                       |
