 9|       An Act relating to schools; directing local school              |
  |       districts to conduct an annual fitness assessment;              |
10|       requiring assessments to include certain methods,               |
  |       factors and standards; requiring annual submission of           |
11|       certain results; requiring the State Board of                   |
  |       Education to adopt and disseminate certain standards            |
12|       and benchmarks; authorizing certain funding;                    |
  |       requiring annual report be submitted to the Governor;           |
13|       authorizing the Governor to establish recognition               |
  |       programs; authorizing certain collaboration;                    |
14|       requiring certain posting on the Board's website;               |
  |       providing for codification; providing an effective              |
15|       date; and declaring an emergency.                               |

19|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
20|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
21|in the Oklahoma Statutes as Section 11-103.9b of Title 70, unless      |
  |                                                                       |
22|there is created a duplication in numbering, reads as follows:         |
  |                                                                       |
23|    A.  Beginning in the 2019-2020 school year, each local school      |
  |                                                                       |
24|district shall conduct an annual fitness assessment, as approved by    |
  |                                                                       |

 1|the State Board of Education, each school year for students in         |
  |                                                                       |
 2|grades four through eight, to be conducted only during a physical      |
  |                                                                       |
 3|education course in which a student is enrolled.  Such assessments     |
  |                                                                       |
 4|shall include methods deemed by the State Board of Education as        |
  |                                                                       |
 5|appropriate to ascertain levels of student physical fitness and        |
  |                                                                       |
 6|include the factors and standards required in subsection B of this     |
  |                                                                       |
 7|section.                                                               |
  |                                                                       |
 8|     B.  The minimum required contents of the assessment shall         |
  |                                                                       |
 9|address the measurements and assessment instruments to be used by a    |
  |                                                                       |
10|school district in assessing student physical fitness under this       |
  |                                                                       |
11|section.  The assessment instruments shall:                            |
  |                                                                       |
12|     1.  Be based on factors related to student health, including      |
  |                                                                       |
13|the following factors that have been identified as essential to        |
  |                                                                       |
14|overall health and function:                                           |
  |                                                                       |
15|         a.    aerobic capacity,                                       |
  |                                                                       |
16|         b.    body composition, and                                   |
  |                                                                       |
17|         c.    muscular strength, endurance and flexibility; and       |
  |                                                                       |
18|     2.  Include criterion-referenced standards specific to a          |
  |                                                                       |
19|student's age and gender and based on the physical fitness level       |
  |                                                                       |
20|required for good health.                                              |
  |                                                                       |
21|     C.  A school district shall annually provide the results of       |
  |                                                                       |
22|individual student performance on the physical fitness assessment      |
  |                                                                       |
23|required by this section to the State Board of Education.  The         |
  |                                                                       |

 1|results shall not contain the name of the individual students, the     |
  |                                                                       |
 2|student's Social Security number or the student's date of birth.       |
  |                                                                       |
 3|    D.  The State Board of Education shall adopt and disseminate to    |
  |                                                                       |
 4|local school districts standards which adequately express the most     |
  |                                                                       |
 5|current and widely accepted best practices and benchmarks in the       |
  |                                                                       |
 6|areas of student health and physical education.  The State Board of    |
  |                                                                       |
 7|Education's efforts may be supported with state, federal or private    |
  |                                                                       |
 8|funding or a combination thereof.                                      |
  |                                                                       |
 9|    E.  The State Board of Education shall submit an annual report     |
  |                                                                       |
10|to the Governor, beginning October 1, 2020, and annually thereafter.   |
  |                                                                       |
11| The report shall include the compliance status of each local school   |
  |                                                                       |
12|district.  The Governor may, in coordination with the State Board of   |
  |                                                                       |
13|Education, establish one or more recognition programs to acknowledge   |
  |                                                                       |
14|local school districts and schools which have most improved in their   |
  |                                                                       |
15|physical fitness assessments.  The Governor may collaborate with       |
  |                                                                       |
16|private corporations in the development and implementation of          |
  |                                                                       |
17|recognition programs pursuant to this subsection, including            |
  |                                                                       |
18|providing monetary or other incentives to local school districts or    |
  |                                                                       |
19|schools for attaining certain levels of health status.  All local      |
  |                                                                       |
20|school districts or schools receiving acknowledgment through a         |
  |                                                                       |
21|recognition program established by the Governor pursuant to this       |
  |                                                                       |
22|subsection shall also be recognized on the State Board of              |
  |                                                                       |
23|Education's website.                                                   |
  |                                                                       |
24|    SECTION 2.  This act shall become effective July 1, 2019.          |

 1|    SECTION 3.  It being immediately necessary for the preservation    |
  |                                                                       |
 2|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
 3|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
 4|be in full force from and after its passage and approval.              |
