 7|       An Act relating to animals; amending 4 O.S. 2001,               |
  |       Section 43, which relates to regulation and control             |
 8|       of dogs running at large; eliminating certain                   |
  |       population restriction; and providing an effective              |
 9|       date.                                                           |

  |                                                                       |
11|                                                                       |
  |                                                                       |
12|BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:                  |
  |                                                                       |
13|    SECTION 1.     AMENDATORY     4 O.S. 2001, Section 43, is          |
  |                                                                       |
14|amended to read as follows:                                            |
  |                                                                       |
15|    Section 43.  A.  The board of county commissioners of any county   |
  |                                                                       |
16|with a population of two hundred thousand (200,000) or more            |
  |                                                                       |
17|according to the last Federal Decennial Census may regulate or         |
  |                                                                       |
18|prohibit the running at large of dogs within said the unincorporated   |
  |                                                                       |
19|areas of that county, and cause such the dogs as may be running at     |
  |                                                                       |
20|large to be impounded and disposed:                                    |
  |                                                                       |
21|    1.  Impounded;                                                     |
  |                                                                       |
22|    2.  Disposed of as otherwise provided for by law; or sold          |
  |                                                                       |
23|                                                                       |
  |                                                                       |

 1|    3.  Sold to discharge the costs and penalties provided for the     |
  |                                                                       |
 2|violation of such this prohibition and the expense of impounding and   |
  |                                                                       |
 3|keeping the same for such sale; and.                                   |
  |                                                                       |
 4|    The board of county commissioners may also provide for the         |
  |                                                                       |
 5|erection of all needful pens, pounds and buildings for the use of      |
  |                                                                       |
 6|said the county at any place within said the county.                   |
  |                                                                       |
 7|    B.  It shall be the duty of the board of county commissioners of   |
  |                                                                       |
 8|any county undertaking the regulation and taxation of dogs in said     |
  |                                                                       |
 9|the county under this act section to establish and enforce rules       |
  |                                                                       |
10|governing the same, and they shall enter into a definite cooperative   |
  |                                                                       |
11|agreement with the sheriff of said the county prescribing said the     |
  |                                                                       |
12|rules and regulations and the manner and terms of enforcement          |
  |                                                                       |
13|thereof, and for the financing and compensation therefor.              |
  |                                                                       |
14|    C.  The board of county commissioners may also regulate and        |
  |                                                                       |
15|provide for taxing the owners and harborers of dogs, and authorize     |
  |                                                                       |
16|the humane killing or disposal of dogs, found at large, contrary to    |
  |                                                                       |
17|any ordinance regulating the same.                                     |
  |                                                                       |
18|    D.  Any person, firm or corporation who violates any rule or       |
  |                                                                       |
19|regulation made by such board of county commissioners under the        |
  |                                                                       |
20|authority of this act section shall be guilty of a misdemeanor and     |
  |                                                                       |
21|shall be punished as provided by the laws of this state in any court   |
  |                                                                       |
22|of competent jurisdiction, provided that in the case of continuing     |
  |                                                                       |
23|offenses, each day on which the offense occurs shall constitute a      |
  |                                                                       |
24|separate offense.                                                      |

 1|    SECTION 2.  This act shall become effective November 1, 2009.      |
  |                                                                       |
