13|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
14|    SECTION 1.     NEW LAW     A new section of law to be codified     |
  |                                                                       |
15|in the Oklahoma Statutes as Section 11-103.6m of Title 70, unless      |
  |                                                                       |
16|there is created a duplication in numbering, reads as follows:         |
  |                                                                       |
17|    A.  As used in this section:                                       |
  |                                                                       |
18|    1.  "HIV" or "Human Immunodeficiency Virus" means a human          |
  |                                                                       |
19|retrovirus known to cause AIDS; and                                    |
  |                                                                       |
20|    2.  "AIDS" or "Acquired Immune Deficiency Syndrome" means the      |
  |                                                                       |
21|final and most serious stage of HIV causing damage to the immune       |
  |                                                                       |
22|system and includes a number of opportunistic infections which can     |
  |                                                                       |
23|result in death.                                                       |

 1|    B.  Each school district in the state shall provide                |
  |                                                                       |
 2|age-appropriate instruction about HIV, AIDS and related issues:        |
  |                                                                       |
 3|    1.  At the option of the local school district, a minimum of       |
  |                                                                       |
 4|once during the period from grades five through six;                   |
  |                                                                       |
 5|    2.  A minimum of once during the period from grades seven          |
  |                                                                       |
 6|through nine; and                                                      |
  |                                                                       |
 7|    3.  A minimum of once during the period from grades ten through    |
  |                                                                       |
 8|twelve, with heightened emphasis on modes of transmission,             |
  |                                                                       |
 9|prevention methods, virology and relevant statistics.                  |
  |                                                                       |
10|    C.  The instruction shall include:                                 |
  |                                                                       |
11|    1.  The definition of HIV and AIDS;                                |
  |                                                                       |
12|    2.  How the virus is transmitted;                                  |
  |                                                                       |
13|    3.  How the virus is not transmitted;                              |
  |                                                                       |
14|    4.  An analysis of the transmission and methods of prevention      |
  |                                                                       |
15|for sexually transmitted diseases (STDs) and HIV, with an emphasis     |
  |                                                                       |
16|on abstinence from sex and intravenous drug use;                       |
  |                                                                       |
17|    5.  Identification of risk behaviors and situations involving      |
  |                                                                       |
18|possible exposure to HIV; and                                          |
  |                                                                       |
19|    6.  Refusal skills, negotiating skills and peer-resistance         |
  |                                                                       |
20|skills.                                                                |
  |                                                                       |
21|    D.  The State Department of Education shall create or implement    |
  |                                                                       |
22|medically accurate instructional materials for HIV education.  A       |
  |                                                                       |
23|school district may elect to create or implement its own HIV           |
  |                                                                       |
24|education instructional materials; provided, any instructional         |
  |                                                                       |

 1|materials shall be approved by the State Department of Health for      |
  |                                                                       |
 2|medical accuracy.                                                      |
  |                                                                       |
 3|    E.  The provisions of this section shall comply with the           |
  |                                                                       |
 4|Parents' Bill of Rights as provided in Section 2003 of Title 25 of     |
  |                                                                       |
 5|the Oklahoma Statutes.                                                 |
  |                                                                       |
 6|    F.  All materials used in the instruction provided pursuant to     |
  |                                                                       |
 7|this section shall comply with Section 11-105.1 of Title 70 of the     |
  |                                                                       |
 8|Oklahoma Statutes.                                                     |
  |                                                                       |
 9|    SECTION 2.     REPEALER     70 O.S. 2011, Section 11-103.3, is     |
  |                                                                       |
10|hereby repealed.                                                       |
  |                                                                       |
11|    SECTION 3.  This act shall become effective July 1, 2019.          |
  |                                                                       |
12|    SECTION 4.  It being immediately necessary for the preservation    |
  |                                                                       |
13|of the public peace, health or safety, an emergency is hereby          |
  |                                                                       |
14|declared to exist, by reason whereof this act shall take effect and    |
  |                                                                       |
15|be in full force from and after its passage and approval.              |
