 7|       An Act relating to Council on Law Enforcement                   |
  |       Education and Training; amending Section 1, Chapter             |
 8|       168, O.S.L. 2018 (70 O.S. Supp. 2020, Section                   |
  |       3311.16), which relates to authority of CLEET to                |
 9|       conduct training; allowing CLEET to establish and               |
  |       certify certain programs at technology center                   |
10|       schools; updating language and internal citations;              |
  |       and providing an effective date.                                |

12|                                                                       |
  |                                                                       |
13|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
14|    SECTION 1.     AMENDATORY     Section 1, Chapter 168, O.S.L.       |
  |                                                                       |
15|2018 (70 O.S. Supp. 2020, Section 3311.16), is amended to read as      |
  |                                                                       |
16|follows:                                                               |
  |                                                                       |
17|    Section 3311.16  A.  1.  The Council on Law Enforcement            |
  |                                                                       |
18|Education and Training (CLEET) is authorized to conduct full-time      |
  |                                                                       |
19|Basic Peace Officer Certification Academies and other law              |
  |                                                                       |
20|enforcement related training for individuals not commissioned or       |
  |                                                                       |
21|appointed by a law enforcement agency under rules established by the   |
  |                                                                       |
22|Council.                                                               |
  |                                                                       |
23|    2.  CLEET may establish and certify additional law enforcement     |
  |                                                                       |
24|and criminal justice programs at state-supported technology center     |
  |                                                                       |

 1|schools in the State of Oklahoma operating under the State Board of    |
  |                                                                       |
 2|Career and Technology Education for teaching students between          |
  |                                                                       |
 3|sixteen (16) and nineteen (19) years of age.  The tuition or fees      |
  |                                                                       |
 4|for law enforcement and criminal justice-related programs shall be     |
  |                                                                       |
 5|similar in cost as other vocational and technical education courses    |
  |                                                                       |
 6|and subjects offered at technology center schools and shall be         |
  |                                                                       |
 7|determined by the State Board of Career and Technology Education.      |
  |                                                                       |
 8|    B.  The tuition and/or or fees for attending the Basic Peace       |
  |                                                                       |
 9|Officer Certification Academies and/or or other law enforcement        |
  |                                                                       |
10|related training will be at a rate established by CLEET and approved   |
  |                                                                       |
11|by the Council.  Tuition and/or or fees charged under this section     |
  |                                                                       |
12|will shall be deposited in the Peace Officer Revolving Fund            |
  |                                                                       |
13|established in Section 3311.7 of Title 70 of the Oklahoma Statues      |
  |                                                                       |
14|this title.                                                            |
  |                                                                       |
15|    C.  Individuals not commissioned or appointed by a law             |
  |                                                                       |
16|enforcement agency who are trained in the Basic Peace Officer          |
  |                                                                       |
17|Certification Academies will shall be required to meet minimum         |
  |                                                                       |
18|requirements established for peace officers as set forth in Section    |
  |                                                                       |
19|3311 of Title 70 of the Oklahoma Statutes this title.  Any fees        |
  |                                                                       |
20|relating to meeting these requirements shall be the responsibility     |
  |                                                                       |
21|of the individual.  Individuals applying for the Academies will        |
  |                                                                       |
22|shall be required to submit a fingerprint check to CLEET prior to      |
  |                                                                       |
23|acceptance.                                                            |

 1|    D.  The Council is authorized to promulgate emergency rules to     |
  |                                                                       |
 2|effectuate the provisions of this subsection section.                  |
  |                                                                       |
 3|    E.  Upon successful completion of the Basic Peace Officer          |
  |                                                                       |
 4|Certification Academy, the individual's CLEET certification will of    |
  |                                                                       |
 5|the individual shall become effective upon employment by an Oklahoma   |
  |                                                                       |
 6|law enforcement agency.  Employment and certification must be          |
  |                                                                       |
 7|obtained within two (2) years of completion of the Basic Peace         |
  |                                                                       |
 8|Officer Certification Academy.                                         |
  |                                                                       |
 9|    SECTION 2.  This act shall become effective November 1, 2021.      |
  |                                                                       |
