  |       An Act relating to the Commissioners of the Land                |
12|       Office; amending 70 O.S. 2011, Section 3904, which              |
  |       relates to school land funds; directing distribution            |
13|       to state colleges and junior colleges; requiring                |
  |       equal distribution among specified institutions;                |
14|       providing an effective date; and declaring an                   |
  |       emergency.                                                      |

18|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
19|    SECTION 1.     AMENDATORY     70 O.S. 2011, Section 3904, is       |
  |                                                                       |
20|amended to read as follows:                                            |
  |                                                                       |
21|    Section 3904.  A.  The income, interest, rentals and proceeds of   |
  |                                                                       |
22|the sale of Section Thirteen in this state, and any indemnity lands    |
  |                                                                       |
23|in lieu of Section Thirteen which were granted to the state for the    |
  |                                                                       |
24|use and benefit of the University of Oklahoma, Oklahoma State          |
  |                                                                       |

 1|University, the Normal Schools, the University Preparatory School,     |
  |                                                                       |
 2|and Langston University, shall be divided and distributed as           |
  |                                                                       |
 3|follows:                                                               |
  |                                                                       |
 4|    To the University of Oklahoma and the Northern Oklahoma College,   |
  |                                                                       |
 5|one-third (1/3); the University of Oklahoma to receive nine-tenths     |
  |                                                                       |
 6|(9/10) of said one-third (1/3) and the Northern Oklahoma College to    |
  |                                                                       |
 7|receive one-tenth (1/10) of said one-third (1/3); to the Oklahoma      |
  |                                                                       |
 8|State University and Langston University, one-third (1/3); the         |
  |                                                                       |
 9|Oklahoma State University to receive nine-tenths (9/10) of said        |
  |                                                                       |
10|one-third (1/3), and Langston University to receive one-tenth (1/10)   |
  |                                                                       |
11|of said one-third (1/3); to the University of Central Oklahoma, East   |
  |                                                                       |
12|Central University, Northeastern State University, Northwestern        |
  |                                                                       |
13|Oklahoma State University, Southeastern Oklahoma State University,     |
  |                                                                       |
14|Southwestern Oklahoma State University, Oklahoma Panhandle State       |
  |                                                                       |
15|University, University of Sciences and Arts of Oklahoma, and Cameron   |
  |                                                                       |
16|University, the Normal Schools, colleges and junior colleges that      |
  |                                                                       |
17|are state educational institutions as defined in Section 3102 of       |
  |                                                                       |
18|this title, one-third (1/3), the same to be equally divided among      |
  |                                                                       |
19|said state colleges and junior colleges, provided, that in the event   |
  |                                                                       |
20|of the establishment of additional similar state colleges or junior    |
  |                                                                       |
21|colleges, such additional state colleges and junior colleges shall     |
  |                                                                       |
22|share equally with the other state colleges and junior colleges in     |
  |                                                                       |
23|the division and distribution of the one-third (1/3) last above        |
  |                                                                       |
24|mentioned.  In the event of the sale of Section Thirteen, or any       |
  |                                                                       |

 1|portion thereof, the proceeds of said sale shall be divided and        |
  |                                                                       |
 2|distributed among said institutions in the same manner, proportion     |
  |                                                                       |
 3|and amount as hereinbefore indicated for the division and              |
  |                                                                       |
 4|distribution of the interest, income, rentals or proceeds thereof of   |
  |                                                                       |
 5|said land; provided, that the said lands so reserved, or the           |
  |                                                                       |
 6|proceeds of the sale thereof or of any indemnity land granted in       |
  |                                                                       |
 7|lieu of Section Thirteen, shall be safely kept or invested and         |
  |                                                                       |
 8|preserved by the state as a trust, which shall never be diminished,    |
  |                                                                       |
 9|but may be added to, and the income, interest and rentals thereof,     |
  |                                                                       |
10|shall be used exclusively for the benefit of said educational          |
  |                                                                       |
11|institutions.  Such additional institutions shall remain under the     |
  |                                                                       |
12|exclusive control of the state, and no part of the proceeds arising    |
  |                                                                       |
13|from the sale or disposal of any land granted for educational          |
  |                                                                       |
14|purposes, or the income or rentals thereof, shall be used for the      |
  |                                                                       |
15|support of any religious or sectarian school, college or university,   |
  |                                                                       |
16|and no portion of the funds arising from the sale of Section           |
  |                                                                       |
17|Thirteen or any indemnity land, shall ever be diverted either          |
  |                                                                       |
18|temporarily or permanently from the purpose for which said lands       |
  |                                                                       |
19|were granted to the state.                                             |
  |                                                                       |
20|    B.  The state educational institutions eligible for                |
  |                                                                       |
21|participation in the Section Thirteen Fund and the new college fund    |
  |                                                                       |
22|may expend monies in such funds from time to time as needs arise for   |
  |                                                                       |
23|the construction and purchase of buildings, for the purchase of        |
  |                                                                       |
24|                                                                       |
  |                                                                       |

 1|equipment, and for other capital additions.  The provisions of this    |
  |                                                                       |
 2|section shall be cumulative to existing laws.                          |
  |                                                                       |
 3|    SECTION 2.  This act shall become effective July 1, 2019.          |
  |                                                                       |
 4|    SECTION 3.  It being immediately necessary for the preservation    |
  |                                                                       |
 5|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
 6|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
 7|be in full force from and after its passage and approval.              |
