11|       An Act relating to schools; amending 70 O.S. 2011,              |
  |       Section 24-100.3, as amended by Section 2, Chapter              |
12|       311, O.S.L. 2013 (70 O.S. Supp. 2018, Section                   |
  |       24-100.3), which relates to the School Safety and               |
13|       Bullying Prevention Act; modifying bullying                     |
  |       definition; adding term; and providing an effective             |
14|       date.                                                           |

17|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
18|    SECTION 1.     AMENDATORY     70 O.S. 2011, Section 24-100.3, as   |
  |                                                                       |
19|amended by Section 2, Chapter 311, O.S.L. 2013 (70 O.S. Supp. 2018,    |
  |                                                                       |
20|Section 24-100.3), is amended to read as follows:                      |
  |                                                                       |
21|    Section 24-100.3  A.  As used in the School Safety and Bullying    |
  |                                                                       |
22|Prevention Act:                                                        |
  |                                                                       |
23|    1.  "Bullying" means any pattern of harassment, intimidation,      |
  |                                                                       |
24|threatening behavior, physical acts, verbal or unwanted, threatening   |
  |                                                                       |

 1|or aggressive behavior committed in person or by electronic            |
  |                                                                       |
 2|communication directed toward a student or group of students that      |
  |                                                                       |
 3|results in or is reasonably perceived as being done with the intent    |
  |                                                                       |
 4|to cause negative educational or physical results for the targeted     |
  |                                                                       |
 5|individual or group and is communicated in such a way as to disrupt    |
  |                                                                       |
 6|or interfere with the school's educational mission or the education    |
  |                                                                       |
 7|of any student involves a real or perceived power imbalance and is     |
  |                                                                       |
 8|repeated or creates the fear it will be repeated.  Bullying actions    |
  |                                                                       |
 9|shall include but not be limited to making threats, spreading          |
  |                                                                       |
10|rumors, attacking someone physically or verbally and excluding         |
  |                                                                       |
11|someone from a group as a means of causing harm;                       |
  |                                                                       |
12|    2.  "Power imbalance" means the attempt by a perpetrator to use    |
  |                                                                       |
13|observed or perceived personal or situational characteristics to       |
  |                                                                       |
14|exert control over a targeted student's behavior or limit a victim's   |
  |                                                                       |
15|ability to respond or stop the aggression;                             |
  |                                                                       |
16|    3.  "At school" means on school grounds, in school vehicles, at    |
  |                                                                       |
17|school-sponsored activities, or at school-sanctioned events;           |
  |                                                                       |
18|    3. 4.  "Electronic communication" means the communication of any   |
  |                                                                       |
19|written, verbal, pictorial information or video content by means of    |
  |                                                                       |
20|an electronic device, including, but not limited to, a telephone, a    |
  |                                                                       |
21|mobile or cellular telephone or other wireless telecommunication       |
  |                                                                       |
22|device, or a computer; and                                             |
  |                                                                       |
23|    4. 5.  "Threatening behavior" means any pattern of behavior or     |
  |                                                                       |
24|isolated action, whether or not it is directed at another person,      |
  |                                                                       |

 1|that a reasonable person would believe indicates potential for         |
  |                                                                       |
 2|future harm to students, school personnel, or school property.         |
  |                                                                       |
 3|    B.  Nothing in this act shall be construed to impose a specific    |
  |                                                                       |
 4|liability on any school district.                                      |
  |                                                                       |
 5|    SECTION 2.  This act shall become effective November 1, 2019.      |
  |                                                                       |
