 8|       An Act relating to school truancy; requiring State              |
  |       Board of Education to provide truant student                    |
 9|       information to the Office of Child Abuse Prevention;            |
  |       establishing procedure for exchange of information;             |
10|       mandating compliance with privacy laws; requiring               |
  |       district attorney to report truancy convictions;                |
11|       providing for inclusion of data in annual report by             |
  |       Office; directing Office to review records; providing           |
12|       for a family assessment to offer or refer services;             |
  |       requiring the State Board of Education to provide               |
13|       access to certain information and reports to Child              |
  |       Welfare Services; providing for establishment of                |
14|       procedure for exchange of information; providing for            |
  |       codification; and providing an effective date.                  |

17|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
18|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
19|in the Oklahoma Statutes as Section 24-120.1 of Title 70, unless       |
  |                                                                       |
20|there is created a duplication in numbering, reads as follows:         |
  |                                                                       |
21|    A.  The State Board of Education shall supply the Office of        |
  |                                                                       |
22|Child Abuse Prevention within the State Department of Health with      |
  |                                                                       |
23|access to the identifying information of individuals who have been     |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|detained or reported pursuant to Section 10-109 or subsection A of     |
  |                                                                       |
 2|Section 24-120 of Title 70 of the Oklahoma Statutes.                   |
  |                                                                       |
 3|    B.  The Office of Child Abuse Prevention and the State Board of    |
  |                                                                       |
 4|Education shall establish a procedure for the exchange of              |
  |                                                                       |
 5|information required by this section.  Any procedure established       |
  |                                                                       |
 6|shall, if applicable, comply with the requirements of the Family       |
  |                                                                       |
 7|Educational Rights and Privacy Act, 20 U.S.C., Section 1232g et seq.   |
  |                                                                       |
 8|and any other applicable federal law.                                  |
  |                                                                       |
 9|    C.  The district attorney shall provide the Office of Child        |
  |                                                                       |
10|Abuse Prevention with a copy of all reports pursuant to subsection D   |
  |                                                                       |
11|of Section 24-120 of Title 70 of the Oklahoma Statutes.                |
  |                                                                       |
12|    D.  The Office of Child Abuse Prevention shall include these       |
  |                                                                       |
13|statistics in the annual report provided for in Section 1-227.2 of     |
  |                                                                       |
14|Title 63 of the Oklahoma Statutes.                                     |
  |                                                                       |
15|    E.  The Office of Child Abuse Prevention or other State            |
  |                                                                       |
16|Department of Health staff shall review the records provided to the    |
  |                                                                       |
17|Office of Child Abuse Prevention by the State Board of Education or    |
  |                                                                       |
18|district attorneys and, when appropriate and if the resources are      |
  |                                                                       |
19|available, provide an assessment of the family in order to offer or    |
  |                                                                       |
20|refer services if needed.                                              |
  |                                                                       |
21|    F.  The State Board of Education shall supply Child Welfare        |
  |                                                                       |
22|Services of the Department of Human Services with access to            |
  |                                                                       |
23|identifying information and updated and accurate school attendance     |
  |                                                                       |
24|reports of individuals with documented developmental disabilities.     |

 1|The State Board of Education and Child Welfare Services shall          |
  |                                                                       |
 2|establish a procedure for the exchange of information required by      |
  |                                                                       |
 3|this subsection.                                                       |
  |                                                                       |
 4|    SECTION 2.  This act shall become effective November 1, 2019.      |
  |                                                                       |
