14|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
15|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
16|in the Oklahoma Statutes as Section 24-157 of Title 70, unless there   |
  |                                                                       |
17|is created a duplication in numbering, reads as follows:               |
  |                                                                       |
18|    A.  The "Oklahoma Prevention Needs Assessment Survey" means the    |
  |                                                                       |
19|biennial mental health prevention survey of public school students     |
  |                                                                       |
20|in grades six, eight, ten and twelve managed by the Department of      |
  |                                                                       |
21|Mental Health and Substance Abuse Services.                            |
  |                                                                       |
22|    B.  Beginning in the 2022-2023 school year, and biennially         |
  |                                                                       |
23|thereafter, public schools shall administer the Oklahoma Prevention    |
  |                                                                       |
24|Needs Assessment Survey, or an alternative survey as provided in       |
  |                                                                       |

 1|subsection D of this section, for the purpose of providing direction   |
  |                                                                       |
 2|to schools, school districts and communities to effectively improve    |
  |                                                                       |
 3|the lives of students regarding a variety of issues with a focus on    |
  |                                                                       |
 4|alcohol, tobacco, other drug use, mental health, academic failure      |
  |                                                                       |
 5|and violence.                                                          |
  |                                                                       |
 6|    C.  The Department of Mental Health and Substance Abuse Services   |
  |                                                                       |
 7|shall maintain the Oklahoma Prevention Needs Assessment Survey and     |
  |                                                                       |
 8|shall provide technical assistance for schools in survey               |
  |                                                                       |
 9|administration, reporting, planning and development of school mental   |
  |                                                                       |
10|health prevention and intervention strategies informed by the survey   |
  |                                                                       |
11|results.                                                               |
  |                                                                       |
12|    D.  If a school or school district chooses to administer an        |
  |                                                                       |
13|alternative survey or assessment tool to fulfill the purpose           |
  |                                                                       |
14|described in subsection B of this section, it may apply for a waiver   |
  |                                                                       |
15|through the Department of Mental Health and Substance Abuse            |
  |                                                                       |
16|Services.                                                              |
  |                                                                       |
17|    E.  The provisions of this section shall be subject to the         |
  |                                                                       |
18|availability of federal funding.  If federal funding is insufficient   |
  |                                                                       |
19|to provide the Oklahoma Prevention Needs Assessment Survey to public   |
  |                                                                       |
20|schools on a biennial basis, administration of the survey shall not    |
  |                                                                       |
21|be required.                                                           |
  |                                                                       |
22|    F.  The Board of Mental Health and Substance Abuse Services and    |
  |                                                                       |
23|the State Board of Education may promulgate rules as necessary to      |
  |                                                                       |
24|carry out the provisions of this section.                              |
