
|ENROLLED SENATE | |BILL NO. 348 By: Myers of the Senate | | | | and | | | | DeWitt, Sanders, Fields and | | Wright (John) of the House | | | | | | | | | | | | | | An Act relating to cities and counties; authorizing | | municipalities to offer reward for convictions | | relating to theft and defacing municipal property; | | authorizing municipalities to establish reward fund; | | authorizing certain fines to be deposited in reward | | fund; providing exception; amending 19 O.S. 2001, | | Section 455, which relates to county reward funds; | | modifying amount of certain rewards and reward funds; | | providing for codification; and declaring an | | emergency. | | | | | | | | | |BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: | | | | SECTION 1. NEW LAW A new section of law to be codified | |in the Oklahoma Statutes as Section 14-114 of Title 11, unless there | |is created a duplication in numbering, reads as follows: | | | | A. A municipal governing body is authorized to offer and pay a | |reward, from municipal funds, in an amount not to exceed One | |Thousand Dollars ($1,000.00) for the arrest and conviction, or for | |evidence leading to the arrest and conviction of any person stealing | |or defacing municipal road signs or other municipal owned property. | | | | B. The municipal governing body may create and maintain a | |reward fund from which to pay the rewards provided for in subsection | |A of this section. The municipal governing body shall determine the | |amount and source of funds necessary to pay the rewards authorized | |in subsection A of this section. | | | | C. Any person convicted of theft or defacing municipal road | |signs or other municipal owned property may, in lieu of other fines | | | arsid8336531 ENR. S. B. |and penalties, be required to deposit like amount into the reward | |fund established pursuant to this section. | | | | D. A municipal governing body shall not be required to provide | |rewards or create a reward fund pursuant to the provisions of this | |section. | | | | SECTION 2. AMENDATORY 19 O.S. 2001, Section 455, is | |amended to read as follows: | | | | Section 455. A. The board of county commissioners of each | |county is hereby authorized to offer and pay a reward, from county | |funds, in an amount not to exceed©2008-09 eCapitol, LLC. All rights reserved.One Hundred Dollars ($100.00)One | |Thousand Dollars ($1,000.00) for the arrest and conviction, or for | |evidence leading to the arrest and conviction of any person stealing | |or defacing county road signs or any other county property. | | | | B. The board of county commissioners may create and maintain a | |reward fundofnot to exceedFive Hundred Dollars ($500.00)Two | |Thousand Dollars ($2,000.00) from which to pay the rewards provided | |for in subsection A of this section. | | | | C. Any person convicted under subsection A of this section, may | |in lieu of the fine, be required to deposit like amount into the | |county reward fund. | | | | SECTION 3.
